I sing with Sydney Philharmonia Choirs. I have concerns about the sound from our rehearsals disturbing any performances happening in the performance area and vice versa. The performance area and our rehearsal space are in very close proximity to each other.
We often rehearse with the door open to allow for fresh air to come in during summer.
Will the choir rehearsal space be air-conditioned and sound-proofed during the development?

Also, the concept pictures seem to indicate a lot of use of concrete. This is not in keeping with the heritage / industrial background of the area and the surrounding structures which are made of timber.

Pier 2/3 has always been this remarkable space in a remarkable location. Now we have a plan that makes great use of it. Walsh Bay will be able to legitimately think of itself as an "Arts Precinct" once these works and the works on Pier 4/5 are complete.

we have conducted a management consult business for 10 years on these premises - our rooms are in constant use for seminars and one on one coaching- due to the sensitive nature of these sessions quite enjoyment is essential - the noise during construction will force us to move and encure costs the business cannot afford potentially forcing a 10 year old business with 40 associates ton close

Dear Mr. Lushel
As an owner of 13/13 Hickson road, a commercial office space situated within the building Pier 2/3. I strongly object to development SSD 7689 and SSD 7561 on the grounds of the excessive noise and vibration caused during construction, making my commercial premises un-tenantable.
My commercial premises is currently rented out, but my tenants have not renewed their lease and I do not know what to tell them.
The SSD 16_7689 Noise impact Assesment has no mention of the effect the construction noise and vibration will have on the commercial offices that are actually within the existing building envelope.
On page 9, Figure 3. Key Noise receptors, the commercial office spaces in Pier 2/3 are show to be `within the site boundary' but are NOT noted as a Key Noise receptor. How can this be?
Furthermore on Page 12 Table 3, Summary of specific noise criteria, there is no mention of the commercial office spaces in Pier 2/3 at all?
After reading the applications, It's obvious that any commercial premises within Pier 2/3 will not be a suitable place of business during construction.

Following review of the EIS Exhibition, Tudor Capital Australia (leasing Studio 11, Pier 2-3) objects on the following grounds:-
Noise during construction period
Noise during set up, events and clearance of proposed events
Street parking during events
Canopy over stage area

Noise during construction period:- Our office directly overlooks the proposed Waterfront square. Due to Heritage restrictions, we are unable to put secondary glazing on the windows or change the windows which due to their age are ill fitting and allow every bit of noise through. However this was part of the charm for us taking this office space almost 12 years ago. Construction works permitted during business hours 8am-5pm Monday to Friday will have a significant impact on our ability to work. It appears from the exhibition documents that there were no noise sensitive receivers or key noise receptors located in or by any of the offices that overlook the proposed development, premises that will suffer the most during and after construction work. Indeed it even states in one of the documents that residential premises on Pottinger Street and Lower Fort Road are shielded from noise at the stage area by the shore building between piers 2-3 and 4-5. Well that's where our office is located so what provisions are in place to shield us from noise? We have previously been significantly impacted by pile driving works and various other remedial work on the wharves. We have frequent in house meetings with investors and clients that will be unable to proceed during construction work. Even telephone calls will be very difficult due to noise levels. All the office space overlooking the proposed construction area is currently leased so to minimise impact to all these businesses, we object to any construction work being carried out during business hours.

Noise during set up, events and clearance of proposed events:- Hospitality businesses such as Simmer On The Bay and Sydney Dance Cafe currently restrict any sound testing to outside of business hours so as not to interfere with local businesses that directly surround them. Set up of events already impacts us to a certain degree and these are only small scale for approx 150 people compared to the proposed scope of events allowing up to 10,000 people. The proposed event management plan does not consider the impact to local offices on the piers for noise disruption during set up, sound testing, the actual event itself and clearing away. Restrictions on set up, sound tests, performance and clearing MUST be put in place (and enforced) during business hours to allow those waterfront businesses to carry out their work without interruption and disadavantage.

Street parking during events - Public transport to the area is lacking so most of our employees drive into work and park on either Pottinger Street or Hickson Road. What additional parking is going to be offered during Category 1-4 events to allow local employees to still be able to park close to their place of work if up to 10,000 people are also able to attend events?

Canopy over stage area - Diagrams and artist sketches show the canopy over stage area as being a permanent structure close to and in line with our office on level 3. This could severely impact natural ventilation and air flow through our office as well as created shadows over our desks and also restrict our views. It would also create a potential hazard when the wind is strong.

It seems that none of the studies (noise, waves etc), Master Plan or Concept Design have considered the impact to local businesses situated on the waterfront. Due to our location, we are the very people most likely to be affected (detrimentally) by this plan both during construction and subsequent events. At no time has anyone from the design team or local council planning department come to our office to get an idea of exactly how we may be impacted, both financially and environmentally.

We spent some time with your team last week to discuss the project planned to upgrade Pier 2/3-the project definitely is an exciting one and we are fully on board with supporting this project, however there are some concerns we have in regards to the period of construction that we may need to further understand in order to decide if we have any issues to lodge as a concern.

* Noise impact over the construction period
* Traffic impact over construction and beyond
* Parking impact post project completion
* Wave action impact post project completion
* Project noise management impact over construction
* Communication channels and decision making over the project between the project team and Pier One
* Pylon installation methods

With these issues requiring further investigation we would like to request a two month extension to the deadline of 16 December 2016 (February 16 2017) to lodge any concerns and would also request any support you may be able to provide to better understand the answers to these questions.

