The NSW Court of Appeal declared that the development consent is void and of no effect. The decision about the application must therefore be re-made following further assessment

This project is a controlled action under the Environment Protection and Biodiversity Conservation Act 1999 and will be assessed under the bilateral agreement between the NSW and Commonwealth Governments, or an accredited assessment process. Thanks for giving me the opportunity to voice my objections to the proposed Bowdens Project, Firstly I would like to state that i'm in the process of moving into the area as we have only just purchased a property in Bara in March. This all came as big surprise to us as our dreams of a quiet tree change have been squashed.
I'm sure your across all the major concerns which i also object, I wish to highlight 3 items that i feel should be payed closer attention as follows:
Item 1, In regards to noise no consideration has been given to the type of noise produced and the impact of this on the greater community. Generally for a mine with all its machinery is of the low frequency range with a larger wave capable of travelling greater distances. Secondly to this point sound travels through a medium the ground a far greater distance than air. In summary this mine is below ground producing low frequency sound waves into the ground which together are capable of travelling greater distances than just through air and at higher frequencies. Yet the project is compliant if they keep below the stated standard industrial 40db target level. This is not acceptable taking into the account the above points and the minimal existing noise level of the surrounding area.
If a rural noise standard doesn't exist it should, There are no factories in Lue and surrounds why are they using this Industrial noise standard?
Item 2) In regards to the EIS, The scope and range is far too small and therefore does not give a true impact of the mine on the greater community. for the reasons above alone the EIS should encompass the greater Mudgee area and not just the immediate mine footprint, Lue & the water supply corridor. If they did in fact revise the EIS to encompass all area affected by the mine the true cost to all stakeholders in the community and biodiversity would be understood.
Item 3) Amendments to the mining proposal, Currently Bowdens Silver has many target under there exploration lease in the local area Kia Ora, Kia Ora West, Bara , Bara North & Botbolar just to name a few. What assurances will Bowdens Silver Project give the community that they will not amend there original planning consent for the Bowdens site if approved . As there would be synergy between all these sites i feel the EIS should also consider which it does not the fact that the ore deposit changes at the Bowdens site, they extend the mines life out and these other projects come online. This would negatively affect the community forcing many out.
Is the proposed Bowdens Silver Mine the foot in the door as they say?
