Penalty Notice issued to Cadia Holdings Pty Ltd (MP06_0295) Cabonne Shire LGA 

On 6 December 2022, NSW Planning issued a $6,000 Penalty Notice to Cadia Holdings Pty Ltd (Cadia) for failing to obtain a Construction Certificate for parts of the Molybdenum Recovery Plant at the Cadia East Project. Cadia have subsequently obtained a Building Information Certificate (BIC) from Blayney Shire Council.

Official Caution issued to Cadia Holdings Pty Ltd (MP06_0295) Cabonne Shire LGA

On 17 October 2024 NSW Planning issued an Official Caution to Cadia Holdings Pty Ltd (Cadia) for failing to submit the required Noise Impact Validation and Air Quality Impact Validation reports for the Cadia East Project Mine. NSW Planning is working with Cadia to develop a time frame for submission of the final reports.

Penalty Notice issued to Cadia Holdings Pty Ltd (MP06_0295) Cabonne Shire LGA

On 28 November 2024, NSW Planning issued a $15,000 Penalty Notice to Cadia Holdings Pty Ltd (CHPL) for failing to implement the Water Management Plan (WMP) for Cadia East Project.  Cadia self-reported the non-compliance following an internal review and an independent report identified that various dams on site were not to the capacity identified in the WMP. NSW Planning will continue to monitor compliance with conditions of consent.

having been actively involved with all Cadia mine developments over the years I am reasonambly conversant with each development and staged progression --I also sit on the community consultative cmte as the Orange L/holder rep.
this cadia east development will cause a reduction in groundwater to a number of l/holders around the development with a major thrust northward to the intersection with four mile creek rd /cadia rd.
what is evident from the hydrological study that this impact modelling is at best a professional estimate --however what is not estimated is the decline in yield of water out of the basalt aquifer that overlies the surrounding l/scape both to the north and to the east--
Last year a pump test of the aquifer at spring terrace showed the consequence of pumping and resultant drawdown and the zone of affectation which developed as a consequence of this activity --giving l/holders for the first time some real understanding of the complex nature of water flows in the basalt aquifer
it is as a result of this understanding that the Hydrological study now has l/holders expressing their concerns through myself to CVO and to other interested parties.
it would seem logical that while monitoring bores have been constructed by CVO that a bore monitoring plan which more broadly reflects this aquifer be implemented --then should impacts occur a stratergy of remediation and alternate water needs be implemented
what impact this groundwater reduction will have on the streams that rise on the east side of Mt. Canonolas and supply water to the catchment of Orange city has yet to be discovered -but in essence there will be some impact as groundwater expresses itself through springs and soakages which feed these streams.
we are aware of the reduction of available water in the riverine environment to the south of the mine complex and the impact it is having on water releases travelling down stream to licence holders -further complicated by rainfall events which have been under stress these past 10 yrs. 1998 was the last time the aquifer and streams were at maximum charge --since then there has been a fall of 5m approx across the aquifer in SWL in the basalt --this rises and falls depending on rainfall events -last spring 08-saw a rise of 1.5m in the groundwater which has been lost since through to the winter period -this was still 3.5 m below the 1998 level and is typical of groundwater movements subject to rainfall events
what I am proposing here is over the past 10 yrs since 1998 full aquifer- rainfall has been reduced during this droiught period --while the stock and domestic bores in general in the basalt have not failed they have on occasions struggled to yield adequate demand supply --any reduction as a consequence of the cadia east development may well see bores fail and l/holders be placed in an untenable position,
it is therefore essential that a full remedial process be made ready, to swing into action should this event occur - for those in the modelled decline of groundwater area- Cadia will have a plan developing to meet that impact --the zone of affectation may well be much large than is predicted as I have previously intermated that is why a stratergy needs to be incorporated in the consent conditions--

Dear Sir,

Currently we occupy two parcels of land. One of which is known as Laggoon Farm (Lot 17,84,89,294,DP 750415, Lot 5 DP 252284 and Lot 1 DP 5233158)is located at 418 Long Swamp Rd, Waldergrave, Cabonne Shire. This property is located within 2 kilometres of the proposed Cadia East project and currently has a water bore to 75 metres yeilding 2250lt/hr. The second peice of land known as Karinya (Lot 54,55,56 DP 750367) is located at 167 Carbine Rd, Forest Reefs, Blayney Shire. This property also has a bore on it to 65 metres yeilding 1600lts/hr and is located within 5 kilometres of the proposed Cadia East Project. As land owners and farmers situated close to the proposed Cadia East Project, as submitted by Newcrest Mining Limited we would make the following submission.

