I fully support Modification 11 to 06_0250 Seaside Boulevard, Fern Bay.

Given that Rawson have agreed to provide a bond of $2.4M to ensure the
completion of the intersection onto Nelson Bay Road, and have already
completed their part of the road, I see no reason not to allow the
registration of Stage 14 prior to the construction and completion of
the intersection by the RMS.

Further delays for stage 14 owners will cause further financial stress
to the lot owners. Builders are putting up their contracts and banks
tightening their lending criteria, putting stage 14 owners in an
increasingly risky situation.

The stress for stage 14 owners of being in limbo has gone on long
enough. Given that section 14 is otherwise ready to go, with services
and roads completed inside the estate it does seem logical to allow
registration. With the intersection works due to start at the
beginning of 2019 it is likely that the intersection will be completed
before stage owners have finished building their houses anyway (taking
into account DA approvals, building times etc.).

As owners within in Stage 8 we are extremely aware of the fact that there
is only one exit out of the estate. Furthermore, there is already
construction at either side of the road along seaside boulevard at the
current and only entry to the estate. If the new extension is allowed
then this will open up another stage of the estate creating more
traffic.
Traffic is only part of the problem, we reside in a very bushfire
prone area. With dunes to the east and surrounded by the Worimi
conservation area. If a bushfire occurs, how do we all get out? From
the 1 entrance that could be blocked? Or the entrance to the dunes
that is also at the front of the estate and is likely to be burning?
Having 2 exits out of the estate minimizes the chance of getting
blocked in.
Only this year a bushifre burned out of control only 10km to our
north. I understand that this will effect the people waiting to build
in our estate but in my opinion i do not believe that this rates
higher then the general safety of all the families who live here
already.
I would suggest a separate entry to the dunes at the Eastern most
point of the estate

I support the application to modify Major Project 06_0250 (MOD 11) in
respect of Seaside Boulevard, Fern Bay.

I understand the current Project Approval ties the release of Stage 14
to the northern extension of Seaside Boulevard and its intersection
with Nelson Bay Road. I am aware that the land developer has completed
the northern extension of Seaside Boulevard as far as practical, and
its intersection with Nelson Bay Road is now subject to approvals
and/or works by RMS with unknown timeframes.

As a person with a deposit on land within Stage 14, I have and
continue to find the delays unnecessary in the release of Stage 14.
This continuing delay, to both myself and others in the Stage14, is
preventing building works commencing and us moving into our future
homes. This is placing continuing financial pressure and emotional
strain on families such as mine as we are having to rent for an
uncertain period.

I understand that the land developer is committed to ensuring the
construction of the northern extension of Seaside Boulevard and
upgrade intersection of Nelson Bay Road.

The proposed modification of the Project Approval would achieve a
mutually beneficial outcome by allowing owners of land in Stage 14 to
start building within further undue delays, yet still delivering
upgraded road infrastructure for those more broadly in the estate when
the intersection is able to be built in the future.

Message
Further delay in on extending the northern extension of Seaside Boulevard
leaves the Seaside Fern Bay community with a risk that if bushfire,
flood or storm were to cause the southern (currently only) entry/exit
road to Fern Bay to be closed for whatever reason, the residents of
the estate would be trapped inside and unable to get to their
workplace, cause undue delay on an ambulance arriving to a victim's
home if they were to become incapacitated, further emergency services
would be unable to provide their service to the Seaside Fern Bay
community.
One road in and out is a danger to the people of the estate.

Not having the extension to Seaside Boulevard in due time is would
also likely cause house prices to climb at a much slower rate or
possibly fall slightly as the estate has already been over time on
having lots prepared for the owners that wish to build their homes in
this estate.

Message
The approval for removal of the link for the delivery of the intersection
onto Nelson Bay Road for the registration of Stage 14 must be on the
condition of the delivery of the bank guarantee to RMS of $2.4
million.

My response to Mod 11 would be classified as Objection without the
financial condition as the key requirement for that approval for
registration of Stage 14.

I have attached my reasoning and evidence for this position.
