I do not agree with the proposal as I believe that the constant daily and evening activity from the rooftop will adversely affect the living quality of the adjacent apartment residents of 3 Carlton street. The daily/nightly activity, noise and loss of privacy (as the people on the rooftop can directly view into the apartments due to the close proximity) are negative factors and would certainly decrease the peacefulness and quality of living of the apartment residents directly facing the rooftop.

I am writing to object to the use of the Clare Hotel Rooftop as a bar/open entertainment area. I live on level 20 of the Central Park building opposite, and sound travels up here even with only a group of 5 people in the rooftop pool and no music or drinking. On previous occasions when the hotel has played music and had people drinking on the rooftop, the sound was impossible to block out. I cannot imagine what the sound will be like with up to 150 patrons drinking until 10pm 7 days per week, whether there is music or not.

On balance the proposal seems entirely unnecessary. This area is residential, the Hotel surrounded by many apartment buildings, and there are already plenty of places for people to drink and socialise close-by that do not create noise pollution for the many residents in the surrounding buildings. For example, the Clare Hotel itself already has a bar downstairs which can be used for alcohol consumption and entertainment, and there are two pubs within 1 minute of the hotel. There is therefore no need to turn the hotel's rooftop pool area into a place for entertainment.

Dear Sir/Madam

There have already been a number of excessive noise complaints from residents living in Central Park who are in close proximity to the Old Clare Hotel.

If this application is approved I believe it will significantly intensify the situation and have a very serious impact on neighbouring residents who are already contending with noisy construction works in the surrounding area, which has been ongoing now for the last 6 months. Our only respite from this excessive and obtrusive noise is after 6pm mon-sat.

If the proposed works at the Old Clare go ahead, it will no doubt lead to numerous irate and frustrated neighbours of the Old Clare (with good reason). Appreciate if you can take this in to consideration whilst making your decision.

Having lived through the last noise invasion in 2015/2016 I'm very concerned on the lack of impact this new modification will have. The general background noise of music was an annoyance, but it was the uncontrollable laughter and dreams from patrons that were the most irritating. there was sporadic increases in sound levels that at times made on feel that there was an emergency occurring that raised my response mechanism to uncomfortable levels. It was impossible to relax in my own home. The only was that i could escape this hysteria was to shut my windows lock out the outside world and expel the environment that I had enjoyed before this invasion was previously approved by Sydney Council. I can't not see how a pergola will in anyway stop patrons of this bar screaming at the top of there vocal capacities. I object strongly to this application and request the pool area be used only as a pool for the hotel patrons as it was originally intended.

To whom it may concern,

I live halfway up the building of One Central Park East building and my apartment is on the corner of Broadway and Carlton Street.

I strongly object to this proposal.

When there was a trial for the rooftop bar the noise was absolutely deafening and echoed across the whole area. Acoustics were not considered when this development was designed. This completely ruined the enjoyment of living in my apartment! I feel very sorry for the apartments looking directly over the pool!

There is already a bar at The Old Clare and other drinking establishments both in Kensington Street as well as the near vicinity of Ultimo and Chippendale. Why is there a need for another bar? The hotel should be mindful and respectful that this is a mixed residential area instead of another opportunity to grab more $$.

The residents here have been subjected to so much building noise over the past 6 months including the demolition of a UTS building on Broadway, the new construction of DUO apartments on Broadway and soon to come road night works in mid Feb from 8pm to 5am. This means we have 4 hours of peace a day however it is temporary.

Subjecting residents to constant and disruptive noise that intrudes on our right to have quiet enjoyment of our homes permanently is another matter.

1. The music was blasted at full volume
2. Patrons Screaming, Laughter and Voice are audible even on 20th floor.
3. I, we, object to Old Clare Hotel to disturb residents peace in their neighbour and Central Park East and all surrounding units are affected by noise pollution. It is not acceptable at any time of day.

A submission is made that this plan would be against the interests of closest residents. The noise and potential disturbances caused by 150 patrons with alcohol influence can very likely affect the residents around the area.

Even living in a high rise apartment some levels above the ground, I can hear at this moment hear noises and screams at night at ungodly hours. I can only imagine the inconvenience caused to private residences with this rooftop terrace.

Hi,

I am a owner occupier of apartment 905/3 Carlton Street, which is facing the Old Clare hotel rooftop and I am concerned that this 'entertainment' proposal for the rooftop area of this premises will negatively affect me along with all the other residents who are facing the hotel. There are 3 issues I am concerned with that will be the result of this proposal:

- It will be very Noisy (150 people together with alcohol and music).
- Privacy issues as East facing apartments are directly adjacent to the rooftop pool area.
- Increased number of people who will be alcohol intoxicated in and around the streets surrounding the Central Park residential apartment complex. This will result in more crime.

Due to the reasons above, I object to the approval of this proposal.

In regards to the rooftop bar above the Old Clare Hotel I understand they wish to open 7 nights a week and host up to 150 people in the venue.
My apartment is located directly above the hotel and overlooks the bar. Currently there is no noticeable noise from the bar, however general street noise is clearly audible in the apartment even with the windows closed. The bar re-opening will significantly add to the street noise. I recall when the bar was open last year and the noise emanating from the bar was very intrusive and prevented sleep.
I request the application for the opening of the rooftop bar be declined, or a compromise may be to have an early closing time (e.g. 9pm).

The proposed application of a bar on the rooftop of Block 3A at Central Park will adversely affect our enjoyment of our property at Central Park (east tower, unit 812).

Our main concern include the lack of acoustic barrier to the new development. Given that the typology of the proposed development is one of restaurant and bar hospitality, we feel the operating hours of this building will affect the overall comfort of our living space.

As an owner of an apartment on the adjacent property I object to this proposal on a number of grounds.
1. Noise - when the rooftop was open to the public and events the noise from the number of people admitted to the deck would permeate through our apartment. This was made substantially worse when music was being played at a volume that exceeded the crowd noise. It effectively destroyed our quiet time on weekends and nights when the rooftop was open for public admission. We had to keep our balcony windows fully closed.
2. Privacy - As the then Chairman of the residents committee I was constantly hearing feedback from residents directly opposite the deck who's privacy was heavily compromised by the large crowds on the deck.
3. The events previously held on the roof deck were like large dance parties and featured loud music, inebriated patrons and people drinking in the pool. Next to a heavily residential precinct ,with many families overlooking, I feel that this is not in keeping with the family friendly Central Park precinct.

There has been many incidents of intoxicated patrons being loud and unruly late at night, the bar is most likely to exaggerate this situation.
