Permissibility of ancillary land uses around the Ingleburn Town Centre

To clarify that ancillary land uses (including home activities) within dwellings located on land adjoining the Ingleburn Town Centre are permissible with consent.The subject land applies to land to which clause 65 of Campbelltown LEP 2002 applies. Clause 65, a copy of which is attached, applies to certain land within the 10(b) District Comprehensive Centre zone at Ingleburn, as shown hatched on the attached map.Clause 65 prohibits all development on the subject land except for residential flat buildings. However, Council advises that, when the clause was introduced, it was intended that home activities be permissible on the subject land.Home activities are currently classified as exempt development under the provisions of Campbelltown LEP No. 209 - Exempt Development. This has created some confusion, whereby ancillary uses, including home activities, could be considered to be a prohibited development by clause 65.The subject planning proposal will clarify this situation by amending clause 65(2) of the LEP to clearly indicate that ancillary uses are permissible.
