On 23 July 2020, the Department issued a $6,000 Penalty Notice to Wollongong Coal Limited (Wollongong Coal) for failing to comply with the Minister’s Development Control Order (DCO) at the Russell Vale Coal Mine. The DCO required Wollongong Coal to replace the underground pipe section of Bellambi Gully Creek with a suitably designed and engineered open channel constructed on the southern side of the coal stockpile area by the 20 December 2019. A further DCO was also issued on 23 July 2020 to undertake the required works at Bellambi Gully Creek.  The Department will continue to monitor the implementation of the order
