Dear Department,

I am a nearby resident and landholder and wish to provide comments regarding the proposed Canyonleigh Battery Energy Storage System.

Overall, of the energy and infrastructure projects proposed in our district, this proposal is the one I am least concerned about in principle. I recognise the role battery storage can play in improving electricity reliability and supporting energy transition.

However, I ask that this project not be assessed in isolation and that the following matters receive particular attention.

1. Cumulative impacts across multiple nearby projects

Residents in this area are already facing cumulative change from multiple existing and proposed developments.

This proposal should be assessed together with:

* the proposed Wattle Creek solar development (approximately 500,000 panels); and
* the proposed gas-fired power station near the Canyonleigh Road substation area.

Each individual project may appear manageable, but local residents experience the combined effect of:

* construction traffic,
* heavy vehicle movements,
* visual change,
* emergency management pressures,
* road wear,
* cumulative noise and disruption.

I request a specific cumulative assessment that models overlapping construction periods and combined impacts rather than considering each project independently.

2. Canyonleigh Road suitability and traffic impacts

Canyonleigh Road is a rural road and should be assessed based on real local conditions.

The assessment should address:

* road width and condition,
* dust,
* heavy vehicle passing opportunities,
* pavement deterioration,
* safe access for residents,
* maintenance responsibilities,
* impacts during prolonged wet weather.

Road upgrades should not only facilitate project access but maintain safe conditions for residents throughout construction and operation.

3. Flood access and emergency response

A particular concern is that Canyonleigh Road experiences flooding.

The project should demonstrate:

* how emergency access will occur during flood conditions,
* whether the site can be safely managed if roads are temporarily inaccessible,
* whether fire response assumptions remain valid when flood isolation occurs,
* what backup arrangements exist if emergency services cannot reach the site.

4. Fire response capability

Battery energy storage facilities require specialised emergency planning.

The assessment should clearly explain:

* firefighting water supply,
* access under adverse weather conditions,
* emergency isolation procedures,
* coordination with local emergency services,
* how emergency response assumptions account for flood-affected access.

5. Community confidence

I request that consent conditions include:

* advance notification of major construction periods,
* public reporting of road management measures,
* ongoing community communication.
Page 54 mentions the community engagement. I don’t think this reflects reality as we met with the company several times and I don’t see our views reflected there.

My intention is not to oppose the project in principle but to ensure that approval decisions properly reflect local road conditions, cumulative regional development pressures and practical emergency management realities.

I am particularly concerned that residents experience the combined effect of multiple projects at once, even where each project individually meets acceptable thresholds.

I acknowledge that the Environmental Impact Statement may address some of the matters raised above. However, I request that the Department carefully consider whether the assumptions and mitigation measures reflect actual local conditions, particularly cumulative regional development, the characteristics of Canyonleigh Road, flood access constraints and practical emergency response capability in this area.

I wish to raise serious concerns regarding the adequacy of emergency response preparedness and capability associated with the proposed Battery Energy Storage System (BESS) development.

In particular, I do not believe sufficient evidence has been provided demonstrating that local and regional emergency response agencies possess the personnel, equipment, specialist training, infrastructure, resources, water supply capability, hazardous materials response capacity, or operational procedures necessary to safely respond to a large-scale lithium-ion battery thermal runaway event.

Given the scale and complexity of modern utility-scale BESS infrastructure, this issue represents a significant public safety concern that warrants detailed independent assessment prior to any project approval.

Thermal Runaway Risks

Thermal runaway events involving lithium-ion battery systems are widely recognised internationally as presenting highly complex and hazardous emergency scenarios. These events may involve:

prolonged fires lasting many hours or days
rapid reignition risks
explosion potential
production of toxic and corrosive gases
significant water demand for cooling and exposure protection
difficult access conditions for responders
environmental contamination risks
evacuation and exclusion zone requirements.

Potential gases generated during thermal runaway events may include:

hydrogen fluoride (HF)
hydrogen chloride (HCl)
carbon monoxide (CO)
volatile organic compounds
flammable gases including hydrogen.

Hydrogen fluoride is of particular concern due to its toxicity, corrosive properties, and ability to travel in smoke plumes under certain atmospheric conditions.

Concerns Regarding Emergency Response Capability

The project documentation does not appear to adequately demonstrate that emergency services within the region possess the specialist capability required to respond to a utility-scale BESS incident.

The following concerns require detailed assessment and public disclosure:

Local Firefighting Capability

It remains unclear whether local firefighting resources possess:

specialist lithium-ion battery firefighting training
thermal imaging equipment
gas monitoring capability
hazardous materials response capability
sufficient breathing apparatus resources
specialist foam or suppression systems
prolonged incident management capability
sufficient tanker and water supply capacity.

