I am appalled by the manner in which the RMS has lied to the people of Berry in regard to the closure of Victoria street. During the early stages of the community consultation process it was stated by the RMS representatives that although the diagrams showed that Victoria St being closed it did not mean it would be so in the final design, it was show that was only for the purposes of discussion, in spite of repeated protests by Berry residents, The RMS has treated the residents of Berry with utter contempt.
Victoria St is a main feeder onto the Highway for the southern sections of Berry and the closure of Victoria St southern access to the highway will push an unacceptable amount of traffic onto local streets unable to accommodate the increased load.

As a registered stakeholder in this matter I refer to previous submissions from myself and family and again lodge strong objections to the acquisition proposal of part Lot 2 DP593476.

I once again advise that under no circumstances will I agree to such acquisition.

The property was acquired by me for the purpose of providing safe and environmentally desirable residences for my family, combined with opportunities to pursue agricultural purposes. Any reduction in area will adversely affect both present and future entitlements to build upon and occupy the property.

Much of the land proposed to be acquired is flat fertile prime agricultural land which is required for access to our proposed home sites, for water catchment, and for general agricultural purposes... including safe accessible stockyards for delivery and removal of livestock, and for necessary yard work.

The dam that is proposed to be acquired would remove our main water source. Relocating the dam is not feasible, nor is it an option, not only would the cost be prohibitive, but there is no other suitable catchment replacement area available.

The improvements on the said land, of dam, stockyard, fences, and private internal access road have been strategically placed and constructed at considerable personal expense and are required for the proper usage of the property for residential and agricultural purposes.

Our safe access for critical maintenance of the hillside would be eliminated should the flat area frontage be acquired, plus fire dangers, falling rocks, erosion and land slippage would greatly increase.

Access to the southern neighbours property would be more practical and of less environmental impact if coming from the south, instead of cutting into the hillside and maintaining a long winding access to the southern property along my property boundary.

Locating the Highway to the east would avoid cutting into the hillside, and would result in far less environmental destruction, and considerably less wastage of land areas.

Regarding: Princes Highway Upgrade - Foxground and Berry Bypass
I strongly object to the proposed section of the bypass affecting our land at A441 Princes Hwy
Broughton.
Note our land is mainly effected to provide, what is in my mind, an unnecessary and easily avoidable
loop to access our neighbours property.
1 - by taking any land from our property, it will remove a house site and managers residence to be
built on the property.
2 - the dam that is proposed to be acquired will remove our water source for over half of the entire
property, (200 acres) also relocating the dam could not give us the catchment area needed to supply
water to our cattle.
3 - the access road to the southern neighbours property, would be more sensible to have from the
south, the house has a long access way that is on the south corner of our property, and this would not
require a huge loop which is proposed now. If you were to make the access to the south would be a
more practicable option and would not require the cutting of our hill side and long and winding road
4 - by taking our flat are at the front of the property removed our access needed to be able to
maintain our hillside
We would like to see the Hwy moved to the east which would mean less cutting of the hill side and
and less waste area for road reserve would then be required

# RMS purchase this property from us because it has been COMPLETLY DEVALUED / WRECKED by the proposed current highway upgrade.We were going to build and currently have a $40,000 house frame still sitting in boxes on the property, rusting. As we no longer wish to live there due to having our access wrecked/ reduced to one way and an unsightly noisy turning bay proposed directly across from our site. As the site is elevated we will cop all the noise and have to look at the turning bay and see all the extra traffic day and night. The value of our land was in its scenic private outlook and its easy access. RMS has wrecked both with the current propasal. I dont want to have to drive into BERRY first before I can turn around and drive back into NOWRA OR LOOK at extra traffic in the turning bay OR HEAR extra traffic in the turning bay.

If RMS will not purchase the land:
# RMS to provide high noise attenuation barriers to protect our property from the increased noise. There is nothing between the proposed tuning bay and our property to stop the noise.
# RMS also provide visual barrier from unsightly proposed turning bay in Mullers Lane and increased traffic activity in direct visual line from our property.

XXXX XXXX: Requests

# 6ft chain fence reconstruction/ realignment from the current border of the highway on council land. Move back chain fence to the border of our property (which will be the new border to the Princes Hwy once it is widened). We currently require the 6 ft cyclone chain fence to keep in our large draught/clydesdale horses as previously discussed.
# glazing on front and side windows to house for noise attenuation

I object to the current plans as there is lots of wasted land from the access roads as well as negatively affecting the usable land on the farm I plan to settle down with family.
In the past I was of the understanding the road was positioned further to the east and I'm disappointed with the changes that seem to have been made

1) I believe that the RTA RMS route selection process was based on extensive detailed studies and community input and was transparent, democratic and fair.
2) Due to the extensive damage which will be done to the environment due to the construction of the route, steps must be taken to compensate for this - including massive replacement plantings etc.
3) Destruction of forest, trees etc should be done in a season that will least affect the fauna whose homes are destroyed - ie not in a breeding season.
3) The RMS must ensure that appropriate plantings are done to screen and soften the look of the new route.

