S73A submission for an amendment to Ballina LEP 1987 relating to the date of reference of Ballina DCP- Exempt and Complying Development

The proposal is to amend the date of adoption of the Exempt and Complying development DCP in Clause 35(5) of the Ballina LEP to reflect the current date of 26 August 2010. The amendment to the DCP will exempt small scale commercial use of footpaths from requiring development consent under the EP &A Act 1979. It will also remove current provisions applying to alfresco dining and clarify car parking requirements. Such activities/land uses will be administered by Council's Commercial Services Section exclusively under the Roads Act 1993.
