The Berry By-Pass .... thoughts of a Berry Resident. It would be laughable if it were not so serious. The placement of a very busy highway (by-pass) at the very edge of the Berry township ... it couldn't be any closer than the preferred option than the preferred option if they tried.

This highway will carry over 20,000 vehicles per day. The environmental damage that will be created by this monstrosity cannot be tolerated. It must be stopped now before it is too late.

Berry will be devastated if it proceeds.

Noise pollution will be vastly increased. The present speed limit in town is 50 kph. The proposed speed limit will be 100 kph. Therefore traffic noise will be increased dramatically.

A noise barrier wall is proposed at 4 meters high, but only in some places. This is about the height of an exhaust stack of a diesel truck and will have little impact on noise reduction.

Noisy motorbikes can be heard kilometers away and the noise walls will have no impact on these machines travelling at 100 kph.

Engine retarder brakes from diesel trucks will also be a major problem on the bridge approaching Berry.

Exhaust pollution is a very serious issue and it is well known of the medical problems caused by vehicle exhaust systems. Being so close to the township of Berry, the resultant exhaust gases will drift over the town continually and many people, including children, will be affected.

At the present time, the location of this proposal is comprised of parks, sporting fields, and other restful recreational areas. In a pristine landscape which is quiet and unaffected by traffic.

The proposal will destroy forever which Berry now has, and if constructed will be there forever

In the future, people will say "Who on earth allowed this to happen? They could have put it anywhere else away from the town and the further away the better."

There is no excuse for this project in this location.

A rail line was built alongside Berry on the south side about 100 years ago, but the RMS today say it is too difficult and costly to follow that route. Nobody in Berry believes this and it would appear to be a pathetic excuse to follow their preferred option.

This preferred option is a term created by the RTA (RMS). Nobody in Berry would call it "preferred".

It is interesting that the Minister for Roads does not live in Berry. The local Member does not live in Berry. None of the RMS Road Planning Department live in Berry. If they did, this proposal would never even have reached the drawing board.

The proposed proposal design itself has numerous faults and impacts adversely on Berry and its inhabitants. There is only one exit to Berry when travelling north from Nowra. Vehicles exit at a very confusing and poorly designed roundabout at Kangaroo Valley Road.

This area is destined to be a bottleneck and create problems which do not currently exist. There is no exit to Woodhill Mountain Road at the north side of town.

Victoria Street is planned to be a culdesac at the present highway, causing undue inconvenience to all residents and forcing motorists to travel back into Queen Street before proceeding south.

This whole proposal is nothing but a huge, expensive and unnecessary mess. This by-pass design clearly demonstrates that the passage of traffic is paramount and Berry gets nothing but inconvenience, noise and pollution.

An alternative by-pass is the only solution and the proposal, as submitted, should be rejected on environmental grounds as well as undesirable and unsympathetic design features not in keeping with the history and ambience of Berry.

The RMS is obviously committed to only one thing - the movement of traffic. They have shown no consideration or benefits for Berry, or the welfare of its inhabitants.

NOISE WALL: There were several different types of noise walls offered for selection. The most effective is a high, near vertical wall, which would direct noise upwards. RMS chose to have a wall of low height, then taper away at a low angle so that it is much less effective. RMS can't even get the noise wall right.

I am responding to a leaflet that was dropped in my mailbox asking if i want Victoria Street left open after the Berry Bypass is completed.I personally want it closed off to major traffic as i own a property on the corner of Victoria Street and XXXX XXXX .Currently the amount of traffic that goes through here is of such a high volume (cars and heavy trucks to a lesser degree)the constant noise of traffic going up Victoria Street to meet the highway at the south end of Berry and also cars that turn left or right into Prince Alfred Street is at times too much!Those people who live in streets off from Victoria Street don't have a problem with it left open as the constant traffic noise does not concern them for obvious reasons but i for one would certainly welcome the closure as Victoria Street runs parallel to the main street through Berry,that being Queen Street so many cars take the less congested route to get back on the highway.I might also say that many times there are cars that don't stck to the 50kph limit on this street which also is a danger to the public.

