Submission of Objection to Application No MP 0060 MOD 15 and MP 06_0058 MOD 15Section (Proposed Modification to Lot 6002 DP 1195858)

My husband and I are lodging our objection to this proposed modification. We are not objecting to the change of use from Retirement Village to Residential Housing but to the changes made to the advertised/promoted Masterplan of the layout of roadways and housing lots, including the change in road access to these housing lots and the proposed changes to the current open space on the cnr of Halloran Street and Coaster Circuit.

1. Objection to the size and shape of the Open Space allotment on the corner of Halloran St and Coaster Circuit and associated introduction of the proposed service road (extension of Ketch Lane)

The advertised Masterplan maps/diagrams and visual presentation for the whole Bayswood Estate have all consistently shown the same shape and size for this Open Space area. Some diagrams have also shown that this area is quite heavily vegetated with eucalypts, casuarinas and other native species. Our property is located at Lot 104 (27 Halloran St) directly opposite this Open Space area. We purchased here specifically because of the proximity to this Open Space and the visual and auditory advantage it offers and the safety of the roadway with no roads or driveways opposite. Because the Masterplan included this Open Space, we expected this to be retained in all future planning. Further, the retention of the open space was a key consideration in our acceptance of the requested Stockland purchase price for Lot 104 (27 Halloran St).

Our expectation was that after the development of Lot 6002, the outlook from the front of our house would be a filtered view, through a layer of mature vegetation in the Open Space, to the rear fences of the closest housing. The Modified plan provides us with a very different and unappealing view, an increase in man-made noise, reduction in the sounds of nature, likely reduced wildlife including threatened species and unsatisfactory road safety hazards.

The addition of the Service Road (Extension of Ketch Lane) and changed block-layout resulting in houses facing Halloran St and a reduction the Open Space on cnr of Halloran Street and Coaster Circuit, will detrimentally impact on us, other Bayswood residents and the environment by:

* Adversely affecting our visual amenity from Lot 104 (27 Halloran Street) - reduced depth of vegetation, with houses rather than fences showing behind the vegetation
* Increasing man-made noise (with house fronts rather then fences facing us, and reduced depth of vegetation due to introduction of service/access road) and reducing the sounds of nature
* Loss of significant native vegetation with likely impact on bird habitat (kookaburras, kingfishers, owls (including the boobook), cockatoos (including the black glossy), parrots, several species of lorikeets, honeyeaters and golden whistlers and other protected/threatened species
* Increased road traffic due to vehicles accessing the service road (proposed extension of Ketch Lane)
* Increase in potential traffic accidents due to close proximity of this service road (extension of Ketch Lane) to main intersection of Bayswood Avenue and Halloran Street and to our driveway
* Increased potential traffic accidents due to reduced visibility that drivers will have when they try and exit the lane onto Halloran St and due to reduce visibility that drivers heading east along Halloran towards the shopping centre will have of cars exiting the proposed service lane.

The "boundary" for Lot 6002 has been shown consistently since 2009 to not include the Open Space on the cnr of Halloran Street and Coaster Circuit. This modification proposes to now include this previously excluded finger (triangle) of Open Space and to also reduce the size of the open space.

2. Objection to the roadway layout for lot 6002

The proposed Modified plan will introduce multiple unsatisfactory and as yet traffic management issues on Halloran St. In the application, the argument made in relation to some of the roadway changes ie to "avoid traffic conflicts with multiple driveway crossings of Moona Creek Road associated with the main thoroughfare to the District Centre" has been flawed and has missed and therefore not assessed/considered the fact that Halloran Street is the MAIN THOROUGHFARE from Stages 5, 6, 7, 8, 9, 10 and 11 (400+ residential lots) to the Vincentia Marketplace. This congestion/thoroughfare has previously been assessed/acknowledged when approval was sought for a Bus Route to service Bayswood. This resulted in a No Stopping Zone being deemed necessary from Summercloud St to the Moona Ck Roundabout on the Eastern side of the road. The application proposes additional burden on this already busy and often dangerous road via introducing 2 new road access points, a new laneway and driveways for 10 new residential lots in the area and on the same side as the No Stopping zone. There will also be considerable impact at the southern end of Halloran St in the vicinity of the Medical Centre, which is already congested with traffic movement and parked cars. The addition of a new road exit into lot 6002 almost opposite Seabreeze St will make this section dangerous to say the least!

3. Flaws in/objections to dfp planning consultant environmental assessment

The dfp planning consultants document (6 July 2016 Our Ref: 6376D.1DK_Mod 15) environmental assessment also does not address nor assess the proposed introduction of the service road (proposed extension to Ketch Lane), the proposed reduction in the open space size due to the proposed introduction of the service road , the proposed additional access road off Halloran Street closer to Moona creek Road and the proposed additional 10 driveways on Halloran Street.

4. Flaws in/objections to the council submission COUNCIL REFERENCE: SF9786-13

*Threatened Species Issues. The council has assessed that `The area of impact remains the same, (i.e. vegetation area to be removed), therefore, no increase in impact, as already approved.' As outlined earlier in this objection the reduction in the size of the OPEN SPACE to introduce the proposed service road (extension of Ketch Lane) means there is a potential impact on threatened species that has not been assessed.

*Open Space. Council has proposed/suggested to relocate the playground in Pacific City Park to this new development but close to Halloran Street. Due to the significant traffic along Halloran Street such a proposal needs further assessment due to potential traffic dangers to children. Consideration for example of using the Open Space opposite from Lots 103-104 in Halloran Street for a play park would not be wise due to the fact that even in its current form the open space is not that wide and fronts a very busy through road (Halloran Street) and this application proposes to make the space even narrower.

We agree with the submission of our neighbours, Joe & Judi Nethery and particularly are concerned by the number of property entrances into Halloran Street as this is a very busy roadway being both a bus route and shopping centre access for the estate. Further we would like to see appropriate trees remain that enhances the bush-like feel of the Estate rather than all completely being bulldozed. The estate plan where entry to this part of the development was via Bayswood Ave would overcome the traffic concerns. Thank you for the opportunity to comment.
