Message
In March 2017 much of the Tweed Coast flooded in areas that has not
flooded for 35years. The water which flooded northern Kingscliff did
not come from rainfall but was pushed up onto the floodplain by the
incoming tide and did not drain from the flooded area for 24 hours
i.e. 2 outgoing tides. Whilst Tweed Shire Council has done a
remarkable job with the projected flood mapping, Council is unable to:
prevent the tides from rising above the TSC projected heights; prevent
the area from flooding to a higher level than in 2017. The North
Kingscliff and West Kingscliff areas were approved for development in
the 1980's and, by Council's predictions (a 3cm rise), those houses
will be flooded. However, there is great concern that if
Gales-Kingscliff Pty Ltd is permitted to increase the amount of sand
extracted (changing the batter from 1:5 to 1:3) and increasing the
Quarry life to 2047, then there is no certainty for current and
intending purchasers that their land will be out of the flood zone.
The water will have less area to spread to because of the floodplain
filling. This will increase home insurance costs considerably. Also,
if the quarry life is permitted to extend to 2047 then the expected
public use of the rehabilitated area will be pushed back well beyond
the date of the completion of the expected residential developments.
There is great concern that if the MOD 2 is approved then the areas
listed will be subjected to higher flood levels.

Cudgen Lakes Sand Quarry Modification 2 05_0103B MOD 2 Commentary on
Application to Modify This commentary is provided on behalf of the
Kingscliff Ratepayers and Progress Association Y1002525 and residents
and ratepayers generally of the locality surrounding this modification
application. While we understand and accept that modifications
applications are submitted for various reasons by others as
individuals or entities, we wish to submit the following in
relationship to the application. While none of our members are
`experts in the field' we do have concerns with regards to the fact
that this area is part of the floodplain, and by and large our history
is lived history (i.e. the Association has been in existence since the
1930's). The timeframe for submissions 24/1/18 to 8/2/18 is considered
too short given the holiday season has not long finished and people
are only just returning to a `normal' routine. In fact the Association
wishes to request that if an extension is not allowed then KRPA Inc.
advises the Department that we may wish to make further commentary on
behalf of our members, residents and ratepayers. Tweed Shire (as you
would most probably know) was severely impacted by flood waters in
March/April 2017. That event has left long lasting impressions on a
considerable number of residents of the Tweed. It has also left
residents in heightened states of awareness, and yes for some members
of our community fear. We appreciate that the owner has obligations
under legislation and regulations conditions of consent, statements of
commitments and is legally bound to conduct various studies/reports
etc. to support any modification application. KRPA Inc. duly notes
that timeframes for sign off on some of the provided reports,
supporting the modification application, predate the flood event of
March/April 2017. We believe that due to that event and its severity
generally within the locality/floodplain that the Department should
have additional reportable studies done to ensure that what is
proposed has no significant impact on the floodplain and properties in
and around the site and or Cudgen/Kingscliff/Chinderah, road networks,
infrastructure public or private etc. Generally KRPA Inc. and
residents/ratepayers understand that some areas of Gales Kingscliff
P/L properties will be approved for other uses in the future. We only
ask given the event of 2017 that those who will sign off on this
application ensure that every study/report necessary is part of the
(modification) approvals process to ensure that the area is left with
good legacies for now and into the future. Thank you for reading our