OPTION 1 PROPOSAL

CLOSURE OF VICTORIA STREET

I hereby present my submission in regard to the Berry ByPass and ask that while you are considering, negotiating and making final decisions, would you please consider extending the now available access road to the farm property, adjacent to the highway south, to include access to the land at BUPA. (Option 1 Proposal).

I am a resident of The XXXX and daily share Pepper Farm Drive with XXXX Residents, XXXX employees, visitors, trades people and the occasional Ambulance. The shared road to BUPA is not ideal due to associated traffic problems, particularly at `knock off' time for employees. BUPA traffic accessing this shared road at present, is far greater than Arbour traffic and with any future expansion of either The Arbour and/or BUPA, will mean even more traffic by both parties and more aged residents sharing the road.

You proposal points out one of the opportunities for Option 1 - is

. Best meets the project objective of improving road safety by reducing potential vehicle and pedestrian conflicts.

This is precisely my point for requesting that consideration be given to planning for extension of the `already' available access track to the farm property, to include BUPA.

FOXGROUND AND BERRY BYPASS

SUBMISSION ON THE PROPOSALS FOR VICTORIA STREET

I support the closure of Victoria Street for the following safety reasons.

- There is provision of access to the bypass via Queen Street. A second access within the short distance from Queen to Victoria will continue to unnecessarily complicate the merging of south bound traffic and thereby reduce the safety margins.
- The development of the retirement villages of The Grange and The Arbour and the aged care facility of Bupa at the Western end of Victoria Street has created a concentration of older residents of Berry. Expansion of each of these is planned so the number of older residents in this precinct will grow. Preventing through traffic here will make it significantly safer for these residents when venturing out from their homes.

I AM OUTRAGED, DISGUSTED and feel UNHEARD that the RMS has shown Victoria Street to be closed on not only the plans but on the video that was produced recently. There have been MANY community meetings/forums regarding this issue and there are many people in this community who disagree with having Victoria Street closed. You have now divided a once close-knit hub of people, purely because a couple of residents in Victoria Street pushed to have it closed and had a Notice of Motion put through at council by an in-experienced councillor. The council have since done traffic studies which prove how other small streets within Berry will be impacted if Victoria Street will be closed. The small, narrow streets which will carry the traffic if Victoria Street is closed have no footpaths and would make it very dangerous. It would be a fatality waiting to happen. I plead with the RMS to keep Victoria Street open for the safety of this town.
In the plans and video that has been produced, all 3 options show that residents living on the southern side of Berry would have to go through THREE roundabouts to access their home. WHY is it not possible to just have a simple fly-over into Victoria Street coming from the southern end which crosses the highway. It happens in many other places. WHY would you congest and increase the traffic around Kangaroo Valley Road and all the people that live there?
There has been so much community discussion regarding this topic (for the last year!) and this option for Victoria Street to be closed only came about due to the fact that a few residents who live in Victoria Street happened to be on the P&C committee at the local school. They then went about collecting signatures from people at school drop off/pick up (when most parents are so busy and hardly thinking about what is getting shoved at them through a car window with the person with the petition stating `it is for the safety of the school children' so most of them went ahead and signed the petition without knowing the exact situation. This is what happened a year ago and then a local councillor decided it was a good idea to take it to council and got a Notice of Motion passed.... And here we are today with the RMS showing Victoria Street closed!
Another petition quickly did the rounds to state that we didn't want it closed however we were only given a certain amount of time to respond. Since then there have been numerous community forums and meetings, many of which were held in the evenings and unfortunately many of us were unable to attend. I am well aware of the impact on nearby streets if Victoria Street was closed. It is totally UNFAIR that traffic would be forced onto small streets that are not capable of high volume traffic. This is evident in the traffic study done by local council so WHY is the RMS over-riding that decision. You people don't have to live here - we do! It would only be a matter of time before an injury/fatality occurred if you chose to close Victoria Street. I urge the RMS to not close Victoria Street, it would cause absolute chaos.
Why should so many other residents of Berry be inconvenienced if Victoria Street being closed. It has been an integral part of the Berry streetscape for many years and a street that many people use. The residents who are complaining have only lived in Victorai Street for just over 5 years, knowing full well that it was a busy street. Now they are tryinig to change things.
This situation has divided many people in this small town and I think the RMS should take reasonable measures to rectify this situation by putting out a vote to ALL People in the 2535 postcode to ask everybody's opinion in a FAIR way. Not everybody will put pen to paper and write to the RMS but if you wrote a letter to them outlining their options and all they had to do was tick the box and have a return envelope included, then this whole decision process could have been completed many months ago.

