I am oposed to the extension of the Marina. This facility was a temporary measure established in 2000 for the Olympic games, this was never intended to be a permanent facility.

I am very concerned about the change in use thst is being proposed, including Live Music venues in this development is unacceptable as access to this site is not suitable for bringing in peiople searching for entertainment. I believe that tbr site could be dangerous for vehicle and pedestrian access.

The current Marina size is adequate the impact on other users of the Bay would be overwhelming, the Rowers, Dragon Boat racers
would be impacted by several more vehicles entering and leaving the Bay.

Previous applications to re instate a Ferry service to Glebe was defeated because of concerns about impact on Rowers etc expanding the Marina would cause greater problems for the Rowing community.

Another objection I have is the increased noise that would be generated by converting this area into an Entertainment Venue precinct with the adding of Restaurants and Live Music facilities.

The impact of extra berthing facilities on the Environment of the Bay should be fully investigated by qualified Scientists and then this should be discussed by the community.

I think the community of Glebe Pyrmont and Rozelle should be more fully included in any development plans as a life long local I am very disappointed by the State Governments lack of concern for local residents.

Finally I would implore a review of local transport in the area currently the only public transport is the Buses which are usually
over crowded .

I strongly object to the changes proposed for the Sydney Superyacht Marina.

I concerned that the proposed changes would effectively turn the area into an entertainment centre. The acoustic impact would be completely unacceptable to nearby residential areas.

Noise carries across the water and affects residential areas. Music in particular carries to not only Glebe but also Balmain.

The proposal for restaurants, outdoor seating areas and licensed venues would mean that the noise would be very much louder. It also changes the purpose and nature of the development that has been approved.

The land is publicly owned waterfront land intended for maritime purposes. It should not be used as an entertainment quarter.

I strongly oppose to the Sydney Super yacht Marina's application to expand its existing facility.
The marina was first established as a temporary base for in 2000. It has been allowed to grow and develop out of proportion to the site. The proposals to expand the buildings to include restaurants and other entertainment venues just compounds this.
The increase in noise level which would occur with this development is unacceptable to nearby residential areas.

I wish to strongly object to the proposed MP09_0165 (MOD 1) Modification to Sydney Super Yacht Marina. My reasons for objecting are set out below.


1. Decisions on possible modifications and enlargement of the Super Yacht Marina are inappropriate at this time. These questions should be delayed so that they can be considered in the context of and in co-ordination with development of the Bays Precinct.
2. The public good and protection of the harbour foreshore and natural assets are required to take precedence over private and commercial interests, according to the Sydney Harbour Regional Environment Plan which covers this area. The changes proposed for the Sydney Super Yacht Marina are a flagrant disregard of these principles.
3. The Super Yacht Marina was originally a temporary measure, set up to cater for special needs during the 2000 Olympics. It has never been legitimized as a permanent fixture which makes expansion of the current facilities even less acceptable.
4. The proposed restaurants, outdoor seating and outdoor licensed venues with live bands will be open all day and seven nights a week. This will impose an unacceptable level of noise on parkland users and local residents, living directly across from the planned expansions, noise from Liquidity has been bad enough. The expansion plans will cause a vastly greater noise impact which should not be inflicted on the community.
5. Public land should be retained for public use and benefit. The area is publicly owned waterfront land zoned for maritime use. Yet the proposed modifications will create an entertainment area and a playground for the super rich. This is not lawful, moral or just.
6. Rozelle Bay is one of the most polluted bays in NSW. The proposal must be rejected until effective plans are in place to deal with the inevitable disturbance of polluted sediments and the ensuing consequences. 7. Areas of passive water remaining are already restricted. The proposal will take over more of the passive water in what is a small, already heavily used bay. This will have a major negative impact on the traditional bay users - rowers, dragon boats, yachts and catamarans.
8. Enjoyment of the adjacent parklands by walkers, picnickers and other park users will inevitably be disturbed by noise from the unreasonable increase in super yachts and the development of what is essentially an entertainment precinct.
9. The proposal, with extra outdoor seating, 79% more super yacht berths, restaurants and live music venues, extra car parking and reduced noise controls, will have major implications for local amenities. It should be rejected.

