Penalty Notice issued to Concrite Pty Ltd (SSD-10479) Penrith LGA

On 10 September 2024, NSW Planning issued a $15,000 Penalty Notice to Concrite Pty Ltd (Concrite) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the 200 Aldington Road Industrial Estate development. Concrite failed to provide the CTMP (containing the approved traffic routes) to their subcontractor resulting in a heavy vehicle subcontracted by Concrite turning right from Abbotts Road onto Mamre Road in contravention of the approved traffic routes on 21 June 2024. The requirement for the left turn into and out of Abbotts Road was put in place for safety and local amenity reasons until the signalised Mamre/Abbbots Road intersection is constructed. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.

Official Caution issued to CJ Doyle Contracting Services Pty Ltd (SSD-10479) Penrith LGA

On 20 November 2024, NSW Planning issued an Official Caution to CJ Doyle Contracting Services Pty Ltd (CJ Doyle) for failing to implement the approved Construction Traffic Management Plan (CTMP) at the 200 Aldington Road Industrial Estate development. A CJ Doyle truck was identified turning right from Abbotts Road onto Mamre Road in contravention of the approved traffic routes. NSW Planning will continue to monitor compliance with the approved traffic routes at the development.

Official Caution issued to Simmons Civil Contracting Pty Ltd (SSD-10479) Penrith LGA

On 21 November 2024, NSW Planning issued an Official Caution to Simmons Civil Contracting Pty Ltd (Simmons Civil) for failure to implement the approved Construction Environmental Management Plan (CEMP) at the 200 Aldington Rd Industrial Estate. While dewatering a dam, sediment laden water was discharged off site. Simmons Civil have since changed their dewatering procedure to ensure this type of incident does not occur.

Referring to my letter and photographic evidence dated 21/11/20 in response to the Mamre Road precinct proposed Development Control Plan. My wife and I repeat our strongest objection to the proposed widening of Aldington and Abbotts Road as it relates to our family home at 287 Aldington Road, Kemps Creek. Our objection relates solely to the potential demolition of my front fence which faces both Abbotts and Aldington Road which appear to support your development application. I personally constructed this unique, artistic, iconic fence over the course of 4 years. It is not replaceable, represents a landmark in Western Sydney which must be protected. Without its fence, the potential alternate use of our home in an industrial area, perhaps as a conference centre, is severely comprised. We propose any road widening extends into the property of my opposite neighbours, which have no unique characteristics, so as to not effect my fence and property. I am seeking legal advise to support my position.

The proposal has included 200m2 of ancillary cafe floor space, which is not in sync with the "Mamre Rd Precinct Structure Plan" whereby the Indicative Employment Service Hubs with a 400m catchment, is not located within this development application. Therefore this request should be eliminated from their proposal, as too many "employment service hubs" would be ad hoc to the overall precinct, as it would lack consistency.

The proposal is unclear to the origin of the materials for the infill of the numerous damns. To support the draft DCP for the precinct, they should be limited to using fill from developments within the precinct.
