I object to this latest modification to the original DA because again it
takes the building height over the maximum height limit allowed for in
the current zoning. I purchased my apartment (opposite the
development) in good faith allowing for those current building height
limits, presuming that my views outside the height envelope would not
be blocked.

If modifications are allowed to be made to height limits imposed by
Newcastle Council, why have height limit controls in the first place!
If developers cannot work within those imposed limits, they must not
proceed with the development application/construction in the first
place.

I refer to the proposed amendments for the above development,
specifically the further increase in the maximum building height (i.e.
rooftop plant increasing by 1050mm, parapet increasing by 300mm and
planters increasing by 250mm).

The existing approved height of this development is already not
compliant with The Newcastle Local Environmental Plan (NLEP) 2012 as
it exceeds the 24m control by 3.28m or 14%. The developer is now
seeking to increase the overall height of the development by a further
1.05m (meaning that it will exceed the 24m control by 4.33m or 18%).
This is a significant increase beyond what the NLEP allows and I
hereby declare my objection to this amendment. Being an absolute
waterfront site, it is imperative that height limits in the NLEP are
adhered to as the visual impact of a development of this size is
significant to neighbouring properties. The height control in the NLEP
for this site has been set so that all residents in the city can enjoy
views to the Hunter River and exceeding this limit by 18% is
detrimental to all other residents in the area.

As an owner of a unit at 10 Worth Place, Newcastle NSW, I purchased
the property on the basis that any future development at 50
Honeysuckle Drive would be fully compliant with the NLEP. Whilst I
knew that the water views I currently enjoy would be reduced by
development on the site, the proposed further height increase above
and beyond the NLEP is excessive. Had I known that the height limits
in the NLEP would be exceeded, I would not have purchased my current
unit as the additional 4.43m of height (particularly in relation to
Building C which is directly in front of my unit) directly impacts my
views to the Hunter River and will have a detrimental impact on the
value of my property.

In relation to the proposed removal of the Anti-Graffiti condition, I
have no issue with the requirement for anti-graffiti coatings being
removed, however the requirement that any graffiti evident on the
exterior facades and visible from a public place is to be removed
within 48 hours must be retained. This condition is imposed on all
buildings in honeysuckle and this development shouldn't be exempt.
There is a high frequency of graffiti in the vicinity and it is
imperative that this building be required to remove graffiti with 48
hours like every other building.

As an owner occupier at 10 Worth Place I oppose these modifications due
to the fact that the development would exceed height LEP controls. I
bought my apartment knowing what the height limits were for the site -
exceeding the height controls will further (and unfairly) reduce the
view for myself and other residents. Therefore this proposal will also
unfairly impact the value of apartments at 10 Worth Place.

Last year myself and others made submissions opposed to the
development exceeding LEP height controls, and the plans were revised
to keep Building C (directly across the road from 10 Worth Place)
within those height controls. Nothing has changed in the past year to
make exceeding those limits any more acceptable.

Height controls are there for a reason and I don't believe submitted
plans to exceed them is a reasonable or responsible action.
