Hart Road Loxford Hydro Aluminium Kurri Kurri Pty Ltd Planning Agreement

Associated with State Development Application 6666 (SSD6666) for the remediation of the former Aluminium Smelter at Kurri Kurri, a Voluntary Planning Agreement has been prepared to secure obligations under that DA including the long-term management of a containment cell and site. Under the Planning Agreement, Hydro Aluminium Kurri Kurri Pty Ltd (Developer) are required to: - Provide $6.5 million for the long-term management of the Cell; - Provide a $6.5 million bank guarantee to secure the payment, and another guarantee of $1 million, in case the Developer fails to properly manage the Cell during that 5 year period; - Provide $30,000,000 in securities for the Cell construction; - Construct an access road from the nearest public road (Hart Road) to the Cell; - Manage, monitor and maintain the Cell and site for 5 years in accordance with a long-term environmental management plan; - Provide insurance cover for the Cell (in the event of its failure or damage) for a further 10 years under which the Minister or Waste Assets Management Corporation (WAMC) will be the insured party The Planning Agreement also requires Hydro to engage an Independent Engineer (a construction quality assurance engineer) to carry out services, equivalent to the Independent Engineer (IE) Services. The IE will inspect and certify the Construction Remediation Works in accordance with the Planning Agreement, the Remediation Consent and all applicable laws and standards. SMEC Australia has been selected as the Independent Engineer.
