Muswellbrook Local Environmental Plan 2009 (Amendment No 7) - Housekeeping Amendment

The planning proposal aims to make the following LEP and mapping amendments:-* Amend Schedule 4 Classification and Reclassification of public land to identify Lot 1 DP1143545 in addition to Lot 266 DP750926, Dorset Street,Kayuga.Both properties were mapped and exhibited for reclassification from community to operational lands as part of draft amendment No.95 to Muswellbrook LEP 1985. This reclassification amendment was later consolidated with the Muswellbrook comprehensive LEP 2009 to reduce the number of individual amendments. Although mapped as part of the reclassification, Lot 1 DP1143545 was inadvertently omitted from the legal drafting.* Amend Schedule 5 Environmental Heritage. This amendment will involve reviewing and updating all heritage item descriptions to accurately refer to the relevant items (no new heritage items will be added), reformatting the heritage schedule to separate heritage items, archaeological sites and conservation areas in accordance with the Department's standard instrument requirements and to correctly label all heritage items on the accompanying LEP maps.* Amend the RU1 Primary Production and E3 Environmental Management land uses tables and make eco tourist facilities permissible with consent. It will also be necessary to adopt the model clause 5.13 which provides the development requirements for eco tourist facilities and adopt the standard definition. * Amend and reformat all LEP maps to comply with the Department's Standard Instrument LEP mapping technical requirements. The Department's Planning Operations Coordination team has offered its assistance to review and update these LEP maps.The regional team has not been approached by a lobbyist.
