Review of State Environmental Planning Policy 44 (Koala Habitat Protection)


The NSW Government sought your feedback on a proposed amendment to State Environmental Planning Policy 44 – Koala Habitat Protection (SEPP 44) from November 2016 through March 2017.

An Explanation of Intended Effect (EIE) was prepared to explain the intent of the proposed amendment to SEPP 44 to change the definitions of koala habitat, expand the list of tree species,update the list of councils and the development assessment process.

Following the review of SEPP 44 and submissions during this consultation a State Environmental Planning Policy (Koala Habitat Protection) 2019 was created and now replaces SEPP 44.

The new Koala SEPP utilises the best available science while continuing the aim of SEPP 44. You can read more about it at: https://www.planning.nsw.gov.au/koala-habitat
