19 MARSH STREET ARNCLIFFE 2205 Cook Cove Nominees No 1 Pty Limited Planning Agreement

Cooks Cove Nominees No 1 Pty Ltd in its capacity as the trustee of the Cooks Cove Property Trust 1 and Cooks Cove Nominees No 2 Pty Ltd in its capacity as the trustee of the Cooks Cove Property Trust 2 (referred together as the Developer) have sought entry into a Planning Agreement with Transport for New South Wales (TfNSW). The Planning Agreement seeks to provide infrastructure contributions is association with a proposal for mixed-use and logistics development generally in accordance with Planning Proposal PP-2022-1748.
The Planning Agreement is to apply land legally referred to as Lot 31 DP 1231486, Lot 100 DP 1231954, Lot 14 DP 213314 and Lot 1 DP 108492.
The developer proposes to make the following contributions:
Monetary contribution
• State and regional road upgrades within Bayside LGA - $8,700,000
Works-in-Kind
• Marsh Street and Gertrude Street intersection upgrade- $324,519
• Marsh Street and Flora Street intersection upgrade - $300,122
• Flora Street East extension interface with Arncliffe Motorway Operations Compound
• Signalised intersections - $113,156
• Bus stops - $358,163
The developer is entitled to generate a Works-in-Kind offset against the monetary contributions. The value of the Works-in-Kind offset is limited to $1,095,960.
The Minister for Planning and Public Spaces is not a signatory to the Planning Agreement.
The Planning Agreement seeks to exclude the application of Division 7.1 Subdivision 4 of the Environmental Planning and Assessments Act 1979.
