Please see attached in general site is far too small for the proposal and is already over flowing and using Lot 1, Lot 8 and Lot 10 there are factual errors in the application and the existing works are in breach of the NSW governments guidelines in water frontage land.

Please find attached photo of the end of Styles st ( turning circle) taken 10th of May at around 6pm. The existing business with its current capacity of 90,000 TPA regularly blocks the entire end of Styles st by parking trucks accross the entire end of the public street. This prevents other trucks or vehicles from turning around. The business clearly is too large for its existing footprint which covers Lot 1, Lot 8 and Lot 10 Styles St.

I refer to the recently exhibited application (SSD-104535) for the Central Waste Plant Resource Recovery Facility at Kurri Kurri and to the Departments request for comments. Council has reviewed the information provided with the application and submits the following comments for the Department’s consideration:

Traffic and Access

It is noted that a Traffic Impact Assessment (TIA) has been prepared in support of the application.

Consideration needs to be given with respect to the ability of trucks to adequately manoeuvre from the proposed load checking/waiting bay on Lot 1, to the central facility located on Lot 5. Any likely queueing of vehicles along Mitchell Avenue and Styles Street will create traffic and safety issues on these roads.

The safety of workers moving between the two (2) sites (separated by Styles Street) needs to be considered. In this regard, safe pedestrian linkages should be provided.

Flooding

The subject land is flood affected and it is noted that a flood impact assessment has been prepared and addresses the requirements of Council’s Development Control Plan 2010 (Chapter C.9 Development on Flood Prone Land).

Air and Water Quality

Council will rely on the comments provided by the Environmental Protection Authority (EPA) with regards to air and water quality impacts resultant from the development.

Noise Impacts

Council will rely on the comments provided by the EPA regarding the likely noise impacts on the locality.

Visual Impact – Café Building

The external appearance of the proposed café building is not considered to be adequate in terms of streetscape appeal. The submitted plans of this building appear conceptual with no details on material colours or finishes. The height of this building is considered excessive given there is only a ground floor component.

Landscaping

The landscaping strip proposed along the eastern frontage of Lot 1 (containing the café) is not detailed in that a planting schedule has not been provided.

Site Consolidation

The proposal will result in the development straddling Styles Street on two (2) separate parcels of land with the proposed car park, cafe, staff amenities and load checking bays on Lot 1 being ancillary to the existing waste recycling facility on Lot 5. It is recommended that in the event of development consent being issued that a condition of consent be imposed requiring the consolidation of these allotments.

Hours of Operation

It is noted that the proposed development will trade 24 hours and Council generally has concerns regarding businesses trading 24 hours, particularly with regards toamenity impacts on surrounding properties. Consideration also needs to be given to any likely social impacts associated with 24 hour trading including crime prevention measures.

Food Premises

The proposed cafe will be required to satisfy the provisions of the Food Act 2003 and Food Safety Standards. In the event of development consent being granted, a condition is recommended requiring compliance with the following legislation, regulation and standards:

• Food Act 2003
• Food Regulation 2015
• Food Standards Australia and New Zealand – Food Standards Code 2003
• AS 4674-2004 for Design, Construction and Fit out of Food Premises
• AS 1668.2-2002 – The use of ventilation and air conditioning in buildings
• Building Code of Australia (BCA)

Section 7.12 Contributions

In the event of development consent being granted, a condition will be required for the payment of contributions in accordance with Cessnock City Council’s Section 7.12 Levy Contributions Plan 2017.
