Penalty Notice issued to Richard Crookes Construction Pty Ltd (SSD 8606, City of Willoughby LGA)
On 6 July 2020, the Department issued a $15,000 Penalty Notice to Richard Crookes Construction Pty Ltd (Richard Crookes) for failing to comply with approved construction hours at the Hollinsworth Road Warehousing Project in Marsden Park, NSW. Limits on construction hours are important to protect the amenity of residents surrounding developments. The company has since taken corrective actions to minimise the risk of reoccurrence and ensure compliance with the approved construction hours. The Department will continue to monitor compliance with conditions of consent.
Official Caution issued to Richard Crookes Constructions Pty Ltd (SSD-8606 as modified, Blacktown LGA)
On 27 April 2021, the Department issued an Official Caution to Richard Crookes Constructions Pty Ltd (RCC) for failure to comply with the approved construction hours at the Marsden Park Warehousing Estate development. RCC permitted construction related deliveries to occur at the development on 3 December 2020, from approximately 6am, causing noise disturbance to neighbouring residents. Compliance with approved construction hours helps to minimise the impact on surrounding residents and protect the amenity of the area. RCC has since taken corrective action to minimise risk of reoccurrence to ensure compliance with conditions of consent.
Development Control Order issued to the Logos Properties Holdings Pty Ltd (Logos) (SSD-8606 as modified, Blacktown LGA)
On 25 March 2021, the Department issued a Development Control Order to Logos Properties Holdings Pty Ltd (Logos) to undertake additional attended noise monitoring to prepare a new Noise Validation Report for their Marsden Park warehouse development. Logos had previously submitted a Noise Validation Report to the Department based on inadequate noise monitoring, failing to take account of enhancing weather conditions and worst-case operational scenarios. Logos have since engaged a noise consultant and carried out the required noise monitoring.

development of the Marsden Park Warehousing and Light Industrial
Estate ( SSD 8606). The information provided by the NSW Planing and
Environment department, indicates that the operation hours of the
warehouses will be 24 hours a day, seven days a week. I strongly
object to this, as I reside to the rear of the development and already
have been impacted by the noise pollution from heavy machinery that is
being used 6 days a week starting a 7am through to 4 pm. After viewing
the Master Plan layout and Estate plans it is evident that large
trucks will be entering and exiting warehouses from the rear of the
development. This will impact on all homes on Stockholm Ave that are
behind the industrial area and I doubt that any amount of landscaping
barriers will make any difference to the reduction of noise. It is
totally unacceptable to expect residents to tolerate 24 hours a day,

Ck Ingenia Lifestyle, Marsden Park. The site as per the projects EIS
is classified as a caravan park, we need to make the point that the
site is not a caravan park it is a manufactured home estate with
permanent residents. As such consideration regarding the impact of the
development should be more in keeping with residential estates rather
than industrial land. Our concern with this proposed development is
the impact the 24 hour operation of the site will have on the
residents of our estate. Our concern primarily relates to the impact
of noise on the residents our estate. We believe the noise impact
assessment on the residents of the estate should factor in the same
noise impact requirements as of the residential communities that
adjoin the development site. It is our view that further consideration
should be given to the installation of noise attenuation barriers
along the boundary of the Logos development and the Ingenia land to
mitigate against noise impacts and safeguard the lifestyle of the
estates' residents. Even though the land is zoned industrial, the
occupants of the estate live there permanently, the homes they live
are their one and only form of residence. We believe that the existing
standards of living currently within the estate should be maintained
to the maximum extent as possible. We would therefore like the
Department to strongly consider the requirement for further noise
attenuation to protect the quality of life of the residents of the
estate.

inclusion and delivery of the ultimate Hollinsworth Road construction
between chainage 400 and 1080 and the ultimate roundabout to
facilitate the near term delivery of the Daniels Road Bus Link by
others. These discussions have not concluded and we are concerned that
they do not amount to amended plans and works. On review of the
application, we note that the proposed plans are inconsistent with the
position that Sydney Business Park, Ganian and Logos had agreed to
progress. This unfortunately puts the inclusion of our land as part of
this application and our landowner consent at risk. In the event that
the ultimate Hollinsworth Road between chainage 400 and 1080 and
ultimate roundabout to facilitate the Daniels Road Bus Link are not
included and delivered as part of the Logos works within this
application, Ganian will unfortunately have to withdraw their
landowner consent. For the record, we note that the conditions on
which the Ganian landowner consent was granted is specifically
detailed in their letter to the Blacktown City Council. We remain
consistent and stand by this position. Obviously, should these
ultimate works be included in the updated plans, and be approved for
delivery as part of the consent, then the Ganian landowner consent
remains as granted. We attach the Ganian landowner consent again for

letter on the 16th January 2018 with regards to the Marsden Park
Warehousing and light Industrial Estate(SSD 8606) I would firstly,
like to object to the building of this development, as I believe this
would have major impact on our standard of living as well as the
de-valuing our property within the area due to closeness to our back
yard. Currently we have Costco which can been seen and heard from our
backyard but this not a 24/7 operation, but with this up-coming
development being in operation 24 hours a day, 7 days, the volume will
increase significantly. but our major concern would be the health
impact this will have on my family and the surrounding family. I would
also like to object to this as currently our 2-year-old granddaughter
is living with us and this will affect her as well. I am all for
growth in the area but not at the cost of people's privacy and quiet
time, as there will be no let up of the noise I am disgusted with the
NSW government in the way they have approached this development and
the lack of any consultation with the community. Could you please
explain to me why construction has been begun before the community has
voiced their concern and objection with this project. Please find