Many regional and rural brigades are volunteer-based and may not be equipped to manage complex industrial battery incidents involving prolonged thermal runaway.

Water Supply and Duration of Fire Events

Large-scale BESS incidents internationally have demonstrated that significant quantities of water may be required over extended periods to cool battery systems and protect adjacent infrastructure.

The project documentation does not clearly identify:

available firefighting water volumes
guaranteed water supply arrangements
refill logistics during prolonged incidents
mutual aid arrangements
contingency planning during drought conditions
impacts on surrounding communities and agricultural water resources.
Toxic Smoke and Community Evacuation

The project documentation appears to inadequately address:

toxic plume modelling
evacuation trigger thresholds
community notification systems
exclusion zone determination
protection of nearby residents
impacts to vulnerable persons
livestock exposure risks
school bus routes and transport corridors.

The potential for toxic smoke movement toward neighbouring rural residences and communities requires far greater scrutiny.

Reliance on External Specialist Resources

It is unclear whether the emergency response strategy relies upon specialist resources located significant distances away from the project area.

If specialist hazardous materials or industrial firefighting resources are required from metropolitan or regional centres, serious questions arise regarding:

response times
escalation procedures
interim containment capability
responder safety during initial attack phases
capacity to manage incidents overnight or during severe weather conditions.
Cumulative Renewable Energy Zone (REZ) Risks

This project must not be assessed in isolation.

Where multiple BESS facilities, substations, transmission infrastructure and renewable energy developments are proposed across a region, cumulative emergency response demands may exceed the capability of local emergency services.

The Department must assess:

regional emergency response capacity
cumulative hazardous materials risk
cumulative bushfire ignition potential
simultaneous incident scenarios
strain on volunteer emergency services
long-term emergency management funding obligations.

Inadequate Demonstration of Preparedness

The project should not proceed unless the proponent can clearly demonstrate:

independently verified emergency response capability
formal consultation with Fire and Rescue NSW, NSW Rural Fire Service, NSW Ambulance and NSW Police
detailed thermal runaway response procedures
publicly available emergency management plans
specialist responder training commitments
ongoing funding arrangements for emergency services
independent peer review of emergency response modelling
demonstrated access to specialist firefighting resources within acceptable response timeframes.

The proponent should also be required to contribute financially toward the capability uplift of local and regional emergency response agencies. This should include consideration of:

specialist lithium-ion battery fire training
hazardous materials response capability
thermal imaging and gas monitoring equipment
breathing apparatus capability
water supply and tanker capacity
emergency response planning and exercises
additional staffing and operational support.

If renewable energy proponents are not required to contribute toward these additional emergency response burdens, the result is effectively cost shifting onto volunteer emergency services, government agencies, local councils and ultimately the broader community and taxpayers.

General statements that emergency risks can be “managed” are insufficient for infrastructure of this nature and scale.

Until these matters are comprehensively addressed, I do not believe the project has demonstrated that risks to public safety, emergency responders, neighbouring landholders, and surrounding communities can be adequately managed.

My property adjoins the Bess project on the eastern and southern boundaries.my house is stated as 350 m from boundry on eastern side,and is probably 700 m from actual bess structures. Our family has been on this property and in the district since the 1850s.

