Change in processes for Class 2 residential developers
To support the ongoing work of the NSW Building Commissioner, the Department has enhanced two of its digital services: the Online Complying Development Certificate Service and the Online Construction Certificate Service.
This will enable developers and building practitioners to better meet their obligations under the Design and Building Practitioners Act 2020 and Design and Building Practitioners Regulation 2021, which both came into effect on 1 July 2021.
From this date, developers and building practitioners working in the Class 2 residential construction sector will need to meet new requirements when completing the relevant applications, including providing the names and registration details of practitioners.
Certain designs will need to be declared for compliance with the Building Code of Australia and other relevant standards before building work can start.
Declared designs will need to be lodged on the NSW Planning Portal through the relevant digital service and builders must then construct according to those designs.
Developers and building practitioners also now have a requirement under the Environmental Planning and Assessment Act 1979 to notify the relevant council/s at least two days before building work commences.
Under the Design and Building Practitioner Act 2020, declared regulated designs will also need to be lodged before building work commences.
