Please find attached submission concerning the excavation proposed for the warehouse planned next to my property, and to the planned changes to the roadway that my property fronts.
I did not see any plans showing how the proposed road change when completed (even though not constructed by Frasers, but joining the part completed by Frasers), will compare with existing road levels.

Canopy Estate at Horsley Park
The property at 1627 The Horsley Drive, Horsley Park 2175 has belonged to the Oliveri & Oliverio families since 1957.

Given that we are not included in the development and continue to reside on the neighbouring property, we wish to raise an objection to the proposed development.
We see no benefits, only stress, anxiety, disturbances , and ongoing concerns. We also understand the development can not proceed without The Horsley Drive upgrade

There are 2 dwellings on one property next door to the proposed development at Horsley Park known as the Capony Warehousing Estate comprising of 6 or 8 warehouses.

The rezoning of the land happened early in 2025 and we were led to believe it was done so Fraser’s Group could build a warehousing estate within the “Keyhole Lands” according to the first application to Fairfield Council. Initial plans included our property. The developers have purchased the properties on our western side and the properties directly behind us. The 2 properties on the fringe(ours included)are not in this current proposal. This was a concern of Patrick Warren- Senior Strategic Land Use Planner, from Fairfield Council - who raised it in his report, as to the visual impact it would have. The development results in lot isolation. The council wanted the developer to take another look at this to ensure a holistic development for the entire Keyhole Lands.

The proposed development will result in a compulsory acquisition of part of our property (VPA)so the signalised intersection (key factor)for the estate rd and Horsley Drive upgrade (key factor) can be completed by the Fraser’s Group and/or Transport NSW.
How wide is this intersection that allows large vehicles to turn?
How far is this intersection from our boundary? How long will it take to complete this road upgrade?

The developer would be carrying out major construction activities right next to our homes — affecting our access, safety, health and peaceful enjoyment of our property.
This creates an unfair and unreasonable situation where we bear the full impact of their development.

Noise, Vibration, Air quality-

…measures 48.20 μg/m3
Receptor 8 near Redmayne Rd… measures 40.5 μg/m3. We have the highest air quality measurement on the table produced by NorthStar. As per report… predicted impacts will be lower at all other receptors. Our property is the most impacted.
Airborne dust will settle on our property, clothes drying outdoors, vehicles, outdoor areas, and inside our home, increasing the amount of cleaning and maintenance required and reducing our ability to enjoy outdoor spaces and activities such as growing our vegetables.
How do we measure what the air quality is?

The number of heavy machinery with bulk earthworks will greatly impact our lives. The amount of noise, dust and vibration generated during construction will have a significant and direct impact on our daily lives.

24-Hour Operations
The proposed operating hours along with machinery and transport vehicles will create constant noise and vibration and pollution disturbing residents sleep and daily lives. Lighting from the proposed warehouses will also impact our property.

Traffic and Access Concerns
Increased construction and delivery traffic will greatly worsen congestion and pose safety risks entering or exiting the property.
The proposed road widening or lane closures could restrict access to my property, especially during peak hours. No consultation from Fraser’s or Transport NSW on how I would enter and leave my property. At this stage no one can tell us the exact location of the signalised intersection - how far from the property boundary? How much soil will need to be moved onto the front of the property to bring it up to the road level so they can do the road upgrade that will then allow Fraser’s to proceed with the development?

Water Flow
Alterations to ground levels and sealed surfaces will oredirect water flow, causing flooding or erosion our property. There is a creek running through the property into the small dam on the canopy site. Is there a re-alignment of the water course? Where will the water go during heavy rains?

Environmental Impacts and Snake Displacement
Clearing vegetation and disturbing soil will drive snakes and other wildlife out of their habitats and into our property. There are known brown snakes and red belly snakes nearby.
This presents a safety concern for our families, and pets.

Taken together, these impacts — combined with the lack of communication and transparency — will cause anxiety and lasting harm to the quality of life, safety, and value of our homes.
This proposal fails to adequately consider the rights of the residents and the long-term environmental consequences. What are the site access and service/utilities arrangements?

For the reasons above, the Oliveri and Oliverio families respectfully request that the Planning Committee:
Reject this development application in its current form.

We completed extension to existing premises a number of years ago. Renovations were completed through registered builder with Da approval. All inspections completed for construction. Builder left us to complete a small retaining wall (been advised by council they wont be interested in retaining wall as below height restrictions). Advised by council need occupation cte they hold plans.

Please refer to the attached documents. The objection relates to the proposed subdivision of the easement benefitting Endeavour Energy for 132 kilovolt overhead transmission lines over the site. Subject to the satisfactory resolution of the easement management matters Endeavour Energy will have no further objection to the Development Application.

I am a landowner directly opposite the proposed main entrance to the Canopy Warehousing Estate and wanted to seek clarification on how the development allows us to enter and exit our property. I can see that it is proposed to have lights at this point on the road and wanted to ensure that our access has been considered. It would be a preference for us to have access to be able to turn in an easterly or westerly direction when exiting or entering our property.
It is also essential for us to enter and exit our property during the whole construction stage of the project. We will require access at various times due to different working hours. Please also advise on how this has been considered.
As our property is a battleaxe block we have a long driveway, our residence is approximately 380 meters from the Horsley Drive.
Finally, I would like to check that when/if the Horsley Drive is widened or altered in any way near our driveway, that our driveway entrance will be replaced.
