Draft Deed of Novation for an existing Voluntary Planning Agreement for 61-79 Henry Street, Penrith

Penrith City Council is publicly notifying a draft Deed of Novation for an existing Voluntary Planning Agreement (VPA) for 61-79 Henry Street, Penrith also known as Lot 1 DP 771927 (the Land) between Thursday 27 June 2024 to Thursday 25 July 2024.

The existing VPA was entered between Council and the Australian Foundation for Disability (AFFORD) on 23 October 2023 in support of a Planning Proposal relating to the Land. Since the VPA was entered, AFFORD and Harrington Penrith Pty Ltd have exchanged contracts for the sale of the Land and AFFORD has sought Council’s consent to sell and transfer the land, and novate its rights and obligations under the VPA.
