Dear Sir/Madam,

I was appointed Liquidator of the Victordot Pty Limited (in liquidation) (‘the Company’) on 19 April 2024.

The Company is the owner of two properties located at Lot 1 & 2 of DP1146671 Terminus Street, Liverpool NSW 2170 (Title Reference: Lot 1 & 2 of DP1146671) (‘the Properties’).

The Properties are adjacent to the property owned by Liverpool City Council (‘LCC’) known as 52 Scott Street, Liverpool NSW 2170 (being the property contained in Certificate of Title Folio Identifier Lot 1 in Deposited Plan 1293937) (‘Council Premises’).

The Council Premises are currently undergoing redevelopment as part of the Liverpool Civic Place project (‘Redevelopment Project’) being undertaken by Built Development Group Pty Ltd (‘Built’) on behalf of LCC.

My preliminary investigations have revealed that LLC and its representatives, Built, have occupied and utilised the Properties since May 2021 (if not earlier) in relation to the earlier works DA (DA-906/2019) or Phase A Detailed DA (DA-836/2020). It appears that LCC and Built have not obtained permission from the owner of the Properties to occupy and utilise the site.

In relation to the proposed SSD application, I make the following comment:

- If you review pages 20-23 of Appendix F – Architectural Design Report in the EIS documentation, you can see that paving, grass and a pathway are proposed on the Properties.

- if you review pages 18, 76, 77 and 80 of the Douglas Partners Preliminary Site Investigation Report located Appendix X - Preliminary Site Investigation Report, it clearly identifies that the Company as the registered proprietor of Properties.

I have been in contact with LCC, they maintain that they are not in occupation of the Properties and have not authorised Built to occupy the Properties.

At present, LCC and its agent, Built are still in possession of the Properties.

On 16 May 2024, I inspected the Properties along with a representative of LCC and Built.

From my inspection and a review of the Properties, I have observed the following:

- There is building material and waste on the Properties;
- The Properties have been altered during LCC and Built’s occupation and use of the site. It appears that a small reservoir has been built.
- The Properties are unsafe. There are a number of occupational health and safety issues on site;
- There is hoarding around the Properties;

I urgently request that LCC and Built remediates the Properties and ensures that the Properties are made safe.

Based on the above, it appears to me that LCC and Built will continue to occupy the Properties as part of this development.

On behalf of my company Landbank Real Estate Pty Ltd owners of 312 Macquarie Street Liverpool near 52 Scott Street Liverpool Lot 1 DP 1293937 state significant development application. I wish to strongly object to the development of the 29 storey shop top housing development comprising of 320 dwellings retail tenancies including a cinema and workplace gym meeting rooms etc.
My main serious objection is they provide only 119 car spaces and I would like to know where the other 201 unit dwelling residences are going to park. Plus commercial and cinema most proposed residents have one or 2 cars each plus visitors to the project they have nowhere to park. Liverpool CBD is already congested and council over the years have not provided parking to meet community expectations and in fact if you take a good look at the CBD there is very little public parking and in fact George Street Liverpool outside the courthouse and police station from one side to the other, signs have been put up Police vehicles only. The department of planning should revisit the car park situation and make sure that the project offers at least one car space per residential unit and the appropriate parking for the cinema and other commercial development. The serious question is where will all the people park? That is the occupants of the units and their visitors and household parcels for items purchased online. This current proposal will create a huge mess and comparing Liverpool to Campbelltown, Campbelltown Council addressed the future parking by providing public parking in the CBD at least 4 to 6 times more spaces than Liverpool. You can not operate a building such as this and the Council chambers next door with inadequate parking. The whole question once again I would like the department to answer where are the 270 occupants of the units going to park most of them have two cars. Check your statistics, plus the cinema and all the other tenancies, how many car spaces are required not to be a white elephant project. Basically I would like an answer to my strong objections.
