I object to the modification of Angus Place mine, which would allow damaging mining in the sensitive Carne Creek catchment.

Centennial Coal must not be allowed consent for Modification 4 over an area where first workings have already been sought and approved last year in a restricted manner that did not preempt decisions on the major extension by the Planning Assessment Commission.

Carne Creek is currently in a pristine state, and its waters that flow through the Greater Blue Mountains World Heritage Area are of the highest standard.

Earth Recovery Australia is strongly opposed to the Angus Place modification 4 proposal put forward by Centennial Coal. The area to be impacted is of high conservation value, including pristine upland swamps and the sensitive Carne Creek, which flows into the Greater Blue Mountains World Heritage Area, thus any impacts on this currently pristine water course will also impact the World Heritage Area.

The Department of Planning and Infrastructure has previously ruled against similar modifications, and the current proposal must be held to the same standards. This proposed minor modification pre-empts the outcome of the major mine extension proposal for Angus Place currently under assessment (SSD5602) and as such it should be refused or deferred until the major mine extension for has been determined by the Planning Assessment Commission.

The issue of Australia's appalling record with regard to species extinction is well know in scientific circles and has recently been highlighted in the media. With the loss of habitat being a major contributor to this sad statistic the degradation of this pristine and valuable natural asset cannot be justified for the short term profit of a private enterprise. The NSW government has a critical role to play in terms of biodiversity conservation, in particular as the custodian of the international significant Greater Blue Mountains World Heritage Area, which stands to be impacted by the degradation of Carne Creek.

I am opposed to this proposal as it will lead to damage to the Carne Creek and its water which flows though the Greater Blue Mountains World Heritage Area.

The applicant has previously wrought damage on the Wolgan River and cannot be trusted in this instance.

There is a major mine extension awaiting determination by the Planning Assessment Commission, and this modification 4 should not be permitted to pre-empt the decision making for Angus Place (SSD5602). It is inappropriate to handle these matters in a piecemeal way, and the various applications and proposals should be considered together to avoid the damage to the environment of a 'death by a thousand cuts'.

This current proposal also seeks to expand the width of the longwalls as a precedent, and should not be permitted to do so until the major extension has been considered. Such expanded width would also cause more damage to the environment and could lead to loss or significant degradation of the shrub swamps on Newnes Plateau which are listed as Endangered Ecological Communities under NSW and Commonwealth environmental protection legislation. The Royal Botanic Gardens says the majority of swamps, particularly those in the Carne Creek catchment, and east and south of it, may be considered primarily groundwater dependent with a permanently high watertable maintained by groundwater aquifers. Longwall mining in this area would damage the aquifers and destroy such swamps and their dependent floral and faunal communities.

In conclusion the modification 4 proposal should either be refused outright or its determination deferred until the major mine extension for Angus Place is determined by the Planning Assessment Commission.

I wish to submit the following as an objection to

I believe strongly that the Mod 4 proposal should quite simply be refused, however at the very least a determination should be deferred until the major mine extension for Angus Place (SSD5602) is accessed & determined by the Planning Assessment Commission.

*I do not feel that this lesser proposal for mining is needed in order for continuity at Angus Place, and I oppose this proposal as by its content it pre-empts decision making for the major mine extension proposal under assessment (i.e. SSD5602).

*There has been great confusion regarding this minor modification with Centennial Coal advertising it during the exhibition period for the major mine extension . In order to give the community proper information, opportunity & fairness I suggest that submissions to Modification 4 & SSD5602 proposals be considered in relation to both these proposals.

* Centennial Coal must not be allowed consent for Mod 4 over an area where first workings have already been sought & approved last year, in a restricted manner that did not preempt decisions on the major extension by the Planning Assessment Commission.

* The proposed first workings being applied for under Mod 4 set up longwall mining of panels 1001 & 1003 that are wider than those previously approved and will lead to more environmental damage in the sensitive Carne Creek catchment than was caused in the Wolgan River catchment.

Surely this is unacceptable to the Planning Department & the people of NSW.

* I feel Centennial Coal is attempting to "lock in" the position of regulatory authorities regarding damaging mining in this sensitive Carne Creek area before the PAC has decided the matter. I do not believe this is in keeping with the intention of regulations nor the roles of our licencing authorities.

& Carne Creek is currently in a pristine state,& its waters flow through the Greater Blue Mountains World Heritage Area are of the highest standard. Surely this precious resources priceless value should be given a higher priority for protection..

