The similar development has been declined by NSW Planning previously given the concern re the scale of the development in a small area, noise, traffic, air quality and lack of natural light. The report suggested that the developement should never be considered.
This current proposal is similar to the earlier one and none of the issues / concerns were addressed properly in the proposal. It seems that the developer is using the 'low ccost housing' pathway to submitt this proposal agian. We do not object developement and low cost housing, however, the scale of current proposal is too big for the area. You may also be aware that Pacific Square apartment block is undergoing a major repair and remediation project which will take two and half years, if this go ahead, one can imagine how disruptive it will be to the structure of this land and I can see another "Mascot Tower" coming.

I am submitting this objection to the proposed development at 138 Maroubra Road, Maroubra. This new proposal is essentially a continuation of the earlier application (DA/80/2023), which was rejected by both Randwick Council and the NSW Land and Environment Court.

The Court found that an eight-storey mixed-use building on this site amounted to overdevelopment. It was considered too tall, too bulky and out of scale for the location, and it did not meet the building height and storey limits in the applicable development control plan. The Court also noted that the project would cause unacceptable impacts for nearby residents, including overshadowing, loss of solar access, view loss, overlooking and privacy intrusion. Concerns were additionally raised about traffic congestion, lack of adequate on-site parking, potential basement drainage and de-watering issues, and the noise and disruption associated with construction.

None of these issues have been resolved in the current submission. In fact, the new plan intensifies the problems: it increases the height from eight storeys to nine and adds even more units, including social housing. These changes magnify the issues the Court already deemed unacceptable. It appears that the developer is now seeking to rely on the State Government’s fast-track assessment process to sidestep the previous decision. A nine-storey building will only worsen the impacts on surrounding homes—greater overshadowing, more significant privacy loss, increased traffic congestion, more noise, additional drainage risks, and even further loss of views and sunlight.

I wish to lodge my objection to the proposed development at 138 Maroubra Road, Maroubra. The current application essentially repeats the earlier proposal (DA/80/2023), which was rejected both by Randwick Council and by the NSW Land and Environment Court.

The Court’s decision made it clear that an eight-storey mixed-use building on this site would amount to overdevelopment due to its excessive height, bulk and scale. It also noted that the proposal failed to comply with the building height and storey controls in the relevant development control plan, and that it would unreasonably affect neighbouring residents through loss of solar access, loss of views, overshadowing, privacy impacts and overlooking. Significant concerns were also raised regarding traffic congestion, inadequate on-site parking, basement drainage and de-watering risks, as well as noise and other construction impacts to surrounding properties.

The new application does not resolve any of those issues. Instead, it proposes an even taller structure—nine storeys rather than eight—and increases the number of units, including social housing. These changes worsen the very problems identified by the Court. It appears the developer is now relying on the State Government’s accelerated assessment pathway to override the previous decision. A building of this height will undeniably produce greater negative impacts for nearby residents, including increased overshadowing, more severe privacy loss, additional traffic congestion, higher noise levels, potential drainage complications, and further reductions in views and sunlight.

As a resident of the Pacific Square—directly adjoining the proposed
development—I have deep concerns not only about the project’s unacceptable scale and impact, but also
the questionable process by which the proponent has approached community consultation.
Key Grounds for Objection:
1. Excessive Height and Density
The proposed 10-storey building grossly exceeds local planning expectations for the area. The
scale and bulk are inappropriate for the location and appear designed to maximise yield rather
than reflect the character or needs of the community.
2. Loss of Privacy and Overshadowing
The close proximity of this large structure to existing residences, will result in severe loss of privacy and overshadowing, affecting the amenity and enjoyment of dozens of homes.
3. Traffic and Parking Impact
Maroubra already suffers from congestion and limited parking infrastructure. This development
will only exacerbate these issues without any corresponding upgrades or mitigation strategies.
4. Tokenistic Approach to Affordable Housing
While the development seeks to justify its increased scale by including 15% infill affordable
housing, there is no clarity around the integration, quality, or long-term management of these
dwellings. Such gestures often serve as a lever to secure bonus floors, rather than a genuine
contribution to housing equity.
5. Selective and Inadequate Community Consultation
The early consultation process was flawed. Pacific Square residents were not notified of the proposal during the community consultation period. This selective distribution of information via flyer to other, less impacted addresses, appeared strategic, to minimise dissent rather than inviting genuine
community feedback. Most recently, we have only been given 2 weeks opportunity to make a
submission on this SSD via the planning portal when the NSW Government’s own guidelines
state that the exhibition period should be 4 weeks (see Section 6.1 of the State Significant
Development Guidelines).

Grounds for Objection:
1. Unmitigated Traffic and Parking Pressures
The locality already experiences high traffic volumes and constrained parking availability. The proposed development will exacerbate these conditions without any demonstrable provision for infrastructure upgrades or mitigation measures, thereby undermining transport and accessibility objectives.

2. Adverse Impacts on Privacy and Solar Access
The proximity of the structure to existing dwellings will result in significant loss of privacy and overshadowing. These impacts will materially diminish residential amenity and contravene principles of equitable access to sunlight and outlook.

3. Non-Compliant Height and Bulk
The proposed 10-storey development substantially exceeds the established planning controls for this locality. Its scale and massing are inconsistent with the intended character of the area and appear primarily driven by yield optimisation rather than alignment with community needs or strategic planning objectives.

I sincerely hope that the community's words can be heard and not ignored. Please refer this matter to the Independent Planning Committee.
