Exempt and complying development within existing cemeteries


Cemeteries have been recognised for their important role in providing social infrastructure and we are providing streamlined pathways tailored to support their ongoing operation. 

The department has introduced a new exempt and complying development framework for maintenance and other minor works within existing cemeteries.  

The new framework has been introduced through an amendment to the State Environmental Planning Policy (Transport and Infrastructure) 2021

The new framework will fast-track planning pathways for minor cemetery maintenance tasks and minor works by eliminating the need for development applications. 

Minor works include:   

  • accessible entrances 
  • ash gardens 
  • construction of small buildings and structures 
  • decks, terraces and pergolas 
  • demolition  
  • driveways, hardstand and carparks 
  • earthworks 
  • fencing 
  • landscaping and landscape structures 
  • minor building alterations and additions (including painting, cladding, repair and replacement of building fabric) 
  • new burial areas and infill burial  
  • rainwater tanks 
  • sheds, maintenance facilities and carports 
  • signage 
  • vaults, crypts, sculptures, artwork, columbariums 

The draft framework was exhibited through an explanation of intended effect from 23 October to 19 November 2023. You can still view the explanation of intended effect below.