I am extremely concerned about the possible changes to the overland flow stream predicted by the the proposed embankment structure on the Broughton creek flood plain between bridge one (1) and bridge three (3).
My property is situated on the flood plain downstream from the proposed road structure.
The surface and groundwater studies are based upon the 100 year flooding event.
Local knowledge experienced by my family since 1974 witnesses much more regular flooding occurrence within this floodplain.
I submit that no embankment should be built upon the Broughton Creek floodplain.
The proposed structure should not involve an embankment.
The road should be built in the same manner as the Minnamurra River flood plain on piles to allow minimum interference with the creeks natural flow and floodplain.
This would alleviate any uncertainty associated with the possibility of increased erosion and water velocity upon the floodplain and buildings built upon it downstream.

As a volunteer at the Berry Riding Club Competitions, I would like you to take into account the following points:

The Issues Associated with the Design of the Proposed Relocation of the Berry Equestrian Centre

This submission concerns the impact of the proposed Foxground and Berry Bypass on the Berry Equestrian Centre which is located in North Street Berry.

The design and loss of land of the proposed relocation of the Berry Equestrian Centre will have a significant impact on the ability to conduct events. It will impact riders, participants and spectators in the following ways.

The competition grounds are required to be rectangular /square in shape of a minimum size of 140 metres x 140 metres with a level, well drained, good riding surface in order to cater for at least 4 dressage arenas or 2 showjumping arenas.

The parking area is required to be of a minimum area equivalent to 90 metres x 160 metres and allow for easy entry, maneuverability, parking and exit of horse floats and trucks. Each parking space is equivalent to an absolute minimum of 4 normal vehicle spaces due to the need for unloading/loading and tie up areas for horses.

There is concern for the safety of horses, riders and the general public due to the near location of the proposed riding area to the 4 lane expressway, the skateway, the public cycleway/walkway and North Street. There will be anticipated significantly increased noise and visibility of cars and trucks travelling at 100km/hour on the expressway with horses competing nearby, often with young, very inexperienced riders.

Access to the grounds is likely to be across a public shared cycleway/pathway. The safety of children on skateboards, bicycles etc are at risk as horse trucks and floats cross the pathway. Horse floats and trucks also require an indented driveway of at least 15 metres to allow vehicles to park off the roadway whilst gates to the grounds are opened.

The nonprofit sporting clubs that utilize the Equestrian Centre have put significant effort and funds raised from their activities into improvements at the Centre. This includes:

a) improving the grounds through leveling and backfilling with hundreds of tonnes of sand in order to make a good all weather riding surface
b) construction of an administration/shelter shed for officials, canteen and spectator viewing area
c) construction of a machinery shed for storage of dressage and showjumping trailers and equipment
d) location of container and construction of a storage annex for pony club gear and secondary showjumping equipment
e) safety fencing to protect riders and horses from falling into the adjoining creek and gully

The Benefits of the Current Site
There are a number of benefits of the current location for the Berry Equestrian Centre. These include:

It is located next to the Berry Sporting Complex so access to toilets and other amenities are nearby.
It is in close proximity to the Berry township which is of benefit to visiting participants both prior to and after events.
The competition arena is located away from other distractions such as the skateway, roads and other public facilities.
There is easy access to the site for people coming from either north, south, east or west of Berry.
Horse float parking and maneuverability of vehicles is easily accomplished.
Storage of dressage, showjumping and pony club equipment is securely held on site.
Overnight yarding of horses is currently available at the Berry Showground which is only minutes away.
The Club Committee members live within 5 minutes as numerous trips are required to unlock access gates and transport ancillary canteen equipment etc to events.

Residents are very angry that RMS has only given "lip service" to the needs of Berry residents re this By Pass.
The off ramps onto Kangaroo V.Rd. will cause undue noise and traffic to hundreds of residents in the main part of Berry and also to the future developement of the town. We request that this interchange be moved closer to Nowra and so avoid congestion to the traffic in Berry.
We also request that Victoria St.remain open to reduce the extra traffic to the town should it be closed . If closed hundrds of cars would be forced onto George Street adding cogestion and unnessesary noise to the town..
