For the past year, there have been significant works undertaken within the Berry St precinct, including work on power upgrades and street landscaping. The works have been loud & intrusive over this time and many of the works have to be undertaken outside of peak. This has caused loss of amenity to residents overnight and during the day of weekends.
This application proposes construction activity outside of normal construction hours where there is no corresponding need for doing so (eg, no major road closures). Hence, the only benefit will be the earlier completion of works, which accrues to the benefit of the developer. There is therefore no reason for residents to bear the burden of the loss of amenity for no public purpose.

As a resident of north Sydney, and living on berry street I object to the extended construction hours, specifically 6 pm - 10 pm Monday to Friday, and any construction on Saturdays.
I object due to noise pollution arising from the construction. the noise significantly interferes with sleeping and impacts on my physical and emotional well being. The current level of construction and associated noise is already unacceptable without increasing the hours any further.

I do lodge the current submissions as there was no other form which would allow me to do so (screenshot can be available by request) using the link provided by Planning and environment (letter dated 24 June 2016)
There is a notification modification request to Commercial and Retail Development at 86-96 and 100 Mount Street, North Sydney received by me on 24 June 2016. The above Notification request seeks approval of the development including extended construction hours for certain works to occur Monday to Friday between 6:00pm to 10:00pm Monday to Friday and 1:00pm, and 5:00pm as well as core construction works to occere Saturday 7:00am to 1:00pm.
In accordance with the Interim Construction Noise Guide recommended standard hours of work are Mopnday to Friday 7 am to 6 pm and Saturday 8 am to 1 pm.
It was not specified in any of the submitted documents why the works should be done outside of recommended standard hours and what kind of works will be done at these hours. It is mentioned that "No external building works shall be undertaken outside the standard construction hours of 7:00am to 6:00pm, Monday to Friday, and 8:00am to 1:00pm on Saturdays, with the exception of activities listed above under D1(b). The use of jackhammers and other noise generating machinery is strictly prohibited after 6:00pm on weekdays and 1.00pm on Saturdays". However the strong justification would typically be required for works outside of recommended standard hours.
In accordance to Assessment of Proposed Additional Construction Hours the Measured Background Noise Level at 6pm-10pm Weekday on Mount street is 59-60 dB(A) what is higher than recommended by NSW Industrial Noise Policy 50 to 55 dB(A).
There were no reasons specified in any of the lodged documents describing why the works should be done outside of standard hours. Even if it was mentioned that "the proposed extension of construction hours was discussed with Council to which it was advised that similar extensions have been granted for other sites in the surrounding area. It was agreed that the extension would allow the construction of the building to be completed more quickly, limiting disruption to the area. It was agreed that internal works are acceptable outside of usual construction hours." there is actually no clear reasons on such an decision being made. Works outside of recommended standard hours can cause sleep disturbance as well as blasting and vibration.
Based on the reasons mentioned above I do object any works been undertaken from 6pm till 10 pm on workdays and from 7am till 8am as well as from 1 pm till 5pm on Saturdays.
Please provide the strong justification proving the works should be done outside of recommended standard hours.
Please also provide some additional information to what the amendments to other associated conditions are.
I do no object to:
- changes in the ground floor and mezzanine levels including the car parking layout and end of trip facilities;
- changes to the basement levels including the car parking layout and end of trip facilities
- a reduction of 96 bicycles spaces from 220 to 234
