Amendment 18 - Rezoning of land to IN2, Munday Street, Warwick Farm

BackgroundThe Australian Jockey Club (AJC), owner of the site, is seeking an amendment to the Liverpool Local Environmental Plan 2008 to facilitate the sale/development on land at Munday Street, Warwick Farm. The AJC has owned the site since 1923 but the majority of the site has remained vacant since that time. ContextThere are eight existing cottages on part of the site (0.72 ha), zoned R2 Low Density Residential, which were built specifically for AJC staff housing in the late 1940s. The houses remained as staff housing until the 1980s. This group of houses known as "The Warwick Farm Conservation Area" is listed as an item of local heritage significance in Division 1 of Part 2 of the Liverpool LEP 2008. The larger part of the site (2.3 ha) is zoned RE2 Private Recreation and is vacant with several trees present. LocationThe site subject to Amendment No. 18 is to the west of Governor Macquarie Drive and within the vicinity of Warwick Farm Race Course. It is bounded by Munday Street, Governor Macquarie Drive, Manning Street and Hume Highway, adjacent to Warwick Farm home improvement hub, which is zoned IN1 General Industrial. ZoningThe planning proposal applies to part of Lot 1 DP 1040353 (West of Governor Macquarie Drive), currently zoned RE2 Private Recreation and R2 Low Density Zones under Liverpool LEP 2008. Related Planning ProposalA separate Planning Proposal (draft Amendment No. 14 to Liverpool LEP 2008) to allow additional uses on Warwick Farm Racecourse and rezoning of part of the land at Coopers Paddock to IN1 General Industrial and RE1 Public Recreation Zones was determined by Gateway on 15 December 2010 (see PP_2010_LPOOL_007_00). These sites are also owned by the AJC and located to the east of the proposed Amendment 18 - Munday Street site. The Planning Proposal seeks to:* rezone part of Lot 1 DP 1040353 from RE2 Private Recreation and part R2 Low Density Residential Zones to IN2 Light Industrial Zone while also adding an additional use to Schedule 1 of the Liverpool LEP 2008 to allow (with consent) the retailing of "Camping and Outdoor Recreation Equipment", "White goods" and "Home d‚cor items", and * to remove the Warwick Farm Heritage Conservation Area from the Heritage Schedule (Schedule 5) within Liverpool LEP 2008. Council's letter and report dated 13 January 2011 are attached at Tag 3.Council's suggested wording to be added to Schedule 1 are as follows and would be subject to legal drafting. Schedule 1 Additional Use ClauseUse of land at Warwick Farm in Zone IN2 Light Industrial This clause applies to part of Lot 1 DP 1040353 being land north of Munday Street, Warwick Farm. Development for the retailing of "Camping and outdoor recreation equipment", "White goods" and "Home d‚cor items" is permitted with consent. Development for the purposes described in sub-clause (2) is only permitted where that development is part of a single entity retail premises which also retails landscape and garden supplies and timber and building supplies. The Planning Proposal also seeks to amend the LLEP 2008 maps to ensure that the appropriate controls apply to the land proposed to be rezoned to IN2 Light Industrial, it is required to amend the lot size map, floor space ratio map, height of building map and the key sites map as follows: Lot Size Map (LSZ-014) - The site currently has two minimum lot size requirements; being 600sqm (Category M) and 10000sq m (Category Y). It is proposed to be increased to 20000sq m (Category Z) for the entire site. Floor space ratio map (FSR-014) - Maximum Floor Space Ratio to be changed from 0.5 (Category D) to 0.75 (Category I), to be consistent with other IN2 Light Industrial Zones. Heights of building map (HOB-014) - Height of buildings is proposed to be changed from 8.5m (Category I) to 15m (Category O). Key Sites Map - Amend Sheets 6, 7, 8, 10, 11, 12, 13, 14 and 15 of the Key Sites Map to denote the proposed additional uses of retailing of camping and outdoor recreation equipment, white goods and home d‚cor items.