It was only approximately 5 years ago that developers from Sydney purchased the land which is now the Arbour and BUPA and next to that is the Grange which, together, houses up to 1000 people (which are all situated at the western end of Victoria, near the corner of the highway. Along with that are the associated people that service these villages and care facilities, such as nurses, gardeners, administration staff and tradespeople. Currently they are able to access these places from the highway by turning into Victoria Street. Should Victoria Street be closed, they would have to congest the rest of town by filtering through all the little narrow streets with no footpaths. Along with that are all the residents who would have to also go up Victoria Street to access the township of Berry. Once again, having to use the narrow streets such as George and Edward, congesting the town and having to go past the school. Many people have questioned how closing Victoria Street would make it safer for the school children (such as what was being stated in the petition by the P&C Victoria Street residents to have it closed . Well, it simply wouldn't make it safer. It would just make those parents on the P&C happy that their street would be a quieter street. It was always just about those people and the developer who owns the Arbour - these are the people that pushed for Victoria street to be closed in the first place. It is an ABSOLUTE DISGRACE AND INSULT TO THE REST OF THE RESIDENTS IN BERRY. It is absolute NEGLIGENCE to build an over 55's housing estate for these people then push for a road that accesses the highway to be closed so that they would be forced to drive up Victoria Street and virtually do a large circle before they end up on the highway, increasing their travel time by an extra few minutes. What about ambulance access, not for IF there an emergency but WHEN. Did the developer think of that or are they thinking of the thousands of dollars they gain when these people die because emergency vehicles are unable to get to the residents in time.

This submission is in reference to the the issues associated with the design of the proposed relocation of the Berry Equestrian Centre. due to the proposed Foxground and Berry Bypass. This submission concerns the impact this bypass will have on our Riding Club Grounds in North Street, Berry. Our competition grounds need to be at least 140 metres by 140 metres with a level good riding surface which has very good drainage so we can have enough area for 4 dressage arenas or two show jumping arenas for our Club.
We need a large separate area for parking all the horse floats and trucks with enough area to maneuver, enter and exit in safety. We need enough room between floats to load, unload and tie up horses without causing danger to other riders, horses and the general public. At least 160 x 100 metres is required.

With the location of the proposed riding area to the proposed expressway, the skate way / skate park, the public cycle way /walkway and North Street with the anticipated increase in noise with cars and trucks travelling at high speeds horse riders competing nearby could be disastrous.

Access to the grounds is likely to cross the public shared pathway. Horse floats and trucks also require an indented driveway of at least 15 metres to allow the vehicles to park off the road whilst the gates to the grounds are opened and closed.

All the non profit clubs that use the Equestrian Centre in Berry have put great effort and funds raised from their various activities to improve the centre. This includes:

Inproving the grounds with hundreds of tons of sand to make a good all weather surface for the riders.
Construction of a large shelter shed for officials, a canteen and spectators to watch events.
Construction of a machinery shed for the storage of all the clubs equipment for show jumping and dressage.
A second shed for the storage of Pony Club equipment and their show jumping trailer.
Safety fencing to protect the riders and horses from falling into the creek and gully that adjoins the grounds.


The benefits of the current Berry Equestrian Centre site are as follows:

It is near the Berry Sporting Complex for easy access to toilets etc.
It is close to the Berry township for all the visitors who participate in events.
It is well away from other roads and distractions for horses and riders safety.
There is easy access to the site for everyone and those from other areas.
There is good storage for all the equipment and it is held securely on site.
At the near by Berry Show Ground there is available overnight yarding for horses from out of town when they are competing in riding events.
The menbers of the Club's Commitee live within 5-10 minutes of the complex as many trips need to be made to unlock gates and transport equipment, food etc to events.

