Public exhibition of an application under section 126N of the now repealed NSW Threatened Species Conservation Act 1995
Part 8 of the Biodiversity Conservation (Savings and Transitional) Regulation 2017 establishes transitional arrangements for biodiversity applications that predate the commencement of the Biodiversity Conservation Act 2016.
The North Tuncurry Urban Release Area has been rezoned and the new planning controls now apply under the Great Lakes Local Environmental Plan 2014.
North Tuncurry Urban Release Area
The North Tuncurry Urban Release Area was declared a transitional biodiversity application under the Proposed Applications for Biodiversity Certification Order 2017, made in accordance with clause 37(2) of the Biodiversity Conservation (Savings and Transitional) Regulation 2017.
The Minister for the Environment can determine the application under Part 7AA of the Threatened Species Conservation Act 1995 (as if that Act had not been repealed). Section 142B and other relevant provisions of that Act and the regulations under that Act continue to have effect for that purpose.
If the Minister for the Environment decides to confer biodiversity certification on land because of the determination of the application, it will be taken to be biodiversity certification conferred on the land under Part 8 of the NSW Biodiversity Conservation Act 2016.
