I am objecting to the huge extension to Mt. Pleasant Coal Mine
1 This huge mine expansion will create 1.5. miliion tonnes of local greenhouse gas pollution in the next 10 years in NSW and over
100 million tonnes in downstream emissions at a time when our state is not on track to meet its legislation 2030 or 2035 emissions targets. The people of NSW are already suffering the impacts of climate change ,including the Hunter region and adding further greenhous pollution will do unacceptable harm to the public interest
2 The New South Wales Court of Appeal's Denman Decision made it clear that the local impact for climate change caused by downstream greenhouse pollution from New South Wales coal has to be considered by planning authorities. As this decision is now in the High Court acceptance of this application will cause legal and practical confusion with environmental and social consequences for the area.
3 The expansion of this mine is in direct contradiction to the Government's own advice from the New South Wales Net Zero in December last year that "[C] ontinued extensions or expansions to coal mining in NSW are not "consistent with NSW climate law goals ( Paris ideally 1.5c)
4 Approval would inflct harm on our people and our economy. The people of NSW are already dealing with increasing bills and escalating dangers from cllimate change fuelled extreme weather.
5 This expansion is not a modification . It is "substanstially the same development" as one previously approved (DA 92/97) and calling it a "modification " avoids and independent review. This project must go to the Independent Planning Commission (IPC)

Extending the mining period and optimising production levels will provide greater operational certainty, safeguard existing jobs, and deliver ongoing economic benefits to Muswellbrook and the surrounding communities.
Importantly, the project also contributes to the stable and reliable supply of high-quality coal to key Asian markets. As energy demand across the region remains stable, maintaining dependable export supply supports energy security, and long-term trade relationships. NSW’s reputation as a reliable supplier is reinforced by projects such as Mount Pleasant.
Furthermore, the operation is subject to a comprehensive regulatory framework and stringent environmental management requirements. The proposed modification does not diminish these obligations or the project’s commitment to compliance, monitoring, and responsible resource development. Continued approval will ensure that mining activities remain transparent, accountable, and responsibly managed.
For these reasons, we strongly support the proposed modification and respectfully encourage its approval.

I strongly object to this proposal on several grounds.
Firstly, this single mine extension would generate over 100 million tonnes of downstream greenhouse pollution, at a time when the NSW Government's own Net Zero Commission has said that continued extensions to coal mining in NSW are not consistent with our state's climate laws or the Paris Agreement. The people of NSW are already living with the consequences of worsening climate damage with extreme floods, fires, and heatwaves in the Hunter and across the state. Adding 100 million tonnes of climate pollution would pour fuel on the fire. This is unacceptable.
Further last year, the NSW Court of Appeal's landmark Denman Decision made clear that the local impacts of climate change that are fuelled by mining and burning NSW coal must be considered by planning authorities. I strongly believe that deciding the mine expansion proposal, when the challenge to the ruling is before the courts, is not good process.
Secondly, calling this a "modification" is itself misleading. This is not "substantially the same development" as the original approval. It should go to the Independent Planning Commission for full and independent assessment, not be waved through as a minor change.
It is disingenuous of Mach Energy to attempt to slip in a new expansion proposal so they can keep making the mine bigger, regardless of the High Court outcome.
The proposal must be rejected and Mach Energy required to submit the plan to the Independent Planning Commission for full and independent assessment
