Enforceable Undertaking – Proten Tamworth Pty Limited (SSD-7704) Tamworth LGA
On 26 July 2023, NSW Planning accepted an Enforceable Undertaking from Proten Tamworth Pty Limited (Proten), for various breaches of SSD-7704 including construction of two unauthorised borrow bits outside the approved disturbance boundary, failure to use fully sealed concrete flooring in poultry sheds, construction of a permanent residence, and commencing operations without an approved Operational Environmental Management Plan in place at the Rushes Creek Poultry Production Farm. Proten has undertaken to provide $50,000 towards a University of New England agricultural biosecurity and waste minimisation research program. Additional details available here.

plan was to build a house that was environmentally friendly
self-sustaining with its own stock (including chickens). This is all
now in question as there will be possible issues coming from the
odour, dust, noise and light from the proposed high intensity farm
development. My plans to have a house using rain water for drinking
are also possibly not viable as there may be contaminated from dust
produced by the farm that could transport hazardous material into
drinking water as a bio-security risk. There are also concerns with
biosecurity risks from the proposed farm to the local area and farms.
There is only a single lane road that separates the land that is owned
by the proposed developers and my own. There are financial
implications that the land value will decrease if the development goes
ahead. From the development application appears to have the sheds
location in direct line of site from my land. If I was to build the
furthest that my house would be approximately 2.8Km to the North of
the proposed farm sheds.
Odour Issues
On the Environmental Impact Statement there is a comment in Table B
(Page ix) as quoted "Negligible potential for any cumulative odour
impacts."
There appears to have been not information / evidence provided to back
this statement as correct or incorrect. This is an environmental
concern that needs to be addressed before the development goes ahead.
Job Issues
After reading a shareholder newsletter produced by ProTen the
possibility for local jobs is possibility not as stated at 20 full
time positions as all manages were previously hired on 457 visa
holders. This will possibly only have 12 of these jobs going to
locals.
Feral/Native Animals
I was unable to find any precautions in relation to the movement of
feral and native animals to and from the property that could be
transporting diseases and or viruses to the local farming lands and
community.
Collection dams
The location of the collection dams are on already known waterways.
What precautions are in place if the collection dams overflow and find
their way into the local water tributaries to Keepit Dam or the Namoi
River.
Dead Bird Freezers
The location of the dead bird freezers are approximately 100m for the
public road. There are possible bio security risks with this being so
close to the public. The dead birds will be transferred to these
locations for collection with the possibility of unknown death from
virus or disease. Why are they not further off the road on the
property.
Old Property Houses
There are proposed changes to the property boundaries within the lots
designated for the development. The houses currently on these lands
will just be left to deteriorate once all tenants leave the houses.
Will there be any obligation for the developer to remove the derelict
buildings before building the new ones as this may interfere with the
residential zoning rights.
