Amendments to State Environmental Planning Policy No. 55 - Remediation of Land


State Environmental Planning Policy Amendment (Remediation of Land) 2018 commenced on 31 August 2018. As a result, new provisions will assist in ensuing that adequate arrangements (including financial arrangements) are in place for the perpetual care of the containment cell and other land on the site of the former Pasminco Cockle Creek Smelter and Incitec fertiliser factory at Boolaroo, Lake Macquarie, before any further significant development can occur on the site.

The amendments impact:

  • State Environmental Planning Policy No 55 – Remediation of Land
  • State Environmental Planning Policy (Exempt and Complying Development Codes) 2008

The amendments have been notified on the NSW Legislation website.

The proposed amendments were on public exhibition during 17 - 31 July 2018.