Victoria Street Design options - the closure of Victoria Street will move significant amounts of traffic onto other local streets which will require more difficult maneouvres; eg, the narrow bridges on Edward Street and will certainly redirect more traffic down George Street. The shortest route is through Victoria Street and at the western end of Victoria Street there is a lesser number of homes and many are set back from the road. All southbound traffic from The Grange, The Arbour & Windsor Drive will be redirected back along Victoria Street & George Street. As someone who uses this route almost daily to travel to Nowra/Bomaderry, I favour Option 3.

The Issues Associated with the Design of the Proposed Relocation of the Berry Equestrian Centre


This submission concerns the impact of the proposed Foxground and Berry Bypass on the Berry Equestrian Centre which is located in North Street Berry.


The design and loss of land of the proposed relocation of the Berry Equestrian Centre will have a significant impact on the ability to conduct events. It will impact riders, participants and spectators in the following ways.


The competition grounds are required to be rectangular /square in shape of a minimum size of 140 metres x 140 metres with a level, well drained, good riding surface in order to cater for at least 4 dressage arenas or 2 showjumping arenas.
The parking area is required to be of a minimum area equivalent to 90 metres x 160 metres and allow for easy entry, maneuverability, parking and exit of horse floats and trucks. Each parking space is equivalent to an absolute minimum of 4 normal vehicle spaces due to the need for unloading/loading and tie up areas for horses.
There is concern for the safety of horses, riders and the general public due to the near location of the proposed riding area to the 4 lane expressway, the skateway, the public cycleway/walkway and North Street. There will be anticipated significantly increased noise and visibility of cars and trucks travelling at 100km/hour on the expressway with horses competing nearby, often with young, very inexperienced riders.
Access to the grounds is likely to be across a public shared cycleway/pathway. The safety of children on skateboards, bicycles etc are at risk as horse trucks and floats cross the pathway. Horse floats and trucks also require an indented driveway of at least 15 metres to allow vehicles to park off the roadway whilst gates to the grounds are opened.
The nonprofit sporting clubs that utilize the Equestrian Centre have put significant effort and funds raised from their activities into improvements at the Centre. This includes:
a) improving the grounds through leveling and backfilling with hundreds of tonnes of sand in order to make a good all weather riding surface
b) construction of an administration/shelter shed for officials, canteen and spectator viewing area
c) construction of a machinery shed for storage of dressage and showjumping trailers and equipment
d) location of container and construction of a storage annex for pony club gear and secondary showjumping equipment
e) safety fencing to protect riders and horses from falling into the adjoining creek and gully


The Benefits of the Current Site

There are a number of benefits of the current location for the Berry Equestrian Centre. These include:
It is located next to the Berry Sporting Complex so access to toilets and other amenities are nearby.
It is in close proximity to the Berry township which is of benefit to visiting participants both prior to and after events.
The competition arena is located away from other distractions such as the skateway, roads and other public facilities.

Issue 1: Bus Facility at Toolijooa Road.

For northbound traffic, provision should also be made for a bus stopping bay opposite the new Toolijooa Rd T- intersection at about CH7700.
Benefits would include:
- no need for the bus to divert to the Bus Facility on the southern side of the upgrade
- passengers would be visible in advance thereby avoiding unecessary delays on days where passengers do not show up.
- the bay could be incorporated into the road shoulder at minimal cost

Issue 2: Southern Entry/Exit Ramps to P.Hwy Upgrade at Toolijooa Road.

Direct entry/exit ramps to the south at Toolijooa Road should be reinstated.
Under the current design proposal, any traffic stopping at Toolijooa Rd including buses are unable to rejoin the Upgrade and would be required to travel for half the length of the Stage 2 Upgrade to access a southern ramp.