I am objecting to the proposed Walsh Bay Arts Project EIS on the grounds of loss of rental income during construction process should my tenants move out or demand compensation for not being able to work in the office during the construction phase and also during subsequent events in the public square. The tenants have previously had noise issues during remediation work on the wharves and cannot be expected to pay the same rent if unable to carry out their normal working duties, meetings etc so I assume compensation will be offered to landlords to cover any financial loss resulting from tenants claims? Due to heritage restrictions, we aren't able to fit secondary glazing to the windows or any form of sound proofing to minimise external noise so noise generated during construction and events is too excessive to allow my tenants to hold meetings, talk on the phone etc.
I also object to the canopy covering the stage due to loss of views, natural ventilation in my property which directly overlooks the proposed public square and it being a hazard during strong winds. The loss of visual and environmental amenity caused by the shade will severely impact the ability to lease my property to quality tenants.
I am not aware of any site visits to the offices directly overlooking the proposed works to ascertain noise impact on tenants and understand the key noise receptors weren't even located at the waterfront offices that front the proposed construction area so fail to see how the noise reports cover all the local offices fronting the development.

The submitted Development Application does not recognise the tenants currently located in the office suites of 13 Hickson Road and as such does not taken into account how this development and associated construction work will affect them.

Key points to my objection:
1. The Noise Impact Assessment submitted in the development application is based upon data from the location of 7 key receptors - as shown on page 9, figure 3 and figure 4. Not one of these key receptors is positioned waterside and close to our office, as such the assessment is incomplete as it does not consider in anyway at all, how the construction will impact / affect those tenants closest to the area marked for development and construction.

2. Shading for Public Square - the plans show that the supports for the shading are to be installed to the same height as our balcony and directly in front of our suite thus obstructing our view out to the water as well as creating shade to our office where it is not wanted, again this impact is not noted anywhere in the development application because the application has not recognised that we are located here.

Pier Capital operates an investment banking and corporate advisory business from offices in Shore 2/3, 13 Hickson Road. The construction of the proposed development, especially the Public Square, is likely to render the operations of our business untenable due to a range of factors set out below:

1. The EIS appears to have been undertaken in a flawed manner to give a false, misleading and deceptive conclusion of the impact of the development on affected premises. This includes, without limitation, that the noise emanating from the construction of this development, including the driving of 180 piles into the sea floor is within acceptable limited. Tests relied upon in the EIS were not located anywhere near the affected premises (including ours) and, of they were, would likely result in unacceptable noise outcomes.

2. There have been several piles driven into the sea floor where the proposed development is to be constructed. Each time these piles are driven, we are unable to conduct our business, including holding meetings and telephone calls, due to the noise emanating from this activity Our office is located a mere 15 metres from the proposed construction site of the Public Square, and is housed in a heritage building with poor sound insulation. In effect, when construction activity occurs, it can be heard loudly and clearly in our premises.

3. The proposed use of the Public Square is incompatible with the current use of our premises, Itis proposed to use the Public Square for commercial events of up to 1,000 people for an unlimited amount of use. Our premises is immediately above a business, Simmer on the Bay, which hosts up to 100 people, mostly outside business hours. The noise emanating from Simmer is most disruptive to our business. We expect that functions of 10 times the size of the current functions will be grossly detrimental to our occupation of our premises and our business activities, and likely to lead to our inability to conduct our normal business operations.

4. Consideration must be given to either compensation to affected businesses or not to build the public square, as it based on false, misleading and deceptive information. At the very lease, an extension needs to be given to the exhibition period to enable, among other things, a cogent EIS to be undertaken.

5. Neither Arts NSW nor Infrastructure NSW consulted early with us enabling us to detail our concerns with the project, and therefore the environmental assessment does not reflect our concerns.

6. Information sessions were deliberately held at times inconvenient for business owners and operators.

If our concerns are not adequately addressed and construction commences, we will be unable to conduct business. Consequences flowing from this include a forced relocation of our business (including a substantial diminution in the value of our premises, owned by a related company), to the potential closure of our business.

We are an occupier in Shore 2/3 (SP73989) immediately adjacent to the proposed developments.

Our business is a content marketing agency. Our work involves on-site client meetings that would be impacted by excessive noise. Our work involves commercial journalism and excessive noise may affect the interview process. And quite clearly audio podcast recordings and internal film work would be severely hampered by noise.

As a neighbouring occupier, we welcome the improved amenity arising from the development, however, we are conscious of the impacts from both the construction works and the proposed use of the public square in the long term given the potential detrimental and material impact on our business. We object to the Development Application as exhibited because it fails to consider the Occupants of Shore 2/3 as being the nearest commercial properties affected by noise from the developments.

The assessments and reports should specifically address the noise and vibration impacts on the existing businesses conducted in Shore 2/3, and the proposers should be required to mitigate these effects or compensate for such resultant impacts. We are concerned that noise from construction and the proposed uses of the public waterfront square will be incompatible with the commercial activities currently conducted in Shore 2/3.

We also request the time for submissions be extended to allow further consideration of these matters, including obtaining relevant reports.
