Section 7.12 flat rate levy contributions are one of several ways local councils can fund infrastructure. The Environmental Planning and Assessment Regulation 2000 currently sets 1% as the standard highest maximum percentage which councils can levy under a s7.12 development contributions plan. It also identifies specific areas which are subject to higher maximum percentage levies.
The department is committed to ensuring the process of assessing requests for a higher maximum percentage levy is efficient and transparent. A set of potential criteria that can be used in assessing requests for a higher maximum percentage was exhibited from 15 April 2020 until 12 June 2020.
A new Section 7.12 fixed development consent levies - Practice Note was released in February 2021 including criteria to guide councils on where higher than the standard maximum 1% percentage section 7.12 levy may be appropriate.