I am against the X-elio bess project at 692 canyonleigh rd for a number of reasons
-poor community liaison
The first I find out about project was when I investigated lights during environmental survey.meetings held in major center of goulburn with no local notifications of marulan and surrounding localities. I believe this was done so BESS project at Breadalbane willavale?could be used to cover planning requirements of both projects doubling community liaison. It was not till I said local people need to be involved and informed of the project that meeting was held in marulan hall.i was even asked to notify people when a poor response occurred, to which my statement was it's your job not mine.the company states they are a global leader in renewable and sustainable energy which worries me because of what I have seen over last 2 years.
The other issue that has caused some concern has been boundry fencing and straying stock of proponent of project and landholder,along with noxious weeds.namely serrated tussock and blackberry. This has been going on since October 2024.this issue may have finally some light at the end of tunnel. But I would like to make it known to planning department something needs to be done with issues such as this so the surrounding landholders aren't inconvenienced.tje situation being land holder has an option agreement in place so is not willing to spend money,hoping project gets passed.proponent of project won't address issues until project passed. There's your problem landholders surrounding project left in limbo till project passed or rejected.
The site itself is proposed as generally flat,it actually slopes to east and west from high point in middle of property.with the main infrastructure on western slope facing the rural subdivision from the 1970s.quite a lot of these properties will be influenced badly by noise and views of the project.especially those along the river to which noise will carry.the time line of 18 months of construction seems like a lot of inconvenience for all property owners along canyonleigh rd.
The increase in traffic volumes along brayton Rd, canyonleigh road of 100 light vehicles, 8 buses,66 heavy vehicles per day on top of gunlake quarrys vehicles on brayton Rd and the cumulative affect of,spark energy's solar and bess project,energy Australia's Marulan gas fired power generation project.the possibility of origin energys gas fired power generation project at kerrawary. All slated to be under construction over the comming 2-5years.
Just to put this all into perspective and show what a feeding frenzy this so called green energy scenario has become,I personally have been approached by inexcess of 35 companies for either BESS,SOLAR or recently ANOTHER GAS FIRED project. Now I'm only 1 landholder in this district, so my refusal or non reply will probably only be taken up by the next person approached. ALL THIS AND WE ARENT EVEN IN A REZ.Traffic continued, the map showing the route from port botany or port Kembla is not of sufficient scale to actually show where they are going through or around marulan itself. But I suppose this is better than the cut and paste faults in the seers for this project.6.8.1 Gulgong, Ulan, Midwestern regional LGA.6.9.1 delivery route port Kembla and port botany via access to site Jackson lane,polgreen Rd,Ulan Rd,comfort Rd,rouse Street Barney's reef Rd.these are examples of slopy and rushed reporting ,hence my concerns with the project. The project and the others will at some point in their life find that the project sites will be blocked from the west at Jaoramin Creek on Campbell's meadow and the paddys river further to the east along canyonleigh rd. No plans in place or mentioned for this scenario. Whilst on water I would like to point out there are 3 drainage lines to the west through the middle of the construction that flow to the wollondilly river approximately 150m from western boundry.with the earthworks needed in my opinion to level and terrace the 472 containerised units being substantial the natural run-off will be changed ,needing a substantial amount of work to stop erosion in what is some of the most erosive land in the district,see pressent gully rills.the soil is a shallow granite with some described as decomposed granite.once the surface is disturbed runoff and silt has the opportunity to enter the wollondilly river, the headwaters of Sydney's water supply.our stockwater dams to the south are problematic because they don't hold water.gypsum ,a polly liner in wall and a later application of synthetic dam sealer has not stopped dam leaking.hence my concerns for there projected earthworks.our stockwater is earth dam and spring dependant so I also have concerns with there water requirements of 11 Meg and possible use of a bore.
The issue of fires is also a concern for the district .-will important assets get priority over districts community members.
-marulan and bighill rfs are supported buy a dedicated and proud group of volunteers that a multi million dollar company is expecting them to fight potect or control fires for their asset.i believe the projects that are going ahead in the district should have their own dedicated and payed fire staff.
Another concern I have for project and the report,under hazards and societal risks states, SOCIETAL RISK NOT CONSIDEREDin assessment given no significant intensification of population around proposed site.there is a rural subdivision directly west of the site that amounts to a significant number of dwellings along with neighbours in all directions of the compass of the BESS project,so I believe it should be considered. As a rural landholder I would like to know the implications if a fire causes significant damage to the site or a number of the lithium ion battery's on my ability to supply the clean and healthy produce, as required through my NLIS requirements. As stated by fire and rescue, Bess facilities pressent special problems of fighting fires and suitable additional provisions are likely to be required.the lighting is something that needs addressing, light pollution is a very much understated issue with the proliferation of similar projects.insects and nocturnal birds and animals pressent on this site are deemed to be very important some threatened,eg bats, owls,squirell gliders ,bogong moths all need further studies to reduce impact on their existence. A list follows of species I know are evident in the area some of which don't show in pressent environmental reports. Diamond firetail,woodswallow,varied sitella, gang gang cockatoo, glossy black cockatoo,squirrel glider, red necked wallaby, swamp wallaby, wallaroo.brushtailed possum, Oldman banksia, kangaroo grass. The Oldman.banksia is only pressent in a small number of areas in proximity to this site.a number of young old man banksias are evident in the area slatted for the bess site.they are between 2 and 3 foot tall and protected by the cunzia from the cattle grazing on the site. Section 6.4.1 states disturbances from vegetation clearing,cropping and livestock grazing.the high point and western slope has never been cleared of trees was always open grassland with low shrubs.secondly that country has never been cultivated and Es has been grazed for a number of years. Originally when.part of mt pleasant by Tomas Holt, Eric holt,Sydney uni then Sold 1985? To pressent owners. The land classification of easterners of block is wrong as that's where the kangaroo grass is ,never cultivated or altered except for serrated tussock ingress and spraying..
This project will significantly increase the carbon emissions for the area and if full emissions and offsets are taken into account the project fails on a number of issues I believe.this I hope shows why I believe this project is unacceptable in its pressent form.again I reiterate we are not in a REZ and believe the pressent net zero.30x30.and 50x 50 along with our following of the UN and cop 26 is bad for our county's future