* Carne creek must not run orange nor suffer reduced flows, similar to Wolgan River after Centennial Coal wrecked it.
I personally also have witnessed damage to other creeks in NSW from Centennial Coal activities - LT Creek in Lake Macquarie is one such creek that comes to mind.

* No amount of prosecution for breaches to licences will 'make good' these waterways. There is already a trail of destruction sites from Centennial Coal with rehabilitation & restoration outstanding or failed.

*Mine Subsidence is another huge issue.
* The cracking & creation of Sink Holes is becoming more common from Mine workings around our state.

*Flora & Fauna that depend on these unique landscapes will be impacted on - including Threatened & Endangered .
species.

*Cumulative impacts & negative irreversible impacts on the health & sustainability of our environment & community can no longer be tolerated .

*Our ecology being placed at unprecedented stress levels & is currently going into decline.

I therefore urge you strongly to reject this proposal by Centennial Coal.

Also, my family and I have had countless camping trips on the Newnes plateau and walked through and through Gardens Of Stone, it is a wilderness that is vital for the ecology and ambience of the Blue Mountains and beyond. We are envied by other countries for this pristine wilderness, it would be criminal and shameful and completely regressive to allow any mining to go ahead in this area. There are plenty of alternatives for energy other than coal, including solar and wind turbines and hydro.
Sheer laziness, greed and blind power at the helm of these proposals. Please think about the future of the planet and our children.

- This small amount of proposed mining is not needed for continuity of operations at Angus Place, and I oppose this proposal as it pre-empts decision making for the major mine extension proposal under assessment (i.e. SSD5602).

- Centennial Coal advertised this minor Modification during the exhibition for the major mine extension causing confusion and to be fair all the submissions to Modification 4 and SSD5602 proposals must be considered in relation to both these proposals.

- Centennial Coal must not be allowed consent for Modification 4 over an area where first workings have already been sought and approved last year in a restricted manner that did not preempt decisions on the major extension by the Planning Assessment Commission.

- The proposed first workings being applied for under Modifcation 4 set up longwall mining of panels 1001 and 1003 that are wider than those previously approved and will lead to more environmental damage in the sensitive Carne Creek catchment than was caused in the Wolgan River catchment.

- Centennial Coal is manipulating the planning system to gain a tactical benefit, namely to set the width of the longwalls as a precedent in the sensitive area proposed for future mining under SSD 5602 before the Planning Assessment Commission as considered the major extension proposal.

- Centennial Coal is attempting to "lock in" the position of regulatory authorities regarding damaging mining in this sensitive Carne Creek area before the Planning Assessment Commission has decided the matter.

- Carne Creek is currently in a pristine state, and its waters that flow through the Greater Blue Mountains World Heritage Area are of the highest standard.

- Carne creek must not run bright orange or suffer reduced flows, just like the Wolgan River after Centennial Coal wrecked it.

All ramifications of such a request need to be considered before granting permission for further mining activity in this area.

It is such a unique area and it and surrounding areas need to be fully protected and therefore mining activity would be at odds to ensuring that these areas are fully protected which would mean permission for additions to mining activities in these areas need to be denied.

Your help is needed to reveal the last card in Centennial Coal's three card trick. Centennial has already played its cards for two major proposals in the Gardens of Stone region, but now we must stop a modification of Angus Place mine that would allow damaging mining in the sensitive Carne Creek catchment. It's a con job intended to force the regulator's hand.

SUMMARY: The proposed Angus Place modification 4 proposal actually forms part of the state significant development recently on exhibition; a major mine extension over 2,638 hectares of Newnes Plateau (SSD 5602). Centennial Coal claims it needs this minor modification to allow it to continue mining while the big project is assessed. It is a tiny proposal in terms of the amount of coal mined but it will set a precedent that allows damaging mining in the sensitive Carne Creek catchment that contains the best swamps on Newnes Plateau.

A year ago the Department of Planning and Infrastructure ruled out an identical mine modification. Centennial Coal is having two bites at this cherry because the stakes are high. Centennial wants to lock into position all the regulatory authorities behind damaging mining in the Carne Creek catchment. It wants high intensity mining that will wreck the best upland swamps on Newnes Plateau. We have to make Centennial play by the rules. Ask that this proposal be sent to the Planning Assessment Commission or refused outright.