We, as neighbouring land-owners to existing Cadia valley Operations(CVO), have always enjoyed a very amicable relationship and see no reason for this not to continue. We are currently leasing agricultural land form CVO. We have always been well satisfied with the way that CVO have dealt with noise, dust and traffic issues, and we wish them well in their future developments.

Having said this we do have one major concern, that being the underground water supply to the two bores that we depend on for stock and domestic water supplies. We understand that there may and propably will be minimal effect on the water supply in the area that we occupy.

However, we need to be assured that when this project is to proceed,should there be any significant effect to our water supply as a result of mining activities,there will be adequate measures in place to protect our water requirements.

Our family has occupied the majority of the above land since 1876, and while relocation would not be an option we would be keen to pursue, the nature of our business is such that it would not be an impossible feat. We would only see this as a worst case scenario if it should come to pass that no other options were available.

We wish Newcrest Mining Limited and the Department of Planning every success in the planning of this development with the hope that the outcome will be in the best interests of everyone.

To Whom It May Concern

Our business has been supplying Newcrest Mining since they first began exploration at the Cadia Hill site south of Orange.

During the last 15 Years, there has been a very obvious growth in Orange. Not just population, but also services and general community facilities, which, without the annual injection of revenue into the town, would not have happened.

Orange has always had a very diverse mix of primary & secondary industry, with tourism also now being thrown into the mix, we live in what is a truly a very fortunate town & region.

In addition mining has created & secured many jobs directly, but also indirectly through the subcontractors used. As well as the flow on effect of Newcrests own spending, the spending of its' emplyees & subcontractors in the town.

Certainly in my lifetime, the previous largest employer in Orange was the Electrolux Factory, manufacturing white goods for both domestic & export clients. With the trend towards manufacturing off shore, in particular Asia, in recent years Electrolux ( a foreign owned company ) has begun winding back their operations here in Orange & moved some manufacturing offshore as well.

At a time when Orange appeared to have no " back up" employer of this size, Newcrest has taken the place of Electrolux as the towns largest direct employer. Add to that the employment opportunities offered by the contractors, and the town has a fantastic employment base, for anyone who WANTS to work!

Newcrest are also a very pro active supporter of many projects within the town. Donations of money, time & materials to schools, town infrastructure & charity are common. I don't believe any one institution in our area has the funds to contribute on such a large & consistant scale.

As well as a housing boom Australia wide, on the back of the large pay packets that mine employees receive, large growth in local housing demand has occured over the last 10 years. The old saying of prices being dictated by supply & demand, is no more evident than in the housing market of Orange & the surrounding districts.

Take away the Newcrest's Cadia East mine expansion, the money that fuelled the rise in housing disappears and the reverse will happen. People who took mortages since the mine began will not be able to earn enough in "regular" jobs to service their debt.

Many of these people would be likely to try & sell up & move away. Many houses on the market = oversupply = decreases in property values, FOR EVERYONE!!

Imagine purchasing a 4 bedroom house 12 months ago for $ 425 000 & having to accept $ 300 000 for it in a failing property market.

Orange has remained VERY economically stable during the world economic crisis, which I & many other business owners & employees believe is due to the activities & flow on of Newcrest loaclly. I am constantly telling clients & other business people that we are too busy to take part in the world wide recession. So if they want to have one, they will have to go ahead & put it on without us!

I am also relaistic & understand that there is more than one side to every story. And in this case the main objections will be environmentally based. The issues raised by environmental groups and concerned citizens ( including myself ) are founded & should be heard.

I also believe that Newcrest are a responsible corporate neighbour, and from what I have seen put forward, want a positive outcome for all parties, including the issues of water availability, sustainability and disruption to native vegetation & habitat.

