I wish to raise my strong objection to the proposed development at 138 Maroubra Road, Maroubra. Although presented as a fresh application, this proposal closely follows the earlier DA/80/2023, which was rejected by Randwick Council and then refused by the NSW Land and Environment Court.
One of the most significant issues identified previously—and still unresolved—is the impact on traffic, congestion and road safety. Maroubra Road is already under immense pressure, functioning as a key thoroughfare with constant vehicle flow, busy intersections, and high pedestrian activity. The additional vehicle movements generated by a development of this scale, along with the increased demand for on-street parking due to insufficient parking provision on site, will further overload the road network.
This raises clear safety concerns for residents, pedestrians, school children and public transport users.
On top of that, the construction phase of a nine-storey building would bring prolonged disruption: heavy vehicles entering and exiting the site, machinery operating for extended periods, and ongoing noise that will severely affect nearby households.
These issues were among the concerns highlighted during the previous proceedings, and they remain entirely unaddressed.
The Land and Environment Court also rejected the earlier eight-storey design on the basis of overdevelopment—finding it excessive in height, bulk and scale, non-compliant with building height and story controls, and detrimental to neighboring residential amenity through overshadowing, loss of views, privacy impacts and overlooking. Instead of addressing these deficiencies, the current proposal increases the height to nine stogeys and includes even more units, including social housing, which only intensifies the adverse impacts previously recognized by the Court.
The addition of the "affordable living" units is also a ploy to tick a box that the NSW government is looking to ease the current housing crisis!
Furthermore, we have seen throughout the country where "affordable Living" apartments have been included in these "Non affordable housing" areas the social upheaval and unrest to the local community.
Everyone who owns property within this vicinity has purchased their properties at market prices or more to be in this prestigious area and have the financial means to maintain a lifestyle which is conducive to this neighborhood.
It appears the developer is now relying on the State Government’s fast-track assessment process to avoid the constraints imposed by the Court’s earlier ruling.
However, the fundamental issues remain: the development is too large for this location, will worsen traffic conditions, pose additional road-safety risks, create substantial construction noise and disruption, and significantly reduce the amenity of surrounding properties.
I noticed that the NSW Transport has advised that they see no negative impact to the current or future traffic flow in and out of this proposed new building! This notice shocked me as the current traffic congestion is out of control in this area throughout the entire day and night! Additionally, with the increased apartments leads to increased visitors to the area and there is currently No On Street Parking spots available to support the current buildings!
Common Sence Must Prevail in objecting to this proposed development.
As you can see from all of these combined objections against the size and identified use of this development, there are more constructive negative arguments against this proposal!

For these reasons, I strongly oppose the revised proposal.

BESS is dangerous and brings hazards to the project and community.
The noises from this BESS project will have negative impacts on the nearby livestock and wildlife. These impacts will be evident in not only everyday life for the animals, but also during breeding and birthing cycles. BESS carries significant fire risk. The proposal of new transmission lines bring significant EMF hazards and as such, should not go ahead.

I pay my respects to Australia’s past, present and future farmers who have and will continue to battle setbacks such as renewable energy destruction, drought, floods, vermin plagues, diseases, and government policy, all so they can provide Australia with food and fibre. I acknowledge that these setbacks come at a high price of mental health, and many have taken their lives as a result due to such pressures. I extend this respect and am thankful for the sacrifices those within the agricultural industry make in order to provide Australia with the essentials; I acknowledge the agricultural industry as the backbone of our nation
This battery energy storage system and new transmission lines are a major fire risk and will put significant strain on local and rural firefighting services. These local firefighting services are not equipped with the resources or man-power to manage emergency fires for when they do break out at this site. Why should the broader community risk their lives and step up to fight fires for infrastructure that they never wanted there in the first place?

Save the land that supports and produces food and fibre for Australia. Put these elsewhere! Stop bowing down and bending over to the EVIL powers of the WEF.

We need to unite and fight these developers and the Australian government for forcing this upon us.
I object because this project will cause permanent toxic damage to the natural environment and impact those around it. There will be too many toxic chemicals and EMF entering the landscapes and environment as a result of this project.

I have a personal and a professional connection with many in the Molong community.
There is low awareness and little understanding amongst the community of Molong regarding the proposal for a Battery Energy Storage System in Molong. As a medical practitioner, I object to the Molong Battery Energy Storage System application on public health and medical safety grounds. I am concerned that the proposal presents insufficiently addressed risks of acute and delayed health harm associated with lithium-ion battery fires. Thermal runaway events are known to release toxic gases including hydrogen fluoride, carbon monoxide, and other irritant and asphyxiant compounds. Inhalation exposure may result in chemical pneumonitis, delayed pulmonary oedema, and severe exacerbations of asthma and chronic respiratory disease. The proposed location in a regional setting raises further concern regarding the capacity for timely emergency response, prolonged fire suppression, evacuation of vulnerable populations, and medical management of toxic inhalation injuries. Battery energy storage fires can burn for extended periods, increasing the likelihood of downwind exposure to residents and first responders. The environmental impact assessments broadly and specifically do not adequately address the serious case health outcomes, plume dispersion uncertainty, or the burden placed on local health and emergency services. These risks may be considered low-frequency however they are of a Highland serious - consequence and warrant a precautionary approach. Independent public health and medical risk assessment should be required prior to determination, and that approval should not be granted in the absence of clear, enforceable mitigation measures addressing inhalation risk and emergency medical response. The potential for irreversible injury or loss of life from toxic exposure, even in a single incident, represents an unacceptable risk in a non-industrial regional community.

The Fire suppression system for this BESS is experimental, unproven, and frequently fails, yet approval authorities pretend theoretical controls are equivalent to real-world safety.

Molong BESS plan shows “a lack of care that demonstrates reckless disregard for the safety or lives of others, which is so great it appears to be a conscious violation of other people's rights to safety.”