My husband and I read through the consultation documents. I've used ID numbers from the report 'thingy'.
Our major concern is the effect of the construction and ongoing maintenance this project will have on our road (Canyonleigh Road) which has never been properly maintained under the Goulburn Mulwaree Council. It was much better maintained when our council was just Mulwaree. With the government forced amalgamation of the two councils, the positive balance of the Mulwaree Council was swallowed up by the negative balance of the Goulburn council. Hence poor maintenance and lack of improvement. Also our road has never been brought back up to pre 2010 standard when a major flood ravaged the road. Do not have G'burn Mulwaree Council do the road works. Quality of work very poor. With a very poor road maintenance record.
3.5.2 existing road is NOT Adequate for construction and ongoing m'tenance activities; what will be the adverse impact of traffic noise?
6.3.1 our noise level is - foliage noise, birdsong & VERY distant traffic noise on a still night; what is future projected noise impacts of the finished facility?
Remember there will also be a gas turbine there too, two lots of noise combined.
Number and size of vehicles for 75-115 workers to and from each day - large impact on a poorly maintained road. Plus noise and dust. Vehicles not owned by driver tend to travel at high speed along our road. Your vehicles will not be driven by owners of them. Govt, business or council vehicles can travel at speed over any terrain! Was told that once by a govt official. So heaven help our road!
Recently we had to zigzag along to avoid numerous pothole craters. Neighbour went to council to get it graded. Potholes already back. B-doubles and quarry trucks (which wreck Brayton Rd which is full of half-patched craters) would be very unsuitable on our road during construction.
Cannot safely see traffic coming along Brayton Rd from Bill Hill at intersection with C'leigh Rd. You stop, it looks clear, start moving from stopped position and frequently find a car on your tail metres up the road, where did he come from? Don't leave fixing this poor visibility to council, be pro active yourselves.
With other projects same area, we don't want 'buck passing' re our road quality. Do not leave it to council - very poor record. They spend money on decorating median strips in their CBD, tree plots with little seats CBD, tens of thousands previously spent on decorating round-abouts. When I spoke to 'roads' man, he was doing the best he could with his poor budget.
4.5 Voluntary Planning Agreement - improving local infrastructure in the area - should be in Brayton, (not Marulan or G'burn) we're closest to project; we need mobile tower coverage for all of us living along Canyonleigh Rd. We have to have a booster on roof and mobile coverage is still not a 24/7 given, and relies on electricity. Coverage is a luxury here.
Other great infrastructure would be a much improved road (tarred?) brought back up to pre 2010 flood heights. In some places it is about up to 1 metre below original height. (I am happy to meet on site to point this out and discuss this, have owned property since 1993)
Having a letterbox newsletter is great - quick visual read. Need written hard copy communication as it stops having to fluff around looking for it online (I'm an extremely busy person). I hate QR codes, hard copies best as you can immediately see them and read them without fussing. I don't build my life around emails.
Community mtgs best, with personal written notification, in Marulan, closer.
5.3 Pls note the concerns already raised by other parties with projects.
Stakeholders - Community Facilities & Groups p.39; Environment Groups Many have nothing to do with Brayton, why note them, ridiculous & irrelevant eg. Bundanoon, Moss Vale, Goulburn.
p.51 fire concerns and noise concerns - both valid, husband says you will have the fire concerns addressed.
6.2.3 how far along C'leigh Rd will the BESS be visible at ground level (pls give street numbers and how much will be seen)?
How high will be be? Physical size? Dimensions?
Workers - we both know they don't come from the local area, or the motels in G'burn wouldn't be so full. Workers travel to get work. Most come from far away, even interstate. So this should not be put in these reports. Same for the 'training' program stuff. I've read enough reports to notice the blarney and padding. Keep them simple AND
Look after the neighbours in Canyonleigh Rd who will be the most affected by all the projects along our road.
The speed of these vehicles is of great concern, and damage to our very poorly maintained road. It needs heavy duty tar on a very strong base. Look at Brayton Rd to see how damaged that tarred road is because of the trucks.
It needs to be made of steel. Oh, that would be a rail line! What a grand idea!
Please pay attention to the quality of our road, the noise and the visibility or the project, and the amount and speed of traffic.
We are not against the project just have big concerns about the short-term and long-term effect on our lifestyle.
Please look after your neighbours.