Any opposition to the Cadia East expansion outside of environmental is petty and does not take into account the positives that Newcrest came with all those years ago.......

We are opposed to this expansion (new section) of the mine on the grounds of the considerable environmental damage that will occur due to clearing of native flora and displacement of native fauna and also the pressure it will place on the water supplies in the area such as, groundwater that has already been lowered by the existing mine.
Also the continuing shifting of millions of litres of water from the Macquarie catchment area to the Lachlan.
The continued insistance of Newcrest that they are entitled to free effluent from Orange Waste Water Treatment Plant is nothing short of a bloody minded attitude to an error of wording made by the then employees of the Orange Council. It was common and public knowledge that the life of the mine at the time was expected to be 20 years with no additional mined areas even thought of at the time.We are also very concerned about the long term high risk of pollution of the general environment.
These concerns must be considered as they are for the long term wellbeing of our area. These must not be sacrificed for the short term profit of Newcrest shareholders or the local economy. We survived before this mine and will still be here after it has gone.

I am writing to oppose the plans to extend Cadia Mines. Even though I am an Orange business owner, I believe there are many reasons we should not have the mine extended. They are as follows:
Orange was fine economically before the mine, it will be fine after.
The destruction of native bushland and trees that have been there hundreds of years will be devestating.
There will be lots of endangered and native wildlife that will be completely wiped out and their homes destroyed.
We already have a huge water problem, this will make it even worse.
Knocking all those trees down is also going to have an effect on our rainfall.
Whats next? Mine all of Mount Canobolas and then what beauty do we have left to go to on weekends and relax?
What has the world come to ? All we care about is money, and making more and more soon we won't have an earth left to live on, then money won't mean anything, will it?
Think about it!!

I offer my support for this project. Not only does this offer direct employment, but the on-going opportunities for employment is vast. We need to de-centralize from our large cities. Companies like Newcrest are supportive of the local community in areas such as sport and education.
This expansion can only be beneficial to our community.

I support this project as one of the larger sources of free-enterprise wealth for Orange and the surrounding area. I'm sfraid the new base hospital and the dentistry school are both Govt projects relying on money stolen through taxation. That makes us all poorer! Without free-enterprise growth there will be no wealth at all for Govts and Councils to steal!

Haha!! Govt donations! I make them every week when I get wages don't I!

Subject: Newcrest Mining. Cadia East, Development Project.

Cadia East development has my total support.

I am a mechanical design draftsman and have been a sole trader since 1998, and have been working full time for Jeff Hort Engineering for the past 2.5 years. Jeff Hort Engineering has called on me on numerous occasions to attend site visits to the Cadia Mine in order to take site measurements for various jobs that were required by the mine. My first visit to the Cadia Mine involved several hours of site induction. I was impressed with the level of commitment and sensitivity that Cadia Mine operators have toward the environment, the heritage and history of the local indigenous people, and the welfare of the neighbouring farming community.
As I had further visits to the mine, I recognised that not only were they a large company employing scores of local people to operate the mine, they also provided work for many local businesses, (myself included). As about 80% of my work came through Jeff Hort Engineering at the time, and most of that work was directly related to Cadia Mine, I recognised that a very large part of my business income was as a result of Cadia Mine.
Those who work at Cadia Mine as well as those who are contractors working on site receive considerable training in safe work practices, as well as many and various other training programmes that skill up workers in other fields.
The very strict drug & alcohol requirements for those who are on the mine site, encourages responsible use of alcohol and discourages contractors and employees from drink/drug driving.
While Cadia Mine requires a considerable quantity of water to sustain the operations at the plant, the largest part of the supply is from recycled water from Orange Waste Water Treatment Plant. I believe this is a very responsible use of a valuable resource which was previously not used. Most of the water used for processing is recycled, with only a small percentage going to tailings.
It is clearly evident that Newcrest (the owners of Cadia Mine), have a benevolent attitude toward the local communities around Orange. This is seen in their willingness to support local charities and sports clubs as well as being a significant income source for many local businesses and individuals.
Orange and the surrounding communities of Blayney, Millthorpe, Spring Hill and others have benefited in many ways from having Cadia Mine in the district.
It is my opinion that the Cadia East Project would be an environmentally responsible, economically stimulating, and socially supporting project which will benefit Orange and the surrounding communities with greater employment opportunities, both directly and indirectly.

