State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) Amendment (Resource Significance) 2013


The NSW Government has amended the Mining SEPP to: Ensure the significance of the resources (major or minor) must be considered in the decision-making process as an important, but not the only, factor; Stipulate the key environmental, ecological and amenity criteria to protect water resources, habitat and amenity; Require that the economic and environmental issues mentioned above are properly balanced; and Elevate the importance of the Office of Environment and Heritage (OEH) in the assessment process, by ensuring a consent authority must consider OEH’s advice on biodiversity mitigation and offset measures. The amendments aim to increase confidence for investors and the community about how decisions are made on mining proposals.