Your feedback has been forwarded to my section, the Environmental Goods and Product Safety Section within the Australian Border Force (ABF) for a response and advice.
the Department of Climate Change, Energy, the Environment and Water (DCCEEW) is Australia’s lead policy and regulatory agency for the management of hazardous industrial chemicals, which is implemented through the Industrial Chemicals Environmental Management Standard (IChEMS).
IChEMS establishes nationally consistent standards for managing the import, export, manufacture, use and disposal of industrial chemicals to reduce impacts on the environment.
While PFAS chemicals, including PFOA, are not yet prohibited at the Australian Border, they are listed in IChEMS as a high risk chemical group, and are regulated domestically within Australia. Bisphenol A is also listed in IChEMS and is being considered for scheduling by DCCEEW but is not a prohibited chemical at the Australian Border.
We have received the below advice from DCCEEW on the PFAS regulations for your consideration:
● The Australian Government expects that introducers, exporters and users of PFAS comply with the standards set out in IChEMS.
● Regulation, or enforcement, of standards is reliant on adoption by the Commonwealth, states and territories into their own environmental laws.
● Jurisdictions are at various stages of incorporating the IChEMS into their own regulatory frameworks.
● The Commonwealth is exploring its legislative options for enforcing the prohibitions and restrictions on importation and manufacture and use in Commonwealth areas as prescribed in the standards.
The Commonwealth will work with introducers and users as it develops implementing legislation

and considers the practicality and appropriateness of different operating models.
● Until new legislation is available there is a unique opportunity for industry to establish compliant supply arrangements and business practices without penalties applying.

In regard to your concerns for asbestos, the ABF is responsible for enforcing border controls for very high volumes of goods that cross the Australian Border every day, and every effort is made to identify and prevent goods containing asbestos from entering Australia.
● Australia is one of the few countries in the Asia-Pacific region that has a comprehensive ban on all six types of asbestos.
● In many countries, despite the known threat to human health, local standards allow manufacturers to use low levels of types of asbestos.
● Goods manufactured outside Australia might be labelled asbestos free and still contain low levels of asbestos.
● It is the responsibility of importers and exporters to ensure they do not import or export prohibited goods such as asbestos.
The ABF must be assured that asbestos containing goods are not unlawfully crossing the border.

Majority minerals and parts by overseas companies that use slave like conditions.
More research and evidence is coming out how BESS's or any renewable projects and transmission lines are not CHEAP, are not CLEAN and are not RELIABLE.
It is not a way forward to sure up our current energy system.

Poor insight, poor management and no critical thinking, therefore weak leadership and this is one project to highlight this.

I object due to fire risks associated with lithium-ion battery systems, release of lethal combustion gases - including hydrogen fluoride - during likely FIRE events, exposure of nearby biodiversity to poisonous contamination, reliance on torturous slave labour supply chains dominated by overseas manufacturers, ever-rising electricity system costs unjustly hurting Australian consumers as well as wrecking industry, productivity and our economy.

The treacherous national security dependence on hostile enemies that X-Elio’s Canyonleigh BESS presents is totally unacceptable.

X-Elio’s poisonous BESS plan introduces highly significant fire hazard in this rural setting with poisonous public health and safety risks and detrimental impacts to critically endangered species from toxic environmental contamination during thermal events.
This Canyonleigh disaster will contribute to electricity price chaos through out of control grid and storage costs.

Depending on hostile battery supply chains with dangerous strategic dependency makes no sense - whatsoever - only to the vested interest parasites and the NSW Government - who are not protecting its citizens.

This project will not help NSW meet emissions reductions targets without ommitting all the diesel used to transport components (ships and trucks), construct and maintain the site, let alone the mining of the resources to make the Batteries. How long before the whole BESS becomes land fill? This project is a toxic fire hazard. The destruction to the environment, to mine the materials and clear the land for the BESS, will be serious and irreversible.

Thermal runaway, lack of facilities to extinguish fire, too much reliance on volunteer RFS, toxic smoke, toxic runoff, destruction of critically endangered woodlands, visual pollution, noise pollution, and will end up as toxic land fill with no decommissioning of the site (after it has been 'flipped' countless times to overseas 'interests' all while avoiding any CGT that everyone else in Australia has to pay). This BESS will emit a constant noise that will impact both the wildlife and neighbouring property. In the event of thermal runaway the BESS will likely be belching toxic smoke for days if not weeks. A Thermal runaway event will breakdown BESS components emitting gas, fire and toxic residue. Where is the procedure to deal with such an event? Does the EPA have a procedure? Where is the land fill where damaged and obsolete components will be disposed. A BESS will only provide this community with a toxic mess.
