We are nearby residents who's quality of life will be affected by this project. This development request has deliberately bypassed the Tweed Shire Council as developers know full well the commercial aspect of the project does not meet community standards and Council Policy regarding height restrictions. We do not object to redevelopment of the nursing home for its current purposes at the height levels of existing buildings. We do however strongly object to the commercial aspect of the project which proposes construction of dwellings to levels exceeding the Tweed Shire Council's current height restrictions. The developer has no concern for the impact on local residents including its impact on off street parking which is presently strained due to the proliferation of duplex dwellings in the area. Our street is situated close to the proposed entry to the nursing/residential complex. Visitors to the complex will cause an overflow to our/nearby streets further impacting on already strained off street parking. Further the proposed multilevel building at the proposed main entry in Lorien Way is out of character and inconsistent with existing residential dwelling in the area. This is clearly a project designed to fund the coffers on the developers at the expense of residents in the area and should not be allowed to proceed in its present format. A main entry to the complex in Lorien Way is as inappropriate as the the proposal to build residential complexes on the site.

I object to the Uniting Kingscliff Development because it does not in any way fit in with the Kingscliff building heights .. it will impact the residents nearby with increased noise of traffic deliveries visitor cars .. lights shining into properties, solar will be affected and privacy will be lost.. increased traffic on surrounding streets from the 200 or so extra cars will have major flow on issues. The flood risk will be increased and houses will be in direct threat of flooding weather

I object to the Uniting Kingscliff Redevelopment for many reasons as follows.. this proposed development is a gross overdevelopment of the area, land area is a flood affected site.. additional fill will create flooding issues in surrounding area. Huge negative impacts on the surrounding residents including privacy, Solar access reductions, lighting shining into homes not to forget noise and congestion from increased traffic and deliveries. This whole development does not fit the guidelines of current building height of 13.6 m
It’s is using aged care as a cover up of a luxury apartment development and I very much object to the size of this design and the influx of over 200 people to the area

I absolutely reject the scale of the proposed project. As a Kingscliff resident who will be directly affected by the proposed project I find it unbelievable that those who claim to represent us could even consider a development of this scale. I can only assume that a proposal by the Uniting Church gives this ridiculous proposed development some form of higher status in the eyes of the NSW Government. In addition to falling short of meeting current building heights and creating access issues for not only the ageing residence and their families but for all Kingscliff residents it will set a precedent for future developments that absolutely no one should support. An aged care development is worthy of consideration but not one on this scale.

I object to the Uniting Kingscliff Redevelopment (SSD-47105958)These are the reasons why I have concerns:
1. It is a major flood basin which protects the other surrounding area and streets such as Beach street, and Loren Way from being flooded. In the floods of 2022 these areas were already flooded due to development in on Tweed Valley road that filled up the water drains above the river level which overflowed into areas that had never flooded before in Kingscliff.
2.The buildings will be on reclaimed land which poses further issues for flooding.
3. The maximum height above ground will be 3 meters higher than existing allowable building heights, and which will negatively impact the environment for local neighbors and the entire culture of Kingscliff which is currently unique in its zoning standards in providing a height levels a low impact on the skyline and environment.
4.Traffic impact, conditions of roads and amenities are already struggling with the new developments in the area.
5. Wildlife that live in the area will lose their habitat especially the bush stone-curlew who nest in the area that the development will expand to, and these birds numbers are significantly dropping in this area as they are a ground-dwelling bird endemic to Australia.
6.I urgently request that new designs are considered for this development to focus on sustainability for the local fragile environment and the local community.

2. Parking in and around the site for the 400+ workers who are expected to be involved with the construction is unmanageable for our small streets around the site.
3. The height of the completed buildings is above the allowable height that all other developers and residents must comply with, according to Council regulations
4. The application includes the block to be filled by over 3 metres and in doing so the height of the actual building will be much higher than other surrounding buildings
5. The addition of so much fill causes me great anxiety should another flood event swamp our region. Where is this intended water now to flow?
6. Lastly, the view to Woolumbin (Mt Warning) will be intruded on for ever for many residents beachside of the development, myself included.
We already have a monolith in the area surrounding Kingscliff by way of the new Tweed Valley Hospital. The community graciously accepted this as inevitable for the sake of the wider community.
This in no way gives another developer the green light to establish another ‘larger than life’ development which completely disregards the village type atmosphere that brought many of us to Kingscliff in the first instance. In particular, the proximity to other residential properties where community ties exist already.
We would rather see your community join in with ours, not us having to join in with yours.

I am concerned at the size of this project and the proposed height of the construction. Kingscliff residents have long held and objection to any buildings that are "too high". The thought process is that once the flood gates are opened, then there will be no stopping such developments. They do not want another Surfers, so-called, Paradise. The 3m raising of the ground, then adding a 16m building is such a project. It is too high and too big.

The development is by far too large for Kingscliff and the building height of 16.75 metres exceeds our current building height by 3 metres. The size of the project in this location will not be sustainable with the current road structure causing significant traffic congestion and traffic volume that the current roads will not support. The development is at significant odds with the character and low rise of the surrounding environment.

