Amendment to Clause 4.2A(3) of the ARLEP 2012

Currently lots can be created under the MLS, under Clause4.1(3) of the ARLEP 2012 in the R5 zone, however Clause 4.2A does not acknowledge this provision under clause 4.1 and requires lots to meet the MLS in order to have a dwelling entitlement. This planning proposal seeks to amend this inconsistency by amending Clause 4.2A to acknowledge lots created under Clause 4.1(3).