Please note that the proposed hotel entertainment venue will have a major noise impact on a large part of Glebe. This statement is based on recent past experience when there was restaurant at the site and the noise from the patrons and particularly the noise from the band/disco was heard on summer nights very clear and loud all the way up to Toxteth Rd and Forsyth St. Clearly, to be successful the club shall need to attract substantial numbers of patrons and the entertainment shall involve a lot of music and not be limited to fine dining.

The noise assessment undertaken for the proposal only had sensors near the bay on the Glebe side but based on experience the noise impacts will have an even greater affect on a much larger area. It is impossible to believe that the club will keep the windows closed at any time after 10 pm on a hot summer night and even later on the 10 unlimited nights. There is no effective way of monitoring the club or the noise levels to ensure that the "mitigation measures" recommended in the assessment are adhered to. The club will constantly be the subject of noise complaints but nothing will be done.

There are more than enough entertainment centres in Sydney already without expanding into and adversely impacting on residential areas. There are only a few owners of super yacht that "want" a club facility in this area. There are a large number of high quality fine dining restaurants in the area and no demand for another club style entertainment precinct. Further, as a result of the noise impacts the club development will constrain residential development associated with the Bay Redevelopment Project.

We strongly object to the proposal.

I object strongly to the proposed modification submitted by Sydney Superyacht Marina.

This is a case not just of a Super Yacht Marina but also of a developer seeking to make Super profits at the expense of the community.

The Government's consent went some way to allaying the many public amenity concerns associated with this proposal.

I find it astounding that the developer has immediately returned to aggressively overturn the compromise reached and impose higher car park levels, more cars, many more yachts, no constraints on outdoor dining, and removal of noise limits.

I found it objectionable from the outset that public land be used for commercial gain by developers who have no interest in respecting the fabric of the local environment or community. Given that Sydney Super yachts, by this application, have now made it clear that they have no intent to consider community interests at all, I feel there is a case to revoke the original consent.

I would ask the Government to reconsider the entire proposal. This development puts private gain before the public good for the many Sydneysiders who live in the neighbouring suburbs, or who frequent its pleasant parks and bays for quite enjoyment in their leisure time.

It particularly threatens the ability of the many rowers, dragon boat oarsmen and women and kayakers to safely use the bay.

This development effectively appropriates public land for commercial gain at the same time harming the community's ability to enjoy large surrounding areas, land and water.

The original application was oversized, inappropriate and should be rejected.

The modifications include increases in the total number of berths by 79%, car park by 40% and overall they are totally unacceptable modifications.

Most worrying is "changes to staging". This site should not be used as an outside music venue. Sound travels across the water and the venue will surely contravene existing sound regulations.

I have read the response to submission from Sydney Superyacht Pty Ltd and have noted their explanations and justifications for their business proposal, and have noted those aspects which are already approved. This does not change my original objections.

I note that having received approval, despite significant opposition from concerned councils, community groups and individuals, the developer is now applying for further extensions to what is already an impost on the community and surrounding area.

All of their modification requests are about increases - in floor area, in the number of boats and tenders moored, in building levels, in carparking, in outdoor amenities, and in using carparking spaces for other business activities.

I can understand why they are asking for all of this - it will make them a bigger profit. I request that NSW Planning & Environment balance the greed of developers, who impose their edifices on to the community and then ask "please sir, can I have some more", against the need of the general public as well as local communities and residents who want to enjoy their surrounds.

I object to the proposed amendments being approved without further noise testing and analysis and without further consideration of the impact to the area as detailed in the attached submission and the specific items repeated below

* Require updated noise testing and analysis for the proposed changes using the same company that was used for the approved application in order to ensure consistency and ensure that the report and data are included in the submission
* Require night time noise testing and analysis of the proposed 24 marina operations, in particular in relation to both yacht engine noise as well as yacht horn blowing which may be required to comply with maritime safety regulations (currently yachts sound their horn before departing the dock and that noise at 2am would be extremely disruptive to people's sleep)
* Require accurate "non wide angle" photos from Pavilions so that the Department can see clearly the visual impact of both the current western boathouse as well as the proposed additional floor in the eastern building and the proposed additional massive buildings that are not in the photos provided in the submission

I wish to object to the elements of the proposal that will increase the noise from operation of this facility. There was a carefully judged compromise on noise in the original approval, balancing wishes of proponent and of the local community. The proposed modification shifts this balance away from the local community.

I have attached a file that expands on these views.