As a landowner and part time resident in Orange, I believe this project to be in the best interests of the Central West and Orange in particular. Jobs will be created.This is a $2 billion project which will create significant new jobs in Orange by 2012 & inject over a billion dollars into the region each year & sustain in excess of 1500 direct & indirect jobs.

My name is Chris Gryllis and I have been a resident of Orange for 47 years.

* For the last 35 years I have run a Real Estate business with my wife.
* I am involved with the Orange City Council serving as a Councillor for the fifth term.
* I have been a member of Orange Rotary Club for the last 38 years.

as an executive on the Orange Chamber of Commerce for 13 years.

Since its inception I was privileged to observe their public relations and communications with the Councils, other organizations and the public. Submission re Cadia East Project:

There are significant adverse environmental impacts associated with approval of the planned Cadia East Project that concern me including demands on the regions water resources totalling 56ML per day, intersecting and disruption of sub aqua groundwater flows, the water table and contamination of same, significant loss of remnant native woodland including Endangered Ecological Communities, loss or impact on a number of threatened species and habitat and loss of base flows and impacts on water quality in numerous local rivers and streams.

One of the most significant impacts will be the demand on water resources in the region. The current mine operation has already had significant impacts on water and the planned expansion will compound those impacts. There will be a continued demand on Orange City Council's treated effluent currently diverted from the Summer Hill Creek system to Cadia Valley Operations. Prior to diverting the treatment water to Cadia this treated effluent has at times of extended dry periods made up 100% of the base flow in Summer Hill Creek and has seen the creek cease to flow for the first time on several occasions in the past few years, an unprecedented event in the past. Summer Hill Creek has been identified as a system under high environmental stress due to excessive water extraction and assigned an S1 classification more than ten years ago in two separate reports by the Department of Land and Water Conservation. Since then the diversion of the treatment water to Cadia, previously discharged into the Summer Hill Creek system, has added significantly to this environmental stress, pillaging water from one catchment and transferring to another catchment.

In 2007 Cadia Valley Operations faced a critical water shortage situation and and on 3 May, 2007 made a request to Orange City Council for the purchase of water from the city's water storages. This was agreed and transfer of 450ML of water was announced to begin on 3 August, 2007. This plea for Orange's water placed the community and the State Government in a situation of moral blackmail to protect jobs and the local economy. There is no guarantee that the planned expansion will not see a repeat of this situation in the future placing pressure on Orange's limited water supplies. The future development and expansion of Orange in itself will place increasing demands on limited local water resources not having access to any local river system. Orange is currently operating a Stormwater Harvesting scheme under emergency provisions of the Water Act 1912 and has Level 5 water restrictions in place. The Stormwater Harvesting scheme is adding to the high environmental stress of the Summer Hill Creek system due to the added extraction of water from this creek system therefore can not afford to see supply any of Orange's potable water, currently wholly captured from the Summer Hill Creek system, diverted to Cadia in times of water shortage at the Cadia mine.

The original deal to divert Orange's treatment water to Cadia Valley Operations made no provision for an allocation of this treatment water to the environment or downstream community and was originally anticipated to be for a period of 10 or 12 years. Now with this planned expansion of the mine this transfer of treated effluent is set to continue till at least 2031 and possibly beyond with potential further expansion in the future, again with no allocation of this treatment water, which has at times constituted 100% of the base flow in the creek, for the Summer Hill Creek system and the environment into the future.

The clearing and loss of 238ha of remnant native woodland and creation of a 255ha subsidence zone and 300 metre deep sink-hole is a significant loss to the environment. With the proposed offset measures of enhancing other areas of native bushland and planting of additional trees to form wildlife corridors, what guarantee is there that these plantings will be successful. There is no guarantee that failed plantings will be replaced until successful and where will the water, vital in the establishment of such plantings, come from.

There must be solid guarantees that lost Endangered Ecological Communities will be replaced and not see any reduction of these important woodlands and habitats and a return of a portion of Orange's treatment water to the Summer Hill Creek system.
