I am writing to object to the modification request by the Tomingley Gold Mine, application no. MP 09_0155 MOD 3.

Our objection is based upon the following concerns;
* The severely detrimental impact the Tomingley Gold Mine is having on the health and lifestyle of those living at "Ellerslie".
* Tomingley Gold Mines previous inability to comply with their NSW EPA licensing conditions for noise at "Ellerslie".
* Excessive noise, light and dust on "Ellerslie" land adjacent to the mine.
* Excessive noise and light at our "Ellerslie" home.

The lifestyle for Gai Strahorn who lives at "Ellerslie" has been severely and detrimentally impacted since the Tomingley mine has begun operating. Gai has reported an inability to sleep due to the noise and lights of the mine. Noise that is more offensive whenever she steps outside into her garden. Consequently Gai's health is being detrimentally impacted via severe headaches and stress, that she is attributing to the constant negative impact the mine is having on her lifestyle.

Tomingley Gold mine have a history of non-compliance with the NSW EPA licensing conditions for noise at "Ellerslie".
This is confirmed by the most recent noise compliance report that stated in relation to "Ellerslie"...

"the mine noise was clearly audible on occasions and it was possible, to directly measure the 15 minute energy average (LAeq, 15 minute) mine noise without the influence of any significant extraneous noise.... at this location noise levels exceeded the 36 dBA limit on 16 out of the 32 fifteen minute measurements and was non-compliant (more than 2 dB above the limit) for 11 out of 32 fifteen minute measurements. The lights from the mine plant were visible through the trees at this location." (Noise and Sound Services Report No. nss22290-Final, October 2015. Attached.)

Given the inability to comply with their NSW EPA licensing conditions on the current mine site, we doubt the ability of any expansion works to comply with the licensing conditions either. Particularly as the expansion works are encroaching towards our "Ellerslie" home.

(It is to be noted that the sound insulation upgrade recommended in the above mentioned report has been completed and has had little effect.)

The noise compliance report makes reference to noise levels at the "Ellerslie" home. Given the house is quite a distance from the boundary of "Ellerslie" and the existing mine, and based on the excessive noise readings at the house, one can conclude that noise levels at our boundary and on our land adjacent to the mine would be extremely excessive.

Given the proposed expansion encroaches towards our "Ellerslie" home and further along our boundary, we fear all of the above-mentioned issues will be exacerbated by any mine expansion. Consequently we strongly object to this modification request.
