Official Caution issued to Consolidated Power Projects Pty Ltd (SSD-6686 as modified, Hilltops LGA)
On 24 May 2021, the Department issued an Official Caution to Consolidated Power Projects Pty Ltd for the construction of an electrical substation at the Bango Wind Farm project without firstly obtaining a construction certificate as required by the Environmental Planning and Assessment Act 1979. A Building Information Certificate for the substation was subsequently obtained from Yass Valley Council.

Dear Sir/Madam
I am writing to you to let you know that we, Robin & Andrew Winterflood are both vehemently opposed to the development and construction of the proposed Bango Windfarm. The main reasons that we are opposed to this project are:
Devaluation of our private holding
Visual Pollution
Mental Health
The proposed wind farm will significantly lower the capital value of our property. This is a serious issue as our property is our only means of income. To have it lose value from a project such as this will not only affect our credit rating but also significantly alter our ability to support ourselves in retirement.
The visual impact of the proposed windfarm will be enormous. Both homes face both north and due east where a conglomerate of more than 90 wind towers of 200 metres in height will be clearly visible. In other words we will be completely surrounded by wind turbines. The view out from the front of our own home would be completely destroyed by their construction. Our home that was originally built in the 1880's was positioned to take in the beautiful sweeping views of the valley and hills behind. The garden itself was architecturally designed in the 1920's to face and utilise the natural beauty of the landscape. The landscape that we look out at from the front of both houses is a beautiful mix of gentle rolling paddocks and unspoiled timbered hills. This would dramatically alter our lifestyle, the value of our home and in turn will then severely affect our mental health. Our beautiful view would be turned into an industrial landscape.
I have attached some photographs for you so that you will be able to see and hopefully understand the reason why we are opposed to the development of the Bango Wind Farm. The photographs are taken from the verandah of our house and neighbouring cottage. We both hope that you will take on board the seriousness of our opposition to the project and understand the impact it will have on every aspect of our lives now and into the future.

In addition it includes a disclaimer which further reduces the extent to which any party, including the NSW Government, can rely on the content of the document.
The EIS submitted does not comply with the Regulations and must be rejected until covered by a statement that wholly complies with the Regulations. Acceptance of the EIS in its
current form would involve the Department in a deliberate breach of the regulations, and a breach whose sole purpose is to benefit the developer.

The EIS does not comply with the requirements of the DGRS for the proposal nor with the requirements of Schedule 2, Part 3, s 7(1)(c) of the Environmental Planning and Assessment
Regulation 2000.
The proposal should be summarily rejected as contrary to the economic and security interests of NSW, its citizens and its industry.

levels and character are unpredictable and why wind farm noise modelling is inherently unreliable.
Consequently no reliability can be placed on the noise modelling submitted in this case and therefore the project should not be approved unless:
* there is permanent 24/7, full spectrum sound monitoring;
* at sufficient locations around the wind farm to provide a comprehensive history of noise impact at all residences within at least 10 kms; and
* with the complete data permanently available to the Department AND to all residents who believe they may be noise affected, and to their advisors.
Further, given NHMRC advice and actions indicates the possibility of adverse health effects (including recurrent sleep deprivation) it is essential that any consent conditions:
* draw explicit attention to the developer's obligations under the NSW Work Health and Safety Act 2011 No 10 (WH&S Act);
* explicitly impose health protection obligations and conditions (including for sleep) such that Investor State Dispute Resolution (ISDS) provisions under any Australian trade agreement cannot be used to block or penalise the NSW Government for any
subsequent actions it may take in relation to the wind farm to protect the health of NSW citizens or their animals.

I believe that the community have not been given adequate information about this process as the Dept of Planning Information Meeting held in Boorowa in October was not advertised in the Yass Tribune.
