31 October 2023 Release: Concurrence and Referral, Online DA and State DA services and NSW Planning Portal

Concurrence and Referral Service[

To support reforms effective on 1 November 2023 to Clause 4.6 of the Standard Instrument, the following change was made:

• Removal of “clause 4.6 local environmental plan” from the concurrence and referral service, as there is no longer a requirement to obtain the Planning Secretary’s concurrence for a variation. 

Online DA and State DAs

To support reforms effective on 1 November 2023 to Clause 4.6 of the Standard Instrument, the following changes were made:

• “Clause 4.6 variation request document” type is no longer a conditionally mandatory document for “modification” development applications.
• Enhancement to the determination stage for development applications to capture whether the variation was approved, any related variations and a brief justification for the variation.  
• Updated help text for questions and document types relating to Clause 4.6 variations. 

Note: The reforms will only apply to development applications lodged after the commencement of the new clause. Any development applications lodged but not determined on 1 November 2023 will continue to be assessed under the previous clause. 

NSW Planning Portal

Content on the NSW Planning Portal was updated including:

• Updates to the BASIX identified technical issues on the BASIX support materials page
• Publication of details of all variation requests on the variations register
