Based on the information provided, the OSD does not constitute a Scheduled Activity under Schedule 1 of the Protection of the Environment Operations Act 1997 (POEO Act). At this stage, the EPA does not consider that the proposal will require an Environment Protection Licence (EPL) under the POEO Act. The EPA understands that the proposal is not being undertake on behalf of a NSW public authority. The EPA is therefore not the appropriate regulatory authority for the environmental performance of the project.

Accordingly, the EPA has no comments regarding the proposal.

As an advisory note only, the future OSD will be located in close proximity to the operational rail network, for which EPA has a regulatory responsibility. Any future planning approvals permitting further development of the site should include acceptable vibration and ground-borne noise limits for spaces within the development drawn from the EPA’s Rail Infrastructure Noise Guideline (EPA, 2013) and Assessing Vibration: a technical guideline (DEC, 2006).

A variation approval was issued on 20/9/2018 for this development to a height of 189m AHD, as it does not seem this height has increased, the original decision still stands.

Thank you for your emails of 16 July 2020 requesting comment from the Civil Aviation Safety Authority (CASA) on the Pitt Street North Over Station Development Modification (SSD-8875-Mod-1) and the Pitt Street North Over Station Development Stage 2 (SSD-10375).

CASA has reviewed the Aeronautical Impact Statement (AIS) for the Pitt Street North Over Station Development Stage 2 and has no issues with the assessment and no objections to the proposed building development. CASA assessed the building at a height of 188.6m above Australian Height Datum (AHD) under the Airspace Regulations 2007 on 6 February 2018. A copy of this assessment is attached for your information.

The Aeronautical Impact Assessment covers the tower cranes up to a height of 241m above AHD that will construct the building. In principal CASA has no objections to the tower cranes, however detailed recommendations for the tower will be made on receipt of an Invitation to Comment from Sydney Airport.

CASA has no specific comments on the Pitt Street North Over Station Modification Report.
