The NSW Court of Appeal declared that the development consent is void and of no effect. The decision about the application must therefore be re-made following further assessment

The Lue Action Group is strongly opposed to a lead mine operating 2 kms from Lue. Lead is poisonous. LAG is very concerned that this lead mine will cause significant damage to the environment and the health and well being of those who live and work in and near Lue. It will mine for 16.5 years, with a massive 200m Tailings Dam wall poised over Lawsons Creek seaping and overflowing poisonous substances and blowing dust and polluting the valley for hundreds of years. The mine pit will remain forever, filled with contaminated water, evapourating and refilling from the aquifer forever. The Waste Rock Embankment will be over 100m high, 670m above sea level. This is higher than all surrounding hills and will be seen from Havilah to Monivae and will be full of acidic rock that will seap into the water table forever.
Lue is located in a very unique area. With abundant wildlife, magnificent cliffs and unusual landforms, rocky outcrops, Elephant Mountain, springs and little waterways, wonderful views from surrounding hills, koalas, endangered grassy woodland and other beautiful old trees, thick bushland and wildflowers, very special Aboriginal carvings and paintings, little farms and very popular tourist accommodation and Lawsons Creek. The farmland is very productive with creek flats gently sloping up to the surrounding hills. There are many businesses hidden away in Lue that will suffer if there is any mining at Lue. Its a very beautiful place.
The mine will not have an external water source. Without an external water source there is no secure reliable water supply so the mine will be reliant on rainfall and runoff and groundwater. A mine cannot operate without a reliable and secure water source. This mine plans to take water that would otherwise flow into Lawsons Creek and into the Cudgegong River. They will take far more than their fair share of water and most likely will take more than they should. This will leave Lawsons Creek dry and prevent access to the water in bores. Lue does not have town water and all 95 landowners are reliant on either rainwater tanks or bores. Some landowners pump water from the creek . Bowdens will take most of this water.
There is no power supply at the mine site so even though there are plans to process on site this wont be possible without an external power source and presumably Bowdens will truck the ore to a processing plant elsewhere.
This is not a coal mine. This is a lead mine with just 1% of silver being mined. The main product that uses silver is solar panels but as the price of silver rises the makers of solar panels are moving to cheaper and more readily available copper.
There is no reliable water source - no power source - 2 kilometres is too close to Lue - operating 24/7 - open cut - dusty - located in a very sensitive area - too close to important Aboriginal Cultural Sites - too close to Koala habitat - too close to springs and waterways - over a faultline - in an Earthquake Hazard Zone - they must relocate the 60m high 500kV Bayswater to Mt Piper Transmission line - they must relocate Maloneys Road - the Lue Road will have to take a lot of additional trucks, wide loads and traffic - it will be very very noisy - operating 24/7 - too light - too ugly and it will pollute the beautiful and unique Lawsons Creek Valley forever.
It is irresponsible and greedy of this company to plan to mine at Lue.
