Proposed Reforms for Assessment of Early Learning Services

The NSW Government wants to make sure all families have access to high-quality early education. 
We are proposing changes to make it easier to deliver early learning services where they are needed most. 

The reforms aim to simplify and clarify how early learning services are assessed to support delivery in appropriate locations. 

The proposed changes apply only to childcare centres. 

An Explanation of Intended Effect outlining the proposed reforms was exhibited from 7 July to 17 August 2026. 

Thank you to everyone who provided feedback. We’re currently reviewing and considering this feedback before we finalise the policy changes. 

The proposed changes are informed by a 12-month review of development applications and consultation with councils and the early education sector. 

The changes include: 

• a new assessment framework and guidance for traffic and parking impacts 

• a more consistent approach to noise through a new acoustic assessment framework 

• greater flexibility for operating hours in appropriate circumstances  

• simpler pathways for low-impact internal works. 

These reforms relate only to how early learning services are assessed through the planning system and do not change child safety requirements or care standards.
