Modification appears to change or remove two conditions imposed on the Springvale Extension project a couple of years ago.

Major implications from the dumping of polluted water in a creek that feeds the Coxs River, which eventually flows to Warragamba - so a major issue for the NSW public.

Centennial were supposed to be reducing salinity levels - this project flies in the face of that committment.

This needs further examination by the department and by independent experts.

Springvale Mine should not be allowed to delay the cleaning up of their discharge water as this was one of the key "strict conditions" of their last mine extension approval. They (and other nearby coal mines) have been polluting our waterways for decades, and often exceeding the approved limits for salt, arsenic, cobalt, etc.

Has no one noticed that the price of coal has doubled in the last 6 months, so the coal companies can surely afford to implement any equipment required for an improved discharge water quality outcome. They install any new equipment quick-smart when it has to do with coal production, or any possible delay to production.
And Centennial's woeful 3 cents per saleable ton for the Lithgow Community fund will not have much impact financially when they are getting over $100 a ton. Why isn't this indexed to the price of coal?
Mine extensions should not be approved in the first place if the "strict" conditions are not adhered to, but are subsequently weakened in MOD's after approval.
The government must make the Springvale Coal comply with the current approval conditions, and not approve this proposed MOD, otherwise it makes a mockery of the whole approval process and the so-called strict environmental conditions of consent.

I strongly object to approval being given to Springvale Coal to modify the date from June 2017 to June 2019 re mine water discharges.
I live in the Lithgow area and see the environmental issues of the protection of waterways as paramount. This is my home and I want Springvale Coal to adhere to the end of June 30 this year to clean up their act.
I believe if they can't do it by this date in 2017 - they should cease operations altogether until the toxic water discharge issues into the Sawyers Swamp Creek and the Coxs River is resolved.
A further 2 years of chronic toxic discharge into my local waterways is unacceptable for the health of the river systems and local residents.

This consent modification proposal would cause on-going pollution of the Coxs River catchment, the Greater Blue Mountains World Heritage Area and Sydney's drinking water resources with toxic metal salts. Centennial Coal must not be granted legal relief arising from its foreshadowed default on the mine water discharge standards that it had previously agreed to with regulatory authorities.

Mine water discharges to Sawyers Swamp Creek that immediately flows into the Coxs River that is part of Sydney's drinking water catchment. Managing Director and CEO of Centennial Coal wrote to the Environment Protection Authority on May 29, 2015 to say that `Centennial acknowledges and agrees to the EPA's proposal for 700/900 EC limits as discussed in your letter'. The Planning Assessment Commission then placed these conditions in the September
2015 consent. I support the company's plans to remove mine water from Sydney's drinking water supplies by 30 June 2019 but Centennial Coal must be required to meet its consent obligations as agreed when the mine was approved.

Centennial Coal must install a temporary water treatment facility to meet the terms of its development consent so that mine water flowing into drinking water supplies receives at least a basic standard of treatment.

Further, this proposed consent modification is one of five modification proposals by Centennial Coal related to Springvale's mine water treatment.
The other proposals are: the mine water transfer, treatment and reuse at Mt Piper Power Plant; storage of treated mine water in Thompsons Creek Reservoir; the emplacement of waste from the water treatment plant; and effective treatment of highly polluting discharges from the emplacement area.

The coal mining industry has long demonstrated a propensity to submit modifications to mining approvals, typically before the ink has even dried on the original development consent. In so doing they have demonstrated an entrenched level on entitlement. Underpinning this process is the primacy of corporate economic gain over environmental and public health. It is even more egregious when one considers the overwhelmingly foreign ownership of these operations. Then, at the conclusion of mining, either due to deposit exhaustion or the deposit becoming uneconomic, we have the demonstrated inadequacy of rehabilitation bonds. At that time we have the cynical full display of the 'corporatise the profits; socialise the losses' paradigm that characterises coal mining in NSW (and Australia in general).

With that in mind, I vehemently object to the proposed modification of the Springvale Mine consent that would allow mine water treatment to be deferred for two more years. This consent modification proposal would cause on-going toxic metal salt pollution of the Coxs River catchment, the Greater Blue Mountains World Heritage Area and Sydney's drinking water resources.
Centennial Coal must not be granted legal relief arising from its foreshadowed default on the mine water discharge standards that it had previously agreed to with regulatory authorities. Mining undertakings, particularly in such an environmentally sensitive area, should be demonstrated to do not degrade the environment, at the least. Adding toxic substances to our drinking water clearly fails this test.

I suspect that the company's management is somewhat surprised that their application did not receive rubber stamp treatment.

Centennial Coal must install a temporary water treatment facility to meet the terms of its development consent so that mine water flowing into drinking water supplies receives at least a basic standard of treatment. Community standards and expectations have risen since the commencement of coal mining in the Lithgow region; Centennial needs to recognise and acknowledge this and adjust its methodology accordingly. The recent damage to swamps on the Newnes Plateau from collapse-retreat mining, and the range of dismissive responses by the companies involved, indicates that this is proving a challenging obstacle for them.

Further, this proposed consent modification is one of five modification proposals by Centennial Coal related to Springvale's mine water treatment.
The other proposals are: the mine water transfer, treatment and reuse at Mt Piper Power Plant; storage of treated mine water in Thompson's Creek Reservoir; the emplacement of waste from the water treatment plant; and effective treatment of highly polluting discharges from the emplacement area.

I make this submission as a private citizen with an extensive history in the mining industry, and a respect for the necessity of most of it for our modern society. However, a nuanced appreciation of the overall industry makes it clear that, rather than a continual relaxation of conditions applied to the thermal coal mining industry, all those involved should be working towards it's eventual closure, sooner rather later. The enormous amount of global warming research and associated literature make this a no-brainer.

I am writing to object to the proposed modification of the Springvale Mine consent that would allow mine water treatment to be deferred for two more years. I oppose this consent modification proposal for several reasons:

1) on-going pollution of the Coxs River catchment and Sydney's drinking water resources with toxic metal salts.
2) increased pollution to the Greater Blue Mountains World Heritage Area - this is NSW's largest wilderness area, and one of the few to survive relatively intact after hundreds of years of European habitation

Centennial Coal must not be granted legal relief arising from its foreshadowed default on the mine water discharge standards that it had previously agreed to with regulatory authorities.

Allowing such leniency to a large corporation sets a dangerous precedent for the environmental protection of both our amazing natural heritage, but also creates increased risk to Sydney's water supply.
