Objection to Proposed Modification for 24-Hour Service Station – Kings Forest Stage 1
To Whom It May Concern,
I am writing to formally object to the proposed modification to allow a 24-hour service station, including associated lighting and noise changes, at Kings Forest Stage 1. As a resident living directly across the road at 240 Old Bogangar Road, Kings Forest, NSW 2487, I, Ian Faram, am gravely concerned about the significant and detrimental impacts this development will have on my lifestyle, wellbeing, and property.
Key Concerns
1. Noise Pollution
The operation of a service station throughout the night will generate continuous noise from vehicle traffic, fuel pumps, and other associated activities. The disturbance from customers arriving and leaving during late hours, often in vehicles, will inevitably disrupt my sleep and peace.
2. Light Pollution
Service stations typically require bright, artificial lighting for safety and visibility. The intensity and duration of this lighting—especially operating 24 hours a day—will adversely affect the quality of life in my home. It will interfere with my ability to enjoy natural darkness, impact sleep patterns, and reduce the general amenity of the neighborhood.
3. Impact on Residential Lifestyle
My neighborhood is primarily residential, and the introduction of a 24-hour commercial activity conflicts with the quiet and family-friendly character of the area. A development of this nature introduces a level of activity that is entirely unsuitable for our location and sets a concerning precedent for future changes.
4. Property Value
The increased noise, lighting, and traffic will negatively affect property values in the immediate area, particularly for homes situated directly opposite the proposed service station.
Request for Consideration
I urge the relevant authorities to reconsider the approval of this modification. If the development must proceed, I request stringent conditions to mitigate its impact, such as:
- Limiting operational hours to daytime only.
- Reducing the intensity of lighting, with shielding to prevent light spill onto nearby homes.
- Implementing noise barriers and landscaping to minimize disruption.
My primary concern is to preserve the residential integrity of the neighborhood and the wellbeing of those who live here. I trust that my concerns as a local resident will be given due consideration in this matter.

To whom it may concern,
My name is Jodie Smith of 6 Old Bogangar Road, Cudgen, NSW, 2487 and I am writing in reference to the above matter, having recently received a letter from the Department of Planning, Housing and Infrastructure.
I, my family and other residents of Old Bogangar have major concerns about the content of this letter and the intent of the development to construct and operate a 24-hour service station on the eastern side of Tweed Coast Road.
I believe this development (and especially the intent to operate 24/7) will have considerable detrimental effects on my residence, well being and others living on Old Bogangar Road, specifically noise and light pollution and the general influx of persons to the area directly across from our homes at night.
I have reviewed the submitted acoustic and lighting assessments, but would strongly dispute the findings and conclusions particularly from a “human” perspective. The request for installation of a 24/7 service station is, in my opinion, unnecessary and clearly highlights an attitude of “profits before people.”
I fail to see how the proposal for a 24/7 service station would not adversely impact the residents of Old Bogangar Road, particularly after hours. It is noted in the application that previous noise limit conditions now be disregarded with this modification, and to be frank, I find this extremely disappointing, considering my (and other residents) alignment with the developers up until this point in time.
I respectfully request that my objection to this DA modification be reviewed and considered by the Planning Officers and sincerely hope that our voices be heard in this case.

I object to this modification vehemently. The proposed opening hours of 24/7 is completely unnecessary in this area, there is several service stations available for patrons to get fuel and food between 10pm and 6am if needed. The modification has no regard for the safety of the residents surrounding the area, the wildlife or farming community.

Tweed Coast Rd on which the service station will be built: services residential areas ( there is no industry south of it); is not on a truckstop route; is not a thoroughfare for commercial vehicles which will use M1 service stations; is adjacent to residences; is very quiet in the evenings - therefore it should only operate during reasonable business hours of e.g. 6am to 8pm.
With consideration for the local residences, illuminated signals should not be used; additionally this is a local road, with Max speed limit of 80km so there is plenty of time to sight the station, which residents, who would be major users of this road, would know of anyway.
The noise limits should not be deleted in deference to local residents and wildlife e.g. koalas.
The station abuts koala habitat within the TweedCoast Koala Study area. The NSW government has a poor record when it comes to koala conservation, therefore illumination and noise at night when they are active is very disruptive to the local population.
With consideration for the local residences, illuminated signals should not be used; additionally this is a local road, with Max speed limit of 80km so there is plenty of time to sight the station, which residents, who would be major users of this road, would know of anyway.

I strongly object to the service station being open 24hrs 7 days a week, its completely unnecessary, this is not the M1 and there is several 24hr service stations in close proximity. I live directly opposite this project and I do not benefit from the acoustic fence in any way. I have no privacy or protection from noise, dust or light pollution and I am finding it very difficult to enjoy my property as I have previously.

This facility should not be open 24 hours and the car parking footprint is sufficient for vehicles. We do not want to encourage trucks detouring from the M1 into this peaceful and environmentally sensitive area.

I object to most of the proposed amendments to the original DA, for several reasons.
1. any change in operating hours to allow 24 hour operation is unfair on the local community, and those who have bought blocks of land on which they plan to build. If the service station is open 24 hours a day, it means that the operators are expecting business at all times. this has the potential to draw traffic away from the M1, onto the Tweed Valley Way. There is no need for two 24 hour stations so close together: the BP service station on the M1 is perfectly positioned to service all late traffic in the area.
2. The deletion of noise limitation conditions, on the grounds that noise will be limited to within allowable levels anyway, seems to be unnecessary. If noise levels are currently expected to be within the allowable limits, then why delete the condition? it should remain there as future protection for current and future residents.
3. it appears that most of the amendments requested are aimed at turning a local service station into a 24 hour truck stop. This is NOT what the local area needs, or wants. There are load limitations for the Tweed Valley Way, and it would not be appropriate to open a truckstop on this particular road. Doing so may encourage vehicles to travel down the Tweed Valley Way instead of the M1. This presents significant danger to wildlife, cyclists, and other road users, and will have an adverse affect on local residents, and the environment. I strongly oppose these changes.

This location is within very close proximity to houses and residential living so the noise and light will be very disruptive to local residents, as there is already a 24/7 service station located within 10 minutes drive of this location (bp at Chinderah) there is no justification for the requirement of 24/7 operation

The environmental impact of a service station directly adjacent Cudgen creek would be disastrous for the marine life, ecosystem and swimming conditions. A different site for this project would be far more ideal. We’ve ruined our Earth enough, we need to protect what we can. Not only the risk of spillage and waste being of a concern, but the littering that is sure to occur from fast food options being so close to the creek, which will flood our waterways and have the potential to harm marine life, and again, affect swimming conditions.

This modification request is totally inappropriate for the location - it's a residential area - in a sensitive natural environment. I find it hard to believe that a service station is allowed to be built there in the first place!
So it's a 'no' from me to 24/7 operation, to splitting the building in two, to the illuminated signage - and the noise limit conditions should remain as they are...

This gas station is not needed. There are plenty of others around.
It will bring dangerous types to the area.

A service station in this location is needed to service the existing population and the soon to be opened Kings Forrest. I believe the hours and end of trip facilities are a great itdea, and will take the pressure off illegal camping and be good for our many tourists in vans etc.

We do not require another service station. There are two at Hastings and one at Chinderah. The people that live across the road are already having a major change to their living experience with the road changes and the estate behind them. I travel through here everyday to drive 100km to Loganholme and there are plenty of petrol stations to use. This is excessive and will be an eyesore as well as impact nearby residents with excessive noise and odour.