I am objecting to the closure of Victoria st as proposed in the EA. The closure of Victoria St will not preserve the future of Mark radium park as suggested. It's main use is as a travellers stop and the closure of Victoria st will make access to the park difficult for travellers and hence they will not stop there. Locals will not use it as it will be a park adjacent to a freeway on-ramp with cars accelerating down the hill.
On the traffic front the closure of victoria st will have unaccepatable impacts on the local streets, especially George and Edward. All of the residents who live in the western end of Victoria and Windsor drive plus the residents and workers at the Arbour,Grange and Bupa will all have to access the Princes highway via these local streets. The bypass with Victoria st remaining open will already significantly reduce traffic at the Western end of Victoria St with increases on the side streets. As a matter of fairness there is no justifcation to further reduce traffic in victoria st by closing it and further increasing traffic in George, Edward and Albany streets.

I object to the closure of Victoria st and support the option 3 with two way local rd passedmark radium park as proposed by the Council Traffic engineer.

Lack of Noise barriers.

The information provided appears to have no noise barriers proposed on the eastern side of the bypass from Queen Street to Victoria Street adjacent to Mark Radium Park . Currently their is a 50klm speed zone in this area on a two lane highway. RMS must correct this error (I assume it's an error) and develope plans to install noise barriers in this area to ensure the increased noise from a 4 lane bypass at 110klms does not impact our homes which are adjacent to Mark Radium Park.

Southern Route

This is not a Bypass as it does not Bypass Berry at all. I understand a southern route is more expensive but why do RMS have to split a community, that cost can not be measured. Make this a true Bypass of Berry and Bypass it.

Victoria Street Must remain Open.

The basis for which the EA was proposed was to close Victoria Street at the Western End (where it mets the existing highway). RMS stated, incorrectly, that the majority of Berry residence wanted it closed, this was and still is untrue, this road must remain open for two traffic for a number of reasons.

Option 1 was chosen by RMS for reasons that were untrue and very misleading and should not be considered for the following reasons:-
- firstly if I or any of the residance of the 3 aged villages and one age hostel were to require and ambulance for any reason it would take approximately 90 seconds longer to get to my house than it would if Victoria street was to remain open, in both directions. I would have to assume a similar time to return to the bypass. My families lives and indeed the lives of hundreds of aged people who reside in the vilages off victoria street who may need an ambulance could be saved if 3 minutes could be removed from the time it takes to get to hospital.
- second, their is no other exit from Berry to the south if Queen street near the proposed Kangaroo Valley road overpass were blocked if Victoria Street were closed.
- third, if Victoria Street were to be closed Mark Radium park would not be used by the passing tourist at all, due maily to the fact they will not see it and can not get to it. It will fast become a local hang out again and a dummping ground for even more unwanted rubbish (remember I live next to it and have done so for the passed 26 years)

As a resident of The Arbour, I do not support the closure of Victoria St, but am strongly in favour of proposals to revise Option 3, which involves extending the road past the Vannini property further south to allow the inclusion of a separate entry/exit point for all BUPA traffic. Currently BUPA traffic including staff, visitors and service vehicles must use the only access road - Pepper Farm Drive - which is the private road to The Arbour.
This shared traffic arrangement is not satisfactory as our private road is regularly made unsafe to Arbour residents by breaches of the 20kph speed limit when BUPA staff enter and leave on shift changes, and tradespeople and delivery vans speed down our main thoroughfare. This is despite frequent attempts to liaise with BUPA management to try to resolve the problem.
The extension of the road in Option 3 would be a simple, relatively cheap solution to an issue that will only escalate when BUPA increases its capacity with a proposed extension and our resident numbers are boosted when construction of our village is completed. Currently there are about 100 residents, but there will be about 160 when all houses are finished.
I strongly support the submissions made by several other Arbour residents to revise Option 3 and continue the road past the Vannini property to allow access to BUPA.

In regards to the three options for Victoria Street we would be happy with either Option 2 or 3 to keep it accessible for vehicles going south. We do not wish it to be closed as we and most people who live on the eastern side of Berry always use Victoria Street when going to Nowra.

