DPI Fisheries is responsible for ensuring that fish stocks are conserved and that there is no net loss of key fish habitats upon which they depend. To achieve this, DPI Fisheries ensures that developments comply with the requirements of the Fisheries Management Act 1994 (FM Act) (namely the aquatic habitat protection and threatened species conservation provisions in Parts 7 and 7A of the Act, respectively), and the associated Policy and Guidelines for Fish Habitat Conservation and Management (2013). DPI Fisheries is also responsible for ensuring the sustainable management of commercial, recreational and Aboriginal cultural fishing, aquaculture, Marine Parks and Aquatic Reserves within NSW.
The Department has no objections to the proposal provided the mitigation measures to protect seagrass and foreshore habitats are in place.

The Department of Planning, Industry & Environment - Crown Lands (Crown Lands) notes that the proposed expansion of underground mining will be located under various parcels of Crown land, waterways (Lake Macquarie) and Crown roads. Coal mining (and ancillary activities) is a prescribed activity that is regulated under the Mining Act. It is not regulated under the Roads Act or Crown Land Management Act. The SEE states that the additional mining areas will cause “20mm subsidence…” which is approved under an existing development consent and will have “no noticeable surface impacts…”.
Crown Lands reserves its right to review the impact of any subsidence on Crown land and Crown roads and if management measures and remediation works undertaken by Delta Coal do not sufficiently addressed the impacts from any subsidence or sufficiently meet any concerns of Crown Lands, then an application for compensation under the Coal Mine Subsidence Compensation Act 2017 may be considered.