1. One of the main entrances to this new estate is near the end of Channel Place (our street). Beach St, Lorien Drive, and other steets in the vicinity are at parking capacity, particularly Friday to Sunday, with cars parked up and down all nearby streets. Beach Street and Lorien Drive are busy bus routes and you usually have to pull across a driveway and wait for a bus to go by as there is not enough room now for a bus and a car to pass on the roads. Some kind of other access to the new development needs to be worked out.
2. Building heights. 13.6 is the building height other developments have to comply with, so why should some of these buildings on the new development be allowed to go to 16.75 metres.
3. In the last major flooding event, residents in Beach Street had flood waters rising in their back yards. Our home was only about 1 metre from flood inundation from Elrond Street, which borders on to our back boundary. (Photos of views from Elrond Street during 2022 flood are attached) With all this extra fill being used on this development, what precautions are in place to ensure flood mitigation. The big question is, where is this water going to go if the development is built on fill in an area which the water usually goes, in heavy rains and flood situations.

Objection to Uniting Aged Care. redevelopment Kingscliff
I object to the Uniting Kingscliff Redevelopment ( SSD-47105958 )
* Gross overdevelopment of the site.
The 199 units in 4 storey blocks are totally out of character with the surrounding one or two storey buildings. The existing 13.6 metre height limit for Kingscliff will be ignored with blocks of units proposed to be built to 16.75 metres above ground level.
* Traffic congestion
Congestion during building will be a major concern/issue. Cars travelling along Beach Street at present have to stop to allow oncoming cars and buses to pass safely. There is virtually no onstreet parking available due to present residents taking up all available spaces. No doubt soil will have to be brought in to fill the development to the proposed height causing more traffic congestion. The associated building vehicles ( cranes,concrete trucks, building supplies vehicles ) will all have to use the narrow suburban streets totally unsuitable for the period of time proposed for this development. The new hospital at Cudgen has already caused a significant increase in traffic down Beach Street and Lorien Way as they provide an alternative access when coming from or going to the medical facility.
* Flooding
Flooding on the site and surrounding area during 2022 was severe. The height increase proposed with filling the land will mean the surrounding areas will be subjected to runoff from the development. At present the Flood Report conducted by the Tweed Shire Council for the area has not been released so any impact on this development is not known.
* Impacts on the amenity and liveability of residents
The negative impacts on the amenity and liveability of surrounding residents will be profound. With buildings up to 4 storeys high overlooking existing residences, privacy concerns are paramount.
As a resident of 6 Beach Street Kingscliff for 47 years I share a 48 metre boundary with the development. Building E, will front my entire block so that I will have the buyers of 24 units looking into my home. My bedrooms,kitchen,dining area, bathrooms and my entire backyard be private.
My backyard is at present more than a metre lower than the existing Aged Care facility. During the flood of 2022 I had a metre of water in my backyard because of the height of the present Aged Care facility and the the failure of their drainage system. One wonders what will happen during the next flood should the development be approved.
Planning indicates a basement carpark under Building E with access right against my fence line. Building works for this structure would no doubt restrict any natural flow of water away from my property during a flood.
I understand that there is a need for Aged Care Beds, but I object to the overdevelopment of the additional 199 2 and 3 bedroom units.

Having received the State Planning Development letter regarding the proposed Uniting Kingscliff redevelopment, the following are some major concerns i have about this proposed development:
1) the proposed development site and the direct neighbouring streets are flood prone.please see Tweed Shire Council flood awareness map.
In the major Tweed river flood in 2022 the streets directly beside the development site ( Beach Street,and Channel Place off Lorien Way ) were inundated with flood water from the storm water overflow) and Lorien Way storm water was at capacity.
My concern is that further filling of this area of the fold plain will cause further flooding and flooding of existing homes.
2)traffic in the narrow Kingscliff Street and Lorien Way is congested and also has cars parked all along them.so added car traffic will make these streets clogged with cars.
3) we own a duplex at 23 Lorien Way.the neighbourhood is quiet,suburban and all single or 2 storey homes.we want this character kept to limit 2 storey s to retain the character of this area of Kingscliff
3)I am happy for more nursing home beds and a renovation of the existing Nursing Home at this site.
4) i humbly suggest that a more modest size development for this site would be appropriate- similar perhaps to the Uniting retirement villas at Yamba maybe.

An impact from this increase in height, apart from being out of character, is the impact on the local inhabitants (Privacy, access to natural light). (I/We actually lived on Drift court (rented) for a year, and this would have been significantly impacted, IF this development had been in place prior to then. We remain good friends with other owners on Drift Court and this would be such a major change to them and all other "locals"
This should be significantly amended, and yes provide more accommodation for those in need, while respecting the important height limitations of this wonderful community.

I believe the scale of this project to be out of keeping with the built environment and character of Kingscliff. I am not against the extension and refurbishment of the existing nursing home but this project seems to be more about a massive seniors apartment complex which is higher and more dense than existing apartments in the town. My property is 23 Lorien Way, there will be 3 perfectly good properties demolished next door in order to create an access road. the prospect of4 to 6 years of construction and 400 plus workers using this road for 4-6 years , 6 days a week is not good. The area to be built upon is also part of a flood plain which was inundated in Feb 2022, some of the surrounding streets were flooded and the stormwater system was full. The surrounding streets are also very congested with both traffic and a lot of parked cars along with a bus route. Visibility at the new intersection would be problematic. the increase of construction traffic, trucks and workers would magnify an already poor situation.