I am greatly disappointed this will impact on the Berry Riding Club. As an adult rider it is the only club in the vicinity where I can ride with my children together as a family. There are no other clubs which offer the variety of activities for both adult and child together.

It is disappointing that the proposed route does not bypass Berry, but rather, bisects Berry. However, given that this is now the confirmed route, I would like to make the following comments:

Victoria St / Mark Radium park:
Of the 3 options, I would like to express support for option 1. I believe that this retains and enhances the residential nature of Victoria St. Importantly, it offers safety improvements for the most vulnerable pedestrians in our community - children and the elderly. This is particularly important as the school and several retirement facilities are located on Victoria St. Option 1 retains the most land for Mark Radium Park. It makes good design sense that the south bound on-ramp should run off Queen St, and not a residential street.

Town Creek:
I have concerns that the diversion of Town Creek will have detrimental ecological consequences to the creek. The creek has the potential to be an attractive part of the Berry township, however, if it is diverted, the flow volumes will drastically reduce, and it essentially becomes reduced to a storm water drain.

This property was listed on the Shoalhaven Heritage Inventory of the State Heritage Register - SHI 2390150, Study Number B093 but hassince been removed.

It is owned by the Department of Roads and Maritimes Services (RMS) and is directly in the path of the Foxground to Berry Road Project. It is my understanding that the RMS has agreed to advertise for someone to remove it at their own cost but if no one is interested it will be demolished.

The cottage was originally built in the 1870s and as such is equivalent in age to the earliest houses built in the town which are listed on the State Heritage Register in the Pulman Street Heritage Conservation Area. It is also in a much more original state than one of the most historically significant houses in that precinct, namely Pulman's Cottage, with the two parts of its history (1870s and federation) clearly seen. I have inspected this house and believe it to be worthy of saving - its later additions are particularly interesting in addition to its core which is believed to be much older.

In my opinion the preferred outcome would be for the RMS to not demolish if no buyer is found but to consider relocating this cottage to a suitable location in the Berry locality, engaging in a public/private partnership if necessary.

I believe that the decision to bisect (not By-pass) Berry has been an extremely poor decision for our SMALL country town in terms of amenity and Berry's relationship to its environment. I believe it will severely compromise Berry's sense of place. However, I acknowledge the consultation process and therefore support the proposed design.
In particular, I support the decision to close Victoria Street:
*Queen Street is the most appropriate and logical street to reconnect with the Princes Hwy;
*Victoria Street, whilst principally residential, is fronted by the school, Show Ground and seniors housing which already generate extra traffic. Closure of Victoria Street preserves and enhances the residentail nature of the street.
*Closure of Victoria Street ensures the safety of the most vulnerable members of our community.
*Traffic calming devices should be installed in those streets impacted by closure of Victoria Street.

Town Creek is integral to Berry's sense of place. The diversion of water from a significant area of the Town Creek catchment will leave the town with a dry drain instead of the viable and attractive stream we now have. Town Creek should not be a casualty of By-pass design, further compromising town amenity. Instead I suggest that the 'normal' non-flood flow into Town Creek be piped under the By-pass in order to maintain Town Creek flow, and that the new channel designed to divert Town Creek water to Bundewallah Creek be used for excess and flood flow.

I feel that the bypass has taken the value from properties on North Street. Seems to be an issue with potential buyers. Therefore, we have to reduce the price again to try to sell the property.

We would like to take the opportunity to object to the protect on the following points:
- increased noise level from the bypass and the proposed bridge which will also increase the noise level upwards.
- asthetically the motor way and the bridge will take away from the charm and beauty of Berry. The Bridge is particularly high and unsightly.
- a simple answer would be to put a low bearing pedestrian bridge at either end of the village thus only allowing car access because of height access. Create a diversion for the the large trucks via Beach Road, plus this would be extremely cost effective. Beach Road as a bypass is the least obstructive to residents, businesses and the general beauty of Berry. Understanding the costs involved, this is surely the best long term solution for the village of Berry.

I support the proposal. I do not want the plan to change. Provided there is a left out only from Victoria Street. I do not want an entry into Victoria Street from Queen Street.
